AN ORDINANCE OF THE CITY OF TEMPLE CITY
CODIFYING AND READOPTING SECTIONS 9100,
9100.1, 9100.2, 9100.3, 9100.4, 9100.5,
AND 9100.6 AS NEW SECTIONS 1, 2, 3, 4, 5,
6 AND 7 OF ARTICLE IX OF THE TEMPLE CITY
MUNICIPAL CODE (WHICH SAID ARTICLE IX IS
HEREAFTER TO BE KNOWN AS THE ZONING CODE
OF THE CITY OF TEMPLE CITY), ADDING NEW
SECTION 1811 THERETO, AMENDING SECTIONS
2400 AND 2501 THEREOF, AND CODIFYING
ORDINANCE 63 -107.
SECTION 1. Sections 9100, 9100.1, 9100.2, 9100.3,
9100.4, 9100.5, and 9100.6 of the Temple City Municipal
Code, as the same existed prior to the adoption of Ordinance
63 -112, be and the same are hereby readopted, recodified,
and renumbered as Sections 1, 2, 3, 4, 5, 6, and 7
respectively of Article IX of the Temple City Municipal Code
which said /°article IX shall hereafter be known and designated
as the POZoning Code of the City of Temple City," as follows:
1. PLANNING COMMISSION CREATED. A Planning
Commission or t e City of Temple City is
hereby created.
2. MEMBERS. Said Planning Commission shall consist
=lye (5) members who shall be qualified
electors of the City of Temple City and who may
be persons who hold an office or a position
with the City other than as a member of the
Planning Commission. Of the members of the
Commission first appointed hereunder, one shall
be for the term of three (3) years; one for the
term of two (2) years, and two for the term of
one (1) year. Their successors shall be
appointed for the term of four (4) years. If
vacancies shall occur otherwise than by
expiration of term, they shall be filled by
appointment for the unexpired portion of the
term. Members of the Planning Commission shall
be appointed by the Mayor with the approval of
the City Council.
3. ABSENCE FROM MEETINGS. If a member of the
Planning Co mm scion shall be absent from three
successive regular meetings of said Commission,
without cause, the office of such member shall
be deemed to be vacant and the term of such
member ipso facto terminated and the Planning
Commission shall immediately inform the City
Council of such termination.
4. ABSENCE FOR CAUSE. An absence due to illness
or unavo.dable sence from the City and written
notice thereof to the Planning Commission on or
before the day of any regular meeting by said
Commission shall be deemed absence for cause.
5. REGULAR MEETING. A regular meeting as provided
,ror by law or by rule of the Planning Commission
or any regularly advertised public hearing
shall be deemed a regular meeting.

6. ORGANIZATION. The Planning Commission shall
elect it Tc: airman from among its appointed
members for a term of one (1) year and, subject
to other provisions of law, may create and fill
such other offices as it may determine necessary,
subject to the approval of the City Council.
The Planning Commission shall hold at least
one regular meeting in each month. It shall
adopt rules for transaction of business and
shall keep a record of the resolutions, trans-
actions, findings, and determinations, which
record shall be a public record.
7. DUTIES, Said City Planning Commission shall
perform the duties and shall have all the rights;
powers and privileges specified and provided
for in this Code or by State Law.
SECTION 2. A. new Section 1811, reading as follows,
is hereby added to the Temple City Municipal Code in the
place and stead of that Section heretofore repealed.
Section 1811 Extension of Variances. Every
variance and conditiona use permit granted by the
City shall expire 6 months after the issuance
thereof, unless within such period the applicant (or
successor in interest) has substantially exercised
the rights granted by such variance or conditional
use permit. The Planning Commission may, without
public notice or hearing, extend for good cause
shown said time period but not beyond an additional
one year.
SECTION 3. Section 2400 of Article IX of the Temple
City Municipal Code is hereby amended to read as follows:
Section. 2400 Penalty. Any person, firm or
corporation violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor,
and upon conviction thereof shall be punishable by
fine of not more than $500.00 or by imprisonment
in the County Jail for a period of not more than
180 days, or both such fine and imprisonment.
SECTION 4. Section 2501 of Article IX of the
Temple City Municipal Code, is hereby amended to read as
follows:

SECTION 5. Ordinances 63 -107 the subdivision
ordinance of this City and Ordinance 63 -112 are hereby
codified and shall henceforth be known as Articles X and IX,
respectively, of the Temple City Municipal Code.
SECTION 6, The City Clerk' shall certify and attest
to the adoption of this Ordinance and shall cause the same
to be published once in the Temple City Times, a semi - weekly

newspaper, published and circulated in the City of Temple City.
