INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Fitzjohn, who led the Pledge 2. of Allegiance to the Flag. 4. Roll Call: PRESENT: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzr john ABSENT: Councilmen -None ALSO PRESENT: Shatford & Woollett 5. APPROVAL OF MINUTES OF OCTOBER 10, 1960. Section 26 was corrected to read as follows: "Councilman Buchan made a motion that the City of Temple City hereby acknowledges receipt of 'Acceptance of the Franchise' from the Southern Cal- ifornia Gas Co., and the 'Acceptance of the Franchise' from the Southern Counties Gas Co." Councilman Buchan moved to approve the minutes as revised, Merritt seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 6. UNFINISHED BUSINESS: REQUESTED ABATEMENT OF LIGHT & AIR EASEMENT - DEPT. OF REAL ESTATE MANAGEMENT. City Attorney Shatford stated this request was referred to the Planning Commission, and the Commission re- commended approval. Buchan asked if any contact had been made with the property owners to see what their feeling is on the easement. Woollett recommended the Council not approve until the rest of the property owners were contacted, and the request discussed with the applicant who has apparently violated the easement. Buchan stated the abatement has an influence on the whole block affecting all lots, and the other property owners should be given a chance to state their opinion. Dickason felt these deep lots where four houses could be built could be future blight areas. Merritt was of the same opinion, and made a motion to table this abatement request until the next council meeting to give the request further study, Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 7. REPORT FROM RUBBISH DISPOSAL COMMITTEE. City Attorney Shatford advised the committee held a meeting and as a result drafted a Resolution "AFFIRMING CONTRACT FOR THE COLLECTING AND DISPOSAL OF'GARBAGE AND OTHER REFUSE AND ADDING ADDENDUM THERETO ", He stated the contractor was under no obli- gation to amend because as it now stands it is an agreement, but the contractor in this case was willing to add changes if the City felt them desirable. The changes made were to clarify the position of the City in the event of changes of the contract or, or bankruptcy of contractor, during tenure of agreement. Shatford recommended to the Council that they adopt the Resolu- tion with attached Addendum, as all additions are of benefit to the City, and that Mr. Beckley, President of Community Disposal Co., was willing to add these additions to the contract if the City felt them a benefit to the City. Mr. Tyrell stated he felt Mr. Beckley should be commended for his willingness to grant this to the City as we are concerned with a ten year contract. Tyrell recommended to the Council that the Resolution No. 60 -82 and attached Addendum to Rubbish Disposal Agreement (Exhibit A) be approved, and that Mr. Beckley be thanked for entering into the Addendum to the Agreement. Shatford advised Mayor Fitzjohn 71 Council Minutes October 24, 1960, page 2 he felt it made a better contract for the City. Dickason stated he had some reservations in respect to finger- printing as it Sm s makes. a police state, however there is this problem in respect rd to people hired for these jobs, but he does not like finger- printing unless absolutely necessary. Tyrell felt it gave added benefit to citizens. Shatford stated where the city is contract- ing with someone on a service basis, one of the terms could be that they did not employ one convicted of a felony. Dickason said if legal in this respect he was 100% in favor, Buchan se- conded and carried by the following roll call vote: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Couneilmen -None 8. PUBLIC HEARING: ZONE CHANGE CASE No. 60 -5 (A -1 to C -1) Carl F. Rasmussen. (Second reading) City Attorney Shatford read title to Ordinance No. 60 -19 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROV- ING RECOMMENDATIONS OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY AND GRANTING A CHANGE OF ZONE TO CARL F. RASMUSSEN ON PROPERTY LOCATED ON THE NORTHWEST CORNER OF LOWER AZUSA ROAD AND HALLOWELL FROM A -1 TO C -1. Dickason moved to waive further reading of Ordinance No. 60 -19, Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None Councilman Dickason moved to adopt Ordinance No. 60 -19, Buchan seconded and carried by the following roll call vote: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen =None. 9. REQUESTED DETACHMENT OF PROPERTY: Superior Concrete & Bldg. Supply Co.- Planning Commission recommends approval. Councilman Buchan stated he saw no reason why we should not accept the recommendations of the Planning Commission. City Attorney Shatford read Resolution No. 60 -88 in full. A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY CONSENTING TO THE DETACHMENT OF LOTS 4 AND 5 of TRACT NO. 10260 WITHIN THE CITY OF TEMPLE CITY TO THE CITY OF ARCADIA. Dickason made a motion the recommendation of the Planning Commission be approved and Resolution No. 60 -88 as read by City Attorney Shatford be adopted, Councilman Buchan seconded, and carried by the following roll call vote: AYES: Councilmen- Buchan, Dickason, Merritt, & Fitzjohn °-` NOES: Councilmen - Tyrell ABSENT: Councilmen -None In discussion Buchan felt Temple City had nothing to lose in granting this request, and both Dickason and Merritt felt we should cooperate with Arcadia in this request. Tyrell felt Temple City should keep the property for zone control as there . are residential properties adjacent to it, and that there is no justification for releasing the land acquired at any time, as it may be valuable to us at some time. Mr. Homer Shirley of the Superior Concrete & Bldg. Supply Co., stated it would be better to have all the Company property in one City, and that any damage to the residential area had already been done, also that there is a block wall where city backs up to it, which was in agreement with 100% of the neighbors in the area. 10. AN ORDINANCE No. 60 -21 AN ORDINANCE OF THE CITY OF TEMPLE CITY PERTAINING TO THE ABATEMENT OF HEDGES, SIGNS AND OTHER OBSTRUC- TIONS TO VISIBILITY AT STREET INTERSECTIONS. City Attorney Shatford read Ordinance No. 60 -21 which was based on a similar ordinance in the City of Pasadena, the only change was from 25 ft. to 30 ft. on property lines at point of inter- section. Considerable discussion followed regarding limit of 30" for growth or obstruction of view in parkway at intersec- tions. 72 Council Minutes October 24, 1960, page 3 Dickason moved this be referred back to the Traffic & Safety Commission as_this involves safety, Buchan seconded, roll call vote as follows: AYES: Councilmen:Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None NEW BUSINESS: ORDINANCE NO. 60 -20: AMENDING MUNICIPAL CODE. City attorney Shatford stated he had revised the entire section concerning variances, modifications, zone changes, petitions, notices, and hearings, and this Ordinance was to bring the Code up to date with reference to various changes made since adopting County Ordinance No. 1494. Discussion followed regard- ing fees charged for filing. Mr. Woollett will do some research and see how much it is costing for the Planning Commission to have all the information they should have, costs of mailing notices, posting property, plus fee paid advisor. Mr. Shatford advised Section 619 was the only section added, and all the - other sections we already have, but this Ordinance No. 60 -20 puts it in a more workable form and he thought it would be helpful to clean it up. Councilman Tyrell moved to table, Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 12. RESOLUTION NO. 60 -80: Designation for official responsibility for filing annual street report. Councilman Dickason moved to adopt Resolution No. 60 -80 A RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DESIGNAT- ING CITY OFFICIAL RESPONSIBILITY FOR FILING ANNUAL STREET RE- PORT, and to designate the Superintendent of Streets of the Citv of Temple City to prepare this report, and the City Manager to audit the report for filing with the State Controller. Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 13. CHAMBER OF COMMERCE: Mr. Woollett read a communication from Mr. Jackson, Pres. of the Chamber of Commerce regarding the booth at the County Fair which stated they were second in their class and won $525.00, with expenses incurred of $832.62, for which he inclosed itemiz- ed bills. Tyrell stated he felt the $525.00 won should apply Co„ec-c -eJ against cost of next years booth. Dickason disagreed as it de- prives them of incentive. Buchan moved that the City pay the irave tir Chamber of Commerce $75EIPEDD immediately for the budgeted amount 1,+_19LI for the Los Angeles County Fair booth and brochures, Dickason seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 14. RESOLUTION NO. 60 -87: Warrants & Demands - City Manager Woollett stated the telephone company was making a study of city services and would be bringing in a recommenda- tion for improving the services. Regarding the Temple Televi- sion bill Mr. Woollett advised this was only for the difference in cost of present mikes and one previously used, and that there had been no charge made for labor for installation or changing loud speakers. Following discussion Merritt made a motion to adopt Resolution No. 60 -87, Warrants and Demands No. 258 through No. 268 in the amount of $542.26, Buchan seconded, carried by the following roll call vote: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 73 Council Minutes October 24, 1960, page 4 15. COMMUNICATIONS: a. Boundary Commission - proposed annexation No. 242, El Monte south, inhabited. City Manager Woollett read a letter from the Boundary Commission regarding above annexation. Tyrell moved to receive and file, Merritt seconded and carried. b. Mr. Woollett read a letter from Lloyd Porter commending the removal of parking meters. Buchan moved to receive and file, Merritt seconded and carried. 16. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO DESIRE TO ADDRESS THE COUNCIL: Mr. Marvin L. Apron, 5404 El Monte Ave., requested permission to take down a tree in his parkway and plant another one. Mr. Woollett advised he would have to have a permit and he would have the parkway department check it out. 17. MATTERS FROM CITY OFFICIALS: The City Manager read a letter from Mr. Bernhard Goldstein who was denied a zone variance at 4913 N. Fiesta Ave. by the Plan ing Commission, and wrote an appeal to the Council which was not in proper form and the Manager was to advise Mr. Goldstein in regard to submitting a proper appeal to the City Council. This appeal being in order was discussed by the Council. The request is for a third house on a lot which is 3650 sq. ft. short of minimum requirement of 5000 sq. ft. per house. Dickasor . stated he attended the hearing and felt the request way out of line. Tyrell stated the right to appeal is a right under the constitution, and Mr. Goldsteins statement that 62 out of 65 families were in favor of the proposed building and he would be interested in knowing whether the majority of residents were in favor of it. Shatford stated the larger amount were against it Tyrell moved to deny the appeal, Dickason seconded, Merritt stated he was at the meeting and heard the evidence presented and cannot recall anything which supported his appeal. Roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Shatford advised that the City Council before taking action would have to hold a public hearing on the appeal Tyrell moved to rescind the ruling on the appeal of Bernhard Goldstein, and to set up a public hearing for the appeal for November 14, 1960, at 8 P. M. at the City Hall, Buchan seconded roll call vote as follows: AYES: Councilmenl. Buchan, Dickason, Merritt, Tyrell & Fitzjoh, NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett read a letter from the Kiwanis Club re- questing the Mayor to proclaim November, 1960, "RELIGION IN AMERICAN LIFE MONTH ". Merritt moved this proclamation be ap- proved, Buchan seconded and carried. Woollett asked regarding attendance at the Co- ordinating Counci luncheon meeting at the Ivanhoe on Nov. 25 with Mrs.Yokum of Alhambra the guest speaker. Attending Fitzjohn, Merritt, Tyrell Shatford, Woollett. Councilman Dickason stated he would like to suggest a Commissio be appointed for Parks and Recreation inasmuch as our contract with the County expires January 1.. He felt a certain amount of planning should be done and as the master plan consultants are being hired the councilmen should at the next meeting make re- commendations for appointments to a commission of parks and recreation. Also recommendations to fill the vacancy on the Traffic & Safety Commission created by the resignation of Richard Null. 74 Council Minutes October 24, 1960, page 5 City Manager stated at this time he would like to indicate that for the Thursday night study session the following would be present from the County offices: Hal Marlowe, Under -Sheriff, Clifford Roos, Chief of Patrol Division, Gordon Bower, Chief Detective Division, and Arthur Will, Administrative Office. 18. Merritt moved to adjourn until Thursday evening, October 27, 1960, at 7:30 P. M. for a study session, Dickason seconded, and carr- ied. ATTEST: Merrill J.
