The following guests were present: Ed Twehous, Twehous Excavating Company; Mike Bates, CMPS; and Madeleine Leroux, News Tribune. 1) Introductions Those present introduced themselves. 2) Approval of the September 19, 2013 Committee meeting minutes Councilman Branch moved and Councilman Carroll seconded to approve the September 19, 2013 minutes, motion carried. 3) Old Business 1. Revision to Forestry Article in the City Code (Bill Lockwood) Mr. Lockwood explained this revision would make the property owner responsible for trees in the City right-of-way except for in the downtown beautification area. There was discussion among Committee members and staff regarding the number of forester's on Parks staff, code enforcement and street staff responsibilities, abatement process, tax liens, third party contractor, and budgetary constraints. Further discussion of no benefit just shifting responsibilites to another department, the transition of property owner responsibility could be difficult, possibility of funds in other Parks areas, Minutes/Jefferson City Public Works and Planning Committee 2 October 24, 2013 liability issues, reluctance to cut back on services, leaving the $25,000 as budgeted, and limited resources of the Street Division. Councilwoman Carroll moved to amend the ordinance changes to include discretion of the Parks Department to include cases where the City is legally required to maintain the trees. Councilman Carroll then withdrew her motion. Chairman Scrivner requested staff work together to make suggested changes to the amendment. Councilman Schulte moved and Councilwoman Carroll seconded to move Item 4.3 to the top of the agenda, motion carried. 4) New Business 3. Helias Catholic High School Signage Request (Amendment of Chapter 3, Advertising and Signs) (Janice McMillan) Ms. McMillan displayed a rendering of the signage requested. Mr. Bates explained this type of monument signage with message board is not allowed in residential districts within the City Code. There was discussion among Committee members, staff and those present regarding the new technology, brightness of sign, and having a static message at night. Councilman Schulte moved and Councilman Branch seconded to have staff amend the code to allow these type of signage in residential areas, motion carried. 1. Change Order with Bartlett & West, Inc. for Basin 5 & 6 Relief Sewer-Phase II Design Services (Eric Seaman) Mr. Seaman explained the sewers along Lafayette cause sewer backups in the Leslie and Rose Valley areas. The overflows have gotten the attention of the EPA. Cost will be eligible for MoDOT utility relocation reimbursement from the SRF loan money with the remaining cost to be paid with wastewater funds. Councilwoman Carroll moved and Councilman Branch seconded to refer the change order to the City Council with recommendation to approve, motion carried. 2. Dunklin Street Crosswalk (David Bange) Mr. Bange explained the State of Missouri has requested and agreed to fund the construction of a signed crosswalk in the 400 block of East Dunklin Street immediately in front of the Employment Security building. This project was designed at their request by City staff several years ago but was shelved for lack of funding. Councilwoman Carroll moved and Councilman Bray seconded to refer an agreement with State of Missouri to the City Council with recommendation to approve, motion carried. 4. Approval of CDBG Consolidated Plan Submittal to the Department of Housing and Urban Development (Janice McMillan) Ms. McMillan referred the Committee to Ms. Abbott's presentation. Ms. Abbott gave a presentation of the highlights of the plan, including the action plan, budget, services, public improvements and removal of slum and blight areas. Minutes/Jefferson City Public Works and Planning Committee October 24, 2013 Chairman Scrivner requested Committee members read through the plan prior to the Council meeting and send comments or concerns to Ms. McMillan or Ms. Abbott. Councilwoman Carroll moved and Councilman Bray seconded to refer the CDBG Consolidated Plan to the City Council with recommendation to approve, motion carried. 5. Heisinger Road Street Lights (Britt Smith) Mr. Morasch explained staff requests the Committee provide direction as to the installation of new street lights on Heisinger Road from Missouri Boulevard to approximately where the new sidewalks connect to the Greenway. Councilman Graham has requested that additional lighting be considered for this area. There was discussion among Committee members and staff regarding the need for lighting in this area, the number of persons walking in this area at night and funding of the additional lighting. Councilwoman Carroll requested this item be brought to the November Committee meeting if Councilman Graham wishes to pursue the lighting. 6. Ongoing Subdivision Acceptance (Matt Morasch) 3 Mr. Morasch explained each year staff makes a focused effort to review all active subdivision's status of infrastructure acceptance versus the percentage of building permits granted. City code requires that upon 50 percent of the building permits being issued that all infrastructure must be completed in accordance with the approved plans. Staff has expended considerable effort in working with the various developments to communicate what is expected for final acceptance and are meeting with the affected developers on a weekly basis to monitor progress to work steadily towards compliance. 7. 2014 Miscellaneous Storm Water Projects (Don Fontana) Mr. Fontana explained staff requests the Committee endorse the storm water capital improvement work plan for 2014 which includes contingency for sink holes and/or pipe lining. Mr. Morasch explained staff would like to get started on the projects due to staff shortage. 5) Other Topics 1. Planning & Protective Services Monthly Reports Ms. McMillan referred Committee members to the reports included in the packet. She stated there has been a cooperative effort between the Fire Department and Building Regulations for code compliance. • Mr. Morasch stated two change orders for sewer extensions will be included for the next Council meeting. • Mr. Seaman gave a status update on the Cole Junction Pump Station and Force Main to be completed for a possible January, 2014 start up. 6) Citizen opportunity to address Council/Staff on Stormwater and Other Public Works Issues There was no one present to speak on this item. City staff requests the committee provide direction as to the installation of new street lights on Heisinger Rd from MO Blvd to approximately where the new sidewalks connects to the Greenway. As you may recall, Councilman Graham requested at a recent City Council meeting that additional lighting be considered for this area. The reason this request comes before the Committee is that funding for adding new lights was removed from the 2013 budget and was not reinstated during the 2014 budget. Therefore staff would need to fund the request from some other source. The cost to add four lights would be in range of $2500. They would also require an estimated additional $800 of electricity costs in the Street Division's annual operating budget. One potential source of funding for the installation costs would be from CIP s~les tax funds sidewalk line item. This would make some sense since the issue arose after construction of a new sidewalk through the area. If the Committee concurs that CIP sidewalk funds should be utilized to pay for the lighting installation, staff could proceed with adding the new lights as it would .fall within staff funding limits. The existing alleyway's right-of-way is unimproved and is not needed for roadway purposes . Douglas and Connie Wheeler are requ esting to vacate the abutting unimproved alleyway right-of-way to allow for use of unimproved property. Staff has contacted all utility companies that provide service in the area , to make a determination whether easement rights for ut ilities will need to be retained . We are awaiting responses back from the utility providers . After approval by the Committee, this ite m will be placed on the City Council agenda for final approval. Restrictions on size and display would apply. Background Information: Helias High School requested the City review its code for the potential of allowing electronic message centers as part of school signage. In reviewing the sign code, staff found that the newer technology of electronic message centers (EMC's) are replacing changeable message boards in most locations throughout the city. Currently, EMC's are permitted in C-2 General Commercial, M-1 and M-2 Industrial districts. The amendment, if passed, would allow electronic message centers in the C-1 Neighborhood district and as part of public or private school signage, regardless of zoning district. It was discovered shortly after this time that Missouri American had not been paying a wastewater utility bill. Based on standard recovery procedure, we have billed Missouri American for the last 5 years of service for the amount of $9,044.88. Missouri American is being billed for current service and this will continue for future bills. If you have any questions, please contact me at 634-6443. There are 12 different workshops offered as part of the program in which sustainable land use code audit is one of them. The workshops are funded under a grant from US EPA's Building Blocks for Sustainable Communities Program. The sustainable land use code a udit workshop focuses on several areas such as storm water, water conservation, natural resource protectio n, etc. This workshop includes a one-day question and answer session with consultants, presentations, examples of best practices, and hands-o n working session to conduct an initial sustainable code assessment, tips and advice on implementation.
