CALL TO ORDER Mayor Man called the City Council Regular Meeting to order at 7:40 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember — Sternquist, Vizcarra, Yu, Chavez, Man ABSENT: Councilmember — None ALSO PRESENT: City Manager Cook, City Attorney Murphy, City Clerk Kuo, Community Development Director Reimers, and Parks and Recreation Director Matsumoto 3. INVOCATION — Mayor Pro Tem Chavez provided the invocation. 4. PLEDGE OF ALLEGIANCE — Boy Scout Troop 161 led the pledge of allegiance. 5. CEREMONIAL MATTERS — PRESENTATION A. OLDER AMERICAN PROCLAMATION City Council proclaimed May Older American Month. Mayor Man presented the proclamation to Older American of the Year Jim Robuck. B. OLDER AMERICAN OF THE YEAR — JIM ROBUCK City Council recognized Mr. Jim Robuck as the Older American of the Year. C. TEMPLE CITY HIGH SCHOOL SCIENCE OLYMPIAD TEAM City Council received a presentation from the Temple City High School Science Olympiad Team and presented each student with a certificate of recognition. D. OAK AVENUE INTERMEDIATE SCHOOL SCIENCE OLYMPIAD TEAM City Council received a presentation from the Oak Avenue Intermediate School Science Olympiad Team for their accomplishments and presented each student with a certificate of recognition. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Dawn Tarin, Camellia Festival Director/Historical Society representative, remarked that City of Temple City will be celebrating its 100th year anniversary of being established as a city. She announced that the Historical Society will host a BBQ to start off the celebration on Sunday, May 28, and that tickets are now available for purchase. She also announced the deadline for the 80th Camellia Festival theme contest is Friday, May 5. She encouraged the children to participate and submit a theme. Valerie Munoz, representative from San Gabriel Basin Water Quality Authority/Mayor Pro Tem of La Puente, requested to be added to the next council meeting so she can make a brief presentation regarding the San Gabriel Basin Water Quality Authority. Jing Li, Temple City Library Manager, announced upcoming library programs and events. 7. CONSENT CALENDAR Mayor Pro Tern Chavez made a motion to approve the Consent Calendar Items. Seconded by Councilmember Sternquist and approved by the following votes: AYES: Councilmember — Sternquist, Vizcarra, Yu, Chavez, Man NOES: Councilmember — None ABSTAINED: Councilmember — None ABSENT: Councilmember — None A. APPROVAL OF MINUTES The City Council is requested to review and approve: 1. The Minutes of the Special City Council Meeting of April 18, 2023; 2. The Minutes of the Regular City Council Meeting of April 18, 2023; and 3. The Minutes of the Special City Council Meeting of April 26, 2023. Action: Approved the Minutes of the City Council Meetings. B. PLANNING COMMISSION ACTIONS — MEETING OF MARCH 28, 2023 The City Council is requested to review the Planning Commission actions of their meeting of March 28, 2023. Action: Received and filed. PARKS AND RECREATION COMMISSION ACTIONS — MEETING OF APRIL 19, 2023 The City Council is requested to review the Parks and Recreation Commission actions of their meeting of April 19, 2023. Action: Received and filed. D. APPROVAL OF PERMITS TO SELL FIREWORKS FOR THE 2023 SEASON The City Council is requested to approve the applications to sell fireworks which will allow the non-profit organizations and groups to raise funds to support their respective activities. Action: Approved the nine applications for fireworks permits for the 2023 season. E. SECOND READING AND ADOPTION OF ORDINANCE NO. 23-1072, AMENDING TITLE 8 (STORMWATER POLLUTANT ELIMINATION) AND SECTION 9-1N-10 (LOW IMPACT DEVELOPMENT STANDARDS AND GREEN STREETS) OF THE TEMPLE CITY MUNICIPAL CODE TO COMPLY WITH THE MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) PERMIT The City Council is requested to consider adoption of an ordinance to amend the City's municipal code to comply with the Municipal Separate Storm Sewer System (MS4) permit. Action: Adopted Ordinance No. 23-1070 amending Title 9, Chapters 1 of the Municipal Code (Attachment "A") related to artificial turf, landscaping and hardscape. F. FINAL SUBDIVISION MAP APPROVAL FOR TRACT MAP NO. 73471, A SIX - UNIT CONDOMINIUM SUBDIVISION AT 4910-4916 ENCINITA AVENUE. City Council approval of the final map will allow the property owner to record the map and start construction of the four condominium units. Action: 1. Reviewed and approved the final subdivision map for Tract Map No. 73471 (Attachment "A"); 2. Authorized the City Clerk to certify Map No. 73471; and City Council Minutes May 2, 2023 Page 4 of 7 3. Found the project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15332 (In -fill Development Projects) of the California CEQA Guidelines. G. APPROVAL OF AGREEMENT WITH REALTY PLANNERS GROUP, INC TO IMPLEMENT THE SIXTH CYCLE HOUSING ELEMENT City Council is requested to approve the service agreement to allow the consultant to start the work so that the September 30, 2023 deadline can be met. Action: 1. Reviewed and approved the Professional Services Agreement (Attachment "A") with Realty Planners Group, Inc. (Realty Planners). This agreement is for the implementation of the sixth cycle Housing Element. The budget for this agreement is $30,000 which will be paid by the Local Early Action Planning Grant (LEAP grant). The remaining grant funds must be spent by September 30, 2023; and 2. Authorized the City Manager to execute the agreement with Realty Planners Group. H. APPROVAL OF RESOLUTION DENOUNCING ANTISEMITISM The City Council is requested to adopt a resolution denouncing antisemitism, hatred, and prejudice. Action: Adopted Resolution No. 23-5666 denouncing antisemitism. I. ADOPTION OF RESOLUTION NO. 23-5667 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2022-23 The City Council is requested to adopt Resolution No. 23-5667 authorizing the payment of bills. Action: Adopted Resolution No. 23-5667 authorizing the payment of bills. 8. PUBLIC HEARING A. ESTABLISHMENT OF AN EXPEDITED, NON -DISCRETIONARY MULTI -FAMILY REVIEW PROCESS AND A LIBRARY OF PROTOYPE ARCHITECTURAL DESIGNS FOR MULTI -FAMILY PROJECTS The City Council is requested to continue the public hearing to a date uncertain. City Council Minutes May 2, 2023 Page 5 of 7 City Manager Cook requested City Council to continue the public hearing regarding the objective design standard and direct staff to schedule a study session in June for this item. Mayor Man opened public hearing. Hearing no request to speak, Mayor Man closed public hearing. Mayor Pro Tern Chavez made a motion to continue the public hearing to a date uncertain and scheduled a study session with the City Council before the end of June 2023. Seconded by Councilmember Yu and approved by the following votes: AYES: Councilmember — Sternquist, Vizcarra, Yu, Chavez, Man NOES: Councilmember — None ABSTAINED: Councilmember — None ABSENT: Councilmember — None 9. UNFINISHED BUSINESS — NONE 10. NEW BUSINESS — NONE 11. UPDATE FROM CITY MANAGER A. LAS TUNAS INFRASTRUCTURE UPDATES City Manager Cook reported that cleaning maintenance will be performed on the sidewalks along Las Tunas Drive and that staff are also looking into a comprehensive update of irrigation and electrical infrastructure underneath the sidewalks. 12. UPDATE FROM CITY ATTORNEY — City Attorney Murphy provided two housing related updates. He reported that the Attorney General's office announced a lawsuit against the City of Elk Grove for violating State Fair Housing Law. The lawsuit is the result of the City denying a proposed project for supportive housing for lower -income households but approving a similarly situated, market -rate housing development located within the same neighborhood as the denied project. He also shared that the Department of Housing and Community Development rejected Orange's state - mandated housing plan due to public comments received by the HCD and that the plan includes too many sites that are unable to be developed. Without the approved housing element, Orange is subject to "builder's remedy" which would force City officials to approve a swath of development projects that violate local zoning and/or city's General Plan. He stated that city staff and the City Attorney's office will keep an eye on upcoming housing related issues. 13. COUNCIL REPORTS REGARDING AD HOC OR STANDING COMMITTEE MEETINGS City Council Minutes May 2, 2023 Page 6 of 7 Mayor Man established a Centennial Celebration Ad Hoc Committee for the celebration of the founding year of Temple City. He appointed Mayor Pro Tern Chavez and himself to the committee. The Council Ad Hoc Committee would provide feedback to staff regarding the festivities of the celebration. Mayor Man also directed City Manager Cook to report out on the preparation for the celebration at each subsequent Council meetings. A. SCHOOL DISTRICT/CITY STANDING COMMITTEE (Councilmember Man and Councilmember Chavez) — Formed 1/3/2012 Mayor Pro Tern Chavez and Mayor Man reported on the standing committee's meeting of April 27, 2023. The standing committee met to discuss funding for a School Resource Officer, District property thefts at their maintenance yard, Joint Use Agreement, 100th Anniversary of the town of Temple City, and the types of programs the school district is looking at to increase enrollment. B. AUDIT STANDING COMMITTEE (Councilmember Chavez and Councilmember Yu) — Formed 7/15/2014 No report. C. FACILITIES, PUBLIC WORKS, AND INFRASTRUCTURE STANDING COMMITTEE (Councilmember Yu and Councilmember Man) — Formed 4/4/2017 No report. D. PRIMROSE PARK ART ELEMENT AD HOC COMMITTEE (Councilmember Vizcarra and Councilmember Yu) — Formed 5/19/20 No report. E. CITY BASED HOMELESS PLAN STANDING COMMITTEE (Councilmember Vizcarra and Mayor Sternquist) — Formed 3/16/21 No report. F. FUTURE DEVELOPMENT OF CITY PROPERTY AT 9050 LAS TUNAS DRIVE AD HOC COMMITTEE (Mayor Pro Tern Man and Mayor Sternquist) — Formed 5/17/22 No report. G. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER YU — None. B. COUNCILMEMBER STERNQUIST — requested a copy of an updated emergency handbook and to schedule an emergency tabletop exercise, spoke about City of Claremont's objective design standards for accessory dwelling units, and reminded the public it is mosquito season and to be aware of standing water. C. COUNCILMEMBER VIZCARRA — inquired about the status of the businesses replacing K -Mart. D. MAYOR PRO TEM CHAVEZ — reported on the California Joint Power Insurance Authority's recent executive committee workshop where they discussed how to lower premium for the member cities and shared that John Shull will be retiring in June. E. MAYOR MAN — spoke about the trash receptacles and planters along Las Tunas Drive and requested staff to bring back an update regarding the upkeep. 15. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA — Jerry Jambazian, Temple City business owner, announced that National Day of Prayer is this Thursday and requested that the meeting be adjourned in memory of Dominic Mortellaro. 16.
