HomeMy Public PortalAboutOrdinance 65-163ORDINANCE NO, 65 -163 AN GRD I NANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 801 (35) 1=. :10 901 (35) AND ADDING SECTION 1300 (20) TO THE TEMPLE CITY MUNICIPAL CODE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. The City Council finds and determines that the amendments hereinafter set forth were processed in the manner required by the State Planning Law and Local Ordinance. follows: follows: SECTION! 2. Section 801 (35) is hereby amended to read as Sec. 801 (35): (a) Restaurant, tea room or cafe; (b) Premises serving or selling on -sale alcoholic beverages; provided, however, that such use in premises, any portion of which is located within 200 feet of the boundary of an R -1, R -2 or R-3 Residential Zone, shall be subject to the (prior application for and) issuance of a Special Use Permit, under the provisions of Sections 1800 and following of this Code, upon a finding that the establishment, maintenance or operation of the use so applied for, wi l l not, under the circumstances of the particular case , be detrimental to the health, safety, ?eace, morals, comfort or general welfare of persons residinc or working in the neich boyhood thereof, nor be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. (c) Excluding establishments where dancing or entertainment is permitted, and excluding drive -in restaurants or food service establishments. SECTION 3. Section 901 (35) is hereby amended to read as Sec. 901 (35): (a) Restaurant, tea room or cafe; (b) Premises serving or selling on -sale alcoholic beverages; provided, however, that such use in premises, any portion of which is located within 200 feet of the boundary of an R -1, R -2 or R -3 Residential '_one, shall be subject to the (prior application for and) issuance of a Special Use Permit, under the provisions of Sections 1800 and following of this Code, upon a finding that the establishment, main» tenance or operation of the use so applied for, will not, under the circumstance of the parti- cular case, be detrimental to. the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood thereof, nor be detrimental 484 ORD. Section 1300 is hereby amended by adding sub- section 20 thereto, reading as follows: Sec. 1300(20): The sale, service or-retailing of on -sale alcoholic beverages in a CC or C -2 (General Commercial District\ if any portion of the subject property is located within 200 feet of the boundary of an R -1, R -2 or R -3 Resi- dential Lone. SECTION 5. PENALTY. Any person, firm or corporation vio- lating this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than $500 or by imprisonment in the City or County Jail for a period of not to exceed six months, or by both such fine and imprisonment. SECTION 6. The City Clerk shall certify and attest to the adoption of this Ordinance and shall cause the same to be pub- lished once in the Temple City Times, a semi- weekly newspaper, published and circulated in the City of Temple City.
