HomeMy Public PortalAboutCity Council_Minutes_2023-04-04_Regular 2023- - CITY COUNCIL TEMPLE CITY, CALIFORNIA REGULAR MEETING MINUTES APRIL 4, 2023 1.CALL TO ORDER Mayor Man called the City Council Regular Meeting to order at 7:40 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2.ROLL CALL PRESENT: ABSENT: ALSO PRESENT: Councilmember - Stemquist, Chavez, Man Councilmember- Vizcarra, Yu City Manager Cook, City Attorney Murphy, City Clerk Kuo, and Community Development Director Reimers Mayor Pro Tern Chavez made a motion to excuse Councilmember Vizcarra and Councilmember Yu for cause. Seconded by Councilmember Stemquist. 3.INVOCATION -Pastor Kelty provided the invocation. 4.PLEDGE OF ALLEGIANCE-Boy Scout Troop 161 led the pledge of allegiance. 5.CEREMONIAL MATTERS -PRESENTATION A.SOUTH COAST AIR QUALITY MANAGEMENT DISTRICT -UPDATE ON AIR QUALITY Governing Board Vice Chair Michael Cacciotti, also South Pasadena Councilmember, provided an update on air quality and incentive programs offered by the South Coast Air Quality Management District. 6.PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA -None 7.CONSENT CALENDAR Mayor Pro Tern Chavez made a motion to approve the remainder of the Consent Calendar Items. Seconded by Councilmember Sternquist and approved by the following votes: AYES: NOES: Councilmember -Sternquist, Chavez, Man Councilmember -None City Council Minutes April 4, 2023 Page 2 of 7 ABSTAINED: Councilmember— None ABSENT: Councilmember — Vizcarra, Yu A. APPROVAL OF MINUTES The City Council is requested to review and approve: 1. The Minutes of the Special City Council Meeting of March 21, 2023; and 2. The Minutes of the Regular City Council Meeting of March 21, 2023. Action: 1. Approved the Minutes of the City Council Meetings; and 2. Found that approval of the City Council Minutes is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. B. PLANNING COMMISSION ACTIONS The City Council is requested to receive and file the actions of the Planning Commission Regular Meeting of February 28, 2023. Action: 1. Received and filed the Planning Commission Actions; and 2. Found that the Commission Actions is exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15061(b)(3). C. FINAL SUBDIVISION MAP APPROVAL FOR PARCEL MAP NO. 83179, A FOUR - UNIT CONDOMINIUM SUBDIVISION AT 4447 ELLIS LANE City Council is requested to approve the final map. Approving the final map will allow the property owner to record the map and start construction of the four condominium units. Action: 1. Reviewed and approved the final subdivision map for Parcel Map No. 83179; 2. Authorized the City Clerk to certify Parcel Map No. 83179; and 3. Found the project exempt from the California Environmental Quality Act CEQA) pursuant to Section 15303 (New Construction or Conversion of Small City Council Minutes April 4, 2023 Page 3 of 7 Structures) and Section 15332 (In -fill Development Projects) of the California CEQA Guidelines. D. VISA CARD REPORT The City Council is requested to receive and file the Visa Card Report. Action: 1. Received and filed; and 2. Found that receiving and filing the Visa Card Report is exempt from review under the California Environmental Quality Act (CEQA) per Section 15061(b)(3). E. ADOPTION OF RESOLUTION NO. 23-5662 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2022-23 The City Council is requested to adopt Resolution No. 23-5662 authorizing the payment of bills. Action: 1. Adopted Resolution No. 23-5662; and 2. Found that adoption of the resolution authorizing the payment of bills is not a Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. F. APPROVAL OF SECOND AMENDMENT TO THE SERVICES AGREEMENT WITH GRETCHEN STERLING TO OPERATE AND MANAGE THE TEMPLE CITY CERTIFIED FARMERS MARKET The City Council is requested to approve the Second Amendment to the Service Agreement with Gretchen Sterling to continue to operate and manage the Temple City Certified Farmers Market. Action: 1. Reviewed and approved the Second Amendment to the Service Agreement Attachment "A") with Gretchen Sterling to operate and manage the Temple City Certified Farmers Market; 2. Authorized the City Manager to sign and execute the Service Agreement; and City Council Minutes April 4, 2023 Page 4 of 7 3. Found that approval of the Service Agreement is not a "Project" as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required 8. PUBLIC HEARING A. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 23-1072, AMENDING TITLE 8 (STORMWATER POLLUTANT ELIMINATION) AND SECTION 9-1N-10 (LOW IMPACT DEVELOPMENT STANDARDS AND GREEN STREETS) OF THE TEMPLE CITY MUNICIPAL CODE TO COMPLY WITH THE MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) PERMIT The public hearing for the introduction and first reading of Ordinance No. 23-1072 to update Title 8 and Section 9-1 N-10 of Title 9 of the Temple City Municipal Code to comply with new state -required provisions in the MS4 Permit has been continued to the April 18, 2023 meeting. City Manager Cook requested that the City Council open the public hearing to receive public comments and continue the public hearing to the next Council meeting on April 18, 2023. No comments or questions from City Council. Steve Stafford, Temple City resident, asked questions regarding water ways and runoffs. Hearing no further request to speak, Mayor Man closed public hearing. Mayor Pro Tem Chavez made a motion to: 1. Open the public hearing to receive public comments for the introduction of Ordinance No. 23-1072; and 2. Continue the public hearing to the next City Council meeting on April 18, 2023. Seconded by Councilmember Sternquist and approved by the following votes: AYES: Councilmember — Sternquist, Chavez, Man NOES: Councilmember — None ABSTAINED: Councilmember — None ABSENT: Councilmember — Vizcarra, Yu B. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 23-1070 AMENDING THE CITY'S RULES RELATED TO ARTIFICIAL TURF, LANDSCAPING, AND HARDSCAPE City Council Minutes April 4, 2023 Page 5 of 7 The City Council is requested to adopt Ordinance No. 23-1070 which would modify the Zoning Code related to artificial turf, landscaping, and hardscaping. Community Development Director Reimers gave a summary of the staff report. City Council made comments and asked questions regarding the proposed zoning code relating to artificial turf. Mayor Man opened public hearing. Hearing no request to speak, Mayor Man closed public hearing. City Council made final comments. Mayor Pro Tem Chavez made a motion to: 1. Introduce Ordinance No. 23-1070 for first reading by title only, amending Title 9, Chapters 1 of the Municipal Code (Attachment "A") related to artificial turf, landscaping and hardscape; 2. Waive further reading of Ordinance No. 23-1070; 3. Schedule the second reading of Ordinance No. 23-1070 for April 18, 2023; and 4. Find that this Ordinance is not subject to environmental review under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Sections 15061(b)(3) because it can be seen with certainty that the Ordinance has no possibility of a significant effect on the environment. Further, any project reviewed under this ordinance would be a class 1, 3, 4, or 5 categorical exemption. Seconded by Councilmember Sternquist and approved by the following votes: AYES: Councilmember — Sternquist, Chavez, Man NOES: Councilmember — None ABSTAINED: Councilmember — None ABSENT: Councilmember — Vizcarra, Yu 9. UNFINISHED BUSINESS — NONE 10. NEW BUSINESS — NONE 11. UPDATE FROM CITY MANAGER — invited everyone to the Easter event at Live Oak Park this weekend and announced that the city's landscape architect for the parks playground project will be collecting residents' input for the project. He shared that City Council Minutes April 4, 2023 Page 6 of 7 the State has certified the City's Housing Element. He also provided an update on the effect the rainstorm had in the city. 12. UPDATE FROM CITY ATTORNEY — He announced that the city will no longer have to include CEQA exemption as a recommendation on the meeting agenda or staff report for items not needing a CEQA review. California Supreme Court invalidated and ordered depublished an opinion of the Second District Court of Appeal in G.I. Industries v. City of Thousand Oaks. 13.
