CALL TO ORDER Mayor Man called the City Council Regular Meeting to order at 7:32 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember —Vizcarra, Yu, Chavez, Man ABSENT: Councilmember — Sternquist ALSO PRESENT: City Manager Cook, City Attorney Murphy, City Clerk Kuo, and Community Development Director Reimers Mayor Pro Tem Chavez excused Councilmember Sternquist for cause. Seconded by Councilmember Vizcarra. 3. INVOCATION — Jerry Jambazian, Wonder Cleaners and Draperies, provided the invocation. 4. PLEDGE OF ALLEGIANCE — Mayor Man led the pledge of allegiance. 5. CEREMONIAL MATTERS — PRESENTATION A. Temple City Chamber of Commerce — Introduction of new CEO John Bwarie Mr. Bwarie gave a self -introduction and is looking forward to working with all the businesses in Temple City. B. Recognition of Captain Mark Reyes City Council congratulated Commander Reyes on his promotion and thanked him for his dedication and commitment to the communities that he served. City Council presented Commander Reyes with a certificate of recognition. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Karmina Lopez, Los Angeles County Regional Parks and Open Space District (POSD), (responsible for administering Measure A) introduced their Technical Assistance Program (TAP). She announced that they have allocated $185,000 in City Council Minutes April 18, 2023 Page 2 of 6 TAP funding to Temple City to be used to increase park acreage. She shared that the City has already signed a master agreement with POSD to access the TAP fund. Jackie Fong and Roy, Temple City residents, expressed concerns regarding power surges and the damage that it has caused to their appliances and home equipment. 7. CONSENT CALENDAR Mayor Pro Tem Chavez made a motion to approve the remainder of the Consent Calendar Items. APPROVAL OF MINUTES The City Council is requested to review and approve: 1. The Minutes of the Special City Council Meeting of April 4, 2023; and 2. The Minutes of the Regular City Council Meeting of April 4, 2023. Action: Approved the Minutes of the City Council Meetings. B. SECOND READING AND ADOPTION OF ORDINANCE NO. 23-1070 AMENDING THE CITY'S RULES RELATED TO ARTIFICIAL TURF, LANDSCAPING, AND HARDSCAPE The City Council is requested to adopt Ordinance No. 23-1070 which would modify the Zoning Code related to artificial turf, landscaping, and hardscaping. Action: 1. Adopted Ordinance No. 23-1070 amending Title 9, Chapters 1 of the Municipal Code (Attachment "A") related to artificial turf, landscaping and hardscape; and 2. Found that this Ordinance is not subject to environmental review under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Sections 15061(b)(3) because it can be seen with certainty that the Ordinance has no possibility of a significant effect on the environment. Further, any project reviewed under this ordinance would be a class 1, 3, 4, or 5 categorical exemption. City Council Minutes April 18, 2023 Page 3 of 6 C. ADOPTION OF RESOLUTION NO. 23-5663 ORDERING THE ENGINEER'S REPORT TO ESTABLISH THE LIGHTING AND MAINTENANCE DISTRICT ASSESSMENT RATES FOR FISCAL YEAR 2023-2024 Pursuant to the 1972 State Lighting and Landscape Act, an Engineer's Report must be prepared for each fiscal year in which assessments are levied and collected for the District. Action: Adopted Resolution No. 23-5663 ordering the preparation of the Lighting and Maintenance Assessment District Annual Engineer's Report for FY 2023-2024. D. ADOPTION OF RESOLUTION NO. 23-5664 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2022-23 The City Council is requested to adopt Resolution No. 23-5664 authorizing the payment of bills. Action: Adopted Resolution No. 23-5664 authorizing the payment of bills. 8. PUBLIC HEARING A. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 23-1072, AMENDING TITLE 8 (STORMWATER POLLUTANT ELIMINATION) AND SECTION 9-1N-10 (LOW IMPACT DEVELOPMENT STANDARDS AND GREEN STREETS) OF THE TEMPLE CITY MUNICIPAL CODE TO COMPLY WITH THE MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) PERMIT The City Council is requested to consider adoption of an ordinance to amend the City's municipal code to comply with the Municipal Separate Storm Sewer System (MS4) permit. City Manager Cook gave a brief introduction to the proposed ordinance amending the City's code relating to Stormwater Pollutant Elimination and Lower Impact Development Standards and Green Street compliance. Management Analyst Coyne gave a summary of the staff report. City Council asked questions and made comments regarding the proposed ordinance relating to fines, compliance of the regulations, preventative measures, and tracking performances. Mayor Man opened public hearing. City Council Minutes April 18, 2023 Page 4 of 6 Steve Stafford, Temple City resident, asked how the regulations will be enforced. Hearing no further request to speak, Mayor Man closed public hearing. City Council made final comments. Councilmember Yu made a motion to: 1. Introduced Ordinance No. 23-1072 (Attachment "A") for first reading by title only; 2. Found Ordinance 23-1072 exempt from CEQA, per Section 15061(b)(3) and Section 15308 of the CEQA Guidelines; 3. Waived further reading of Ordinance No. 23-1072; and 4. Scheduled the second reading for May 2, 2023. UPDATE FROM CITY MANAGER — commented on the Easter event and the survey conducted by the city's parks playground project consultant. Deferred to Parks and Recreation Director Masumoto to provide a timeline for the parks playground project. City Manager Cook also announced the upcoming Neighborhood Watch meeting this Thursday. 12. COUNCILMEMBER VIZCARRA — commented on the -art. -project for -Primrose Park and reported on the Historical Society meeting he attended this weekend. D. MAYOR PRO TEM CHAVEZ — commented on the 100th year anniversary celebration of the city's township and remarked on the general aesthetics of Las Tunas Drive sidewalk. E. MAYOR MAN — directed staff to provide an update on the allocation of ARPA fund in a upcoming meeting for council consideration, commented on the Easter Event and the parks playground project survey, reported on Congresswoman Chu's City Council Minutes April 18, 2023 Page 6of6 Artistic Discovery Awards Ceremony that he attended, and commented on La Rosa Elementary School's STEAM event. 15. RECESS TO SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY DEVELOPMENT AGENCY MEETING At 8:48 p.m., the City Council recessed to the Successor Agency Meeting. Minutes of the Successor Agency Meeting are set forth in full in the Successor Agency's records. RECONVENE AS CITY COUNCIL The City Council meeting was reconvened at 8:52 p.m. with all Councilmembers present 16. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA — Jerry Jambazian, Temple City business owner, commented on the maintenance of Las Tunas Drive and remarked on business owners that are discarding their business trash into the sidewalk trash receptacles. He also commented on the Easter Event, upcoming Arbor Day, and Temple City's Got Talent. 17.
