A special meeting of Town Council was held today in the Council Room at 6 :001p,.M, and was attended by Mayor Dutton, who pre- sided, and Councilmen peters, Young, Slotin, Lovell, Hosti and Town Attorney Alexander, also by Mr. J. A. Brown. The meeting was called for the purpose of :- 1. To elect Mr. J. A. Brown as a new member of Council. 2. Consolidate the returns of the eleption of June 25th, 3. Pass an Ordinance to provide for the issuance of paving bonds passed at the election held June 25th, 1947. 4. Pass a resolution of thanks to ex- Councilman Farrell. 5..Change the hour of the regular meetings of Council. Councilman Lovell moved that James A. Brown be elected to fill the unexpired term of Joel T. Farrell, Councilman Young seconded and the motion passed. Town Attorney Alexander administered the following oath to Mr. Brown. OATH I, James A. Brown, do solemnly swear that I will faith- fully and honestly perform the duties of Councilman of the Town of Savannah Beach, Tybee Island, Georgia, to the best of my skill and ability without favor or affection, S0 HELP ME GOD. (Signed) James A. Brown All the members of the Board wished Councilman Brown a successful term of office and stated that they were happy to have him on, the Board and offered their cooperation. He stated that he would do his best in his new job. The consolidation of returns submitted by the managers of the election held on June 25th was upon motion of Councilman Slotin and seconded by Councilman Peters adopted. CONSOLIDATION OF RETURNS We, the undersigned who were duly appointed of the election held in the Town of Savannah Beach, Tybee Island,on June 25th, 1947 by resolutions adopted by Council at a special meeting held for that purpose, and who have conducted said election in accordance with the provisions of the Charter of Savannah Beach, Tybee Island, and the laws of the State of Georgia applicable thereto, do hereby certify that said election was held on June 25, 1947, in accordance with the law, and that the following votes were cast in-'said election: 96 For the issuance of Savannah Beach, Tybee Island Pav- ing Bonds of 19-7 in the amount of $90,000.00, 177 Votes Against the issuance of Savannah Beach, Tybee Island paving Bonds of 19+7 in the amount of $90,000.00. 70 Votes We further certify that we, together with the Mayor and Councilmen of Savannah Beach, Tybee Island met at 6 :30 o'clock p.m. on June 25th, 1947 for the purpose of consolidating said returns in the presences of the Managers of said election and the Mayor and Councilmen of Savannah Beach, Tybee Island, as required by la.w,,and we do hereby announce and declare the results of said election as set out above. Councilman peters moved that the following Resolution be adopted, Councilman Young seconded and the motion passed. 1 1 A special meeting of City Council was held on Wednesday, June 25th, 1947, at 6 :30 o'clock, p. M. at the Town Hall, Savannah Beach, Georgia, for the purpose of adopting resolutions necessary to the issuance of bonds by the Mayor and Councilmen of Savannah Beach, Tybee Island, a copy of the notice of such special meeting being hereto attached and made a part hereof. Present were: Hon. Edward A. Dutton, Mayor and the following Councilmen: Hon. Morris Siotin Hon. William S. Lovell Hon. John A. Peters Hon. Benno P. Hosti Hon. Mitchell R. Young Hon. James A. Brown 97 The following resolution was read and unanimously adopted : - RESOLUTION WHEREAS by resolution of the Mayor and Councilmen of Savannah Reach, Tybee Island, in council adopted on May 15th, 1947, an election was called to be held in said municipality on June 25th, 1947, to submit to to qualified voters of said municipality the question of incurring debts and issuing the following bonds as hereinafter set out, to wit: - BONDS, the proceeds of which shall be used for the exclusive purpose of opening, paving, grading repairing and hard surfacing streets any ways within said Town of Savannah Beach, and of acquiring rights of way and lands necessary in order to carry out said purpose, in the amount of Ninety Thousand ($90,000.00) Dollars. AND WHEREAS the said Mayor and Councilmen of Savannah Beach, Tybee Island caused a notice of said election to be published in the Savannah Evening press, a newspaper published in the City of Savannah, Chatham County, Georgia, in which Sheriff's advertisements for the County of Chatham are published, notifying the qualified voters of said municipality that on the 25th day of June, 1947, an election would be held to determine the question of whether or not the said bonds should be issued by said Municipality, said notice conataining specifications and information required by law; AND WHEREAS se.id Mayor and Councilmen also caused to be published in said newspaper,a list of the qualified voters eligible to vote in said election more than three,-(3) days prior thereto, as required by the charter of said municipality; AND WHEREAS said election was held on the 25th day of June, 1947, in accordance with said resolution and order and notice, as required by law; AND WHEREAS the several managers of said election brought in the returns from said election, as required by law, which returns had been made to the Mayor and Councilmen of Savannah Beach, Tybee Island, they being the officers calling and ordering said election; and it appearing to the Mayor and Councilmen of Savannah Reach, Tybee Island and to the managers of said election who brought up said 98 returns, as provided by law, in joint session assembled, and who in the presence of and together with each other, canvassed and con- solidated said returns, that said election was ;field in the voting precinct in said municipality and that said election was held by the came persons, and in the same manner, and under the same rules and regulations that elections for officers of said municipality are held; AND WHEREAS sald_Mayor and Councilmen of Savannah Beach, Tybee Island, and the several managers in said election who brought in the returns in the presence of -and together with each other, consolidated said returns and the result of the said election to be as follows : - Savannah Beach, Tybee Island paving Bonds for 19+7 FOR AGAINST TOTAL 177 70 2 AND IT FURTHER APPEARING from the registration list of said municipality, as certified by the Official Registrar acid as furnished to and used by the managers of said election, which registration list was filed with said returns of said managers, that the total number of qualified voters of said municipality are ij-75 . AND IT FURTHE.a APPEARING from said returns, consoli- dated as aforesaid, that more than a majority of the qualified voters of said municipality, voting at said election, voted for said bonds; AND IT FURTH':IR APPEARING that said officers calling and ordering said election, namely, the Mayor and Councilmen of Savannah Beach, Tybee Island, in the presence of and together with the said several managers of said election, who brought up said returns, did declare said election to be in favor of issuing said bonds, to -wit : - BONDS, the proceeds of which shall be used for the exclusive purpose of opening, paving, grading, repairing and hard surfacing streets and ways within said Town of Savannah Beach, and of ac- quiring rights of way and lands necessary in order to carry out said purpose, in the amount of Ninety Thousand 090,000.00) Dollars. THEREUPON, it is ordered that said election is in favor of the issuance of siad bonds; and it is further ordered that the consolidated returns of said election and this resolution be entered upon the minutes of Council of Savannah Beach, Tybee Island, Given under our hands and official signatures this 25th day of June, 1947, Edward A. Lovell Councilman 99 Councilman Hosti moved that the following Ordinance be adopted, Councilman Young seconded and the motion passed. AN ORDINANCE TO REGULATE AND PROVIDE FOR THE ISSUANCE OF BONDS OF SAVANNAH BEACH, TYBEE ISLAND, IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE VII, SECTION VII, PARAGRAPH 1 OF THE CONSTITUTION OF GEORGIA, TO- WIT: NINETY (90) SAVANNAH BEACH, TYBEE ISLAND PAVING BONDS OF 1947; SAID BONDS TO BE SERIAL BONDS IN THE DENOMINATION OF ONE THOUSAND ($1,000.00)DOLLARS EACH, OR NINETY (90) BONDS AGGREGATING THE SUM OF NINETY THOUSAND ($90,000.00) DOLLARS, ALL OF SAID BONDS BEING DATED AS OF THE FIRST DAY OF AUGUST 1947; SAID BONDS TO RUN TWENTY (20) YEARS FROM THAT DATE; TO BEAR INTEREST AT THE RATE OF TWO AND THREE QUARTERS (2 3/4) E'ER CENTUM PER ANNUM; SAID INTEREST PAYABLE SEMI- ANNUALLY ON THE FIRST DAY OF FEBRUARY AND THE FIRST DAY OF AUGUST IN EACH YEAR AFTER THE DATE THEREOF; SAID ISSUE OF BONDS SHALL BE USED FOR THE FOLLOWING NAMED PURPOSES AS PROVIDED IN A RESOLUTION ADOPTED BY THE MAYOR AND COUNCILMEN OF- SAVANNAH BEACH, TYBEE ISLAND ON MAY15th, 1947: BONDS, THE PROCEEDS OF WHICH SHALL BE USED FOR THE EXCLUSIVE P- URPOSE OF OPENING, PAVING, GRADING, RE- PAIRING AND HARD SURFACING STREETS AND WAYS WITHIN SAID TOWN OF SAVANNAH BEACH, AND OF ACQUIRING RIGHTS OF WAY AND LANDS NECESSARY IN ORDER TO CARRY OUT SAID PURPOSE; TO PROVIDE FOR THE FORM OF BOND FOR SAID ISSUE; TO PROVIDE FOR THE RETIREMENT OF ALL OF SAID BONDS; TO PROVIDE THE FORM OF INTEREST COUPONS; TO PROVIDE FOR THE REGIST RATION OF EACH BOND AS TO PRINCIPAL AND INTEREST; TO PROVIDE FOR THE ISSUANCE OF AD INTERIM CERTIFICATES PENDING THE DELIVERY OF SAID BONDS; TO PROVIDE FOR THE ANNUAL LEVY AND COLLECTION OF TAXES FOR THE PAYMENT OF INTEREST AND FOR THE RETIREMENT OF SAID BONDS• TO PROVIDE FOR. WHEREAS, by resolution of the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council,adopted on May 15th, 1247, an election was called to be held in said town on June 25th, 1947, tox submit to the qualified voters of said town the question of in- curring debts and issuing bonds as hereinafter set out, to -wit : - BONDS, the proceeds of which shall be used for the exclusive purpose of opening, paving, grading, repair- ing and hard surfacing streets and ways within said town of Savannah Beach, and of acquiring - rights of way and lands necessary in order to carry out said purpose. 100 AND WHEREAS IN SAID RESOLUTION it was provided that the form and manner in which all of said described bonds and interest coupons attached thereto should be executed and how said bonds may be registered, all all other matters incident to the lawful iss- uance, sale and payment of said bonds should be determined and fixed by the said Mayor and Councilmen of Savannah Beach, Tybee Island. THEREFORE, BE IT ORDAINED by the Mayor end Co ncilmen of Savannah Beach, Tybee Island, in special meeting of Council assembled, and it is hereby ordained by authority of the same that, SECTION ONE. Savannah Beach, Tybee Island do issue nine- ty (90) Savannah Beach, Tybee Island paving Bonds of 1947 of the denomination of One Thousand 01,000.00) dollars each, same to be described and designated as ►iSAVANNAH BEACH, TYBEE ISLAND PAVING BONDS OF 1947"' provision having,alrea.dy been made in resolution adopted May 15th, 194-7 for the rote of interest, for the payment of interest and for the payment of principal. Said bonds shall be numbered from one (1) to ninety (90), both inclusive. 1 -a. That the issue. of said. Savannah Beach, Tybee Island bonds shall be sold by the Mayor and Co uncilmen of Savannah Beach, Tybee Island in such amounts as may be deemed necessary by them in order to comply with and in accordance with the authority vested in them by the charter of said town, as amended, and the Constitution and laws of the State of Georgia. 1 -b. Said bonds shall bear date as of August 1st, 1947, and shall mature and be payable in eighteen (18) equal annual installments of Five Thousand ($5,000.00) Dollars each. Five (5) of said bonds, numbered one (1) to five (5), both inclusive, shall mature and be payable on the 1st day of August 1950, and five (5) of said bonds of the next succeeding numbers on August 1st of each of the years 1951 to 1967, both inclusive, at the office of the Clerk of Council and ex- officio Treasurer of Savannah Beach, Tybee Island, in said town, or at the designated depository of Savannah Beach, Tybee Island in the City of Savannah, State of Georgia, at the option of the holder. 1 -c. The interest on said bonds, herein provided for, shall be evidenced by coupons attached to said bonds and shall be executed with the facsimile signatures of the Mayor and Clerk of Council of Savannah Beach, Tybee Island, and shall be payalbe semi - annually in accordance with said resolution of May 15th, 1947, to -wit: February 1st and August 1st of each year at the office of the Clerk of Council and ex- officio Treasurer of - Savannah Beach, Tybee Island in said town, or at the designated depository of Savannah Beach, Tybee Island in the City of Savannah, State of Georgia, beginning on February 1st, 1948. Each coupon shall be for the sum of Thirteen and Seventy -five one- hundredths (13.75) Dollars on each of said bonds. 1-d. The bonds above provided for shall be signed by the Mayor and Clerk of Council of Savannah Beach, Tybee Island, and the said bonds shall be in substantially the following form, to-wit:- 1 UNITED STATES OF AMERICA STATE OF GEORGIA T O W N O F S A V A N N A H B E A O H Receivable for all Taxes and BOND NO. other dues to said Town. SAVANNAH BEACH, TYBEE ISLAND PAVING BONDS OF 1947. 101 Issued for the purpose of paving streets and ways in the town of Savannah Beach, Georgia. $1,000.00 $1,000.00 KNOWN ALL MEN BY THESE PRESENTS: That Savannah Beach, Tybee Island, a municipal corporation in the County of Chatham, State of Georgia, acknowledges itself indebted, and for value received hereby promises to pay, to the bearer, or, if registered, to the registered holder thereof, ONE THOUSAND DOLLARS, on the 1st day of August, 19 , with interest thereon from the date hereof at the rate of two and three - quarters, (2 3/4) per centum per annum, payable semi- annually on the 1st day of February and the ist day of August of each year upon the presentation and surrender of the attached interest coupons as they respectively become due, or, if this bond be registered as to both principal and interest, to the registered holder thereof. Both prinicpa.l and interest of this bond are payable in lawful money of the United States of Alm ricanat the office of the Clerk of Council and ex- officio Treasurer of Savannah Beach, Tybee Island, or at the designated depository of Savannah Beach, Tybee Island in the City of Savannah, State of Georgia, at the option of the holder. This bond is one of an issue of like date and tenor except, as to the maturity,aggregating the sum of $90,000.00. The proceeds of each bond shall be used by Savannah Beach, Tybee Island for the exclusive purpose of opening, paving, grading, repairing and hard surfacing streets and ways within said town of Savannah Beach, and of acquiring rights of way and lands necessary in order to carry out said purpose. This bond is issued under the authority of Article VII, Section VII, Paragraph 1 of the Constitution of the State of Geor- gia, and the charter of Savannah Beach, Tybee Island, as amended, and pursuant to the results of an election duly called in accordance with a resolution duly adopted by the Mayor and Councilmen of Sav- annah Beach, Tybee Island, as provided therefor on the 15th day of May, 1947, said election being held in said town of Savannah Beach on June 25th, 1947, for the purpose of authorizing an issuance of said bonds, whereat more than a majority of the qualified voters of 102 Savannah Beach, Tybee Island votion in said election voted in favor thereof. This bond may be registered as to payment of principal only, or as to principal and. interest, on the books of the Clerk if Council and ex- officio Treasurer of Savannah Beach, Tybee Island, and such registration shall be noted on the bond. No transfer thereafter shall be valid, unless made on the books of such Clerk of Council and ex- officio Treasurer and endorsement of same re- gistered on the back of this bond, unless the last registration shall have been to bearer. This bond shall continue subject to successive registrations and transfer to the bearer at the option of the aner. The registration of the bond as to principal only shall not affect the negotiability of the coupons by delivery. It is hereby certified and recited that all acts, condit- ions and things required to be done precedent to the issuance of this bond have been done, and have been perforpled in due time, form and manner as required by the Constitution and laws of the State of Georgia and ordinances and resolutions of Savannah Beach, Tybee Island applicable thereto, and that provision has been made for the levying and collection of an annual tax sufficient to pay the prin- cipal and interest of this bond at maturity, end that this bond is issued pursuant to the laws of the State of Georgia, and is within every debt and other limit prescribed by the said Constitution and laws. IN WITNESS WHEREOF the said municipal corporation has caused this bond to be signed by the Mayor of said town, its corporate seal affixed thereto, and attested by the Clerk of Council, and the annexed interest coupons be authenticated by the fac- simile signatures of the Mayor of said town and said Clerk of Council, this day of 19 Mayor Attest: Clerk of Council BE IT FURTERH ORDAINED by the authority aforesaid that the form of interest coupons of all of the said described bonds shall be substantially as follows: No. On the day of 19 , Savannah Beach, Tybee Island, a municipal corporation of the County of Chatham, State of Georgia, promises to pay to the bearer Thirteen Dollars and Seventy -five Cents ( "13.75), in lawful money of the United States of America at the office of the Clerk of Council and wx- officio Treasurer of the town of Savannah Reach, or at the depository of Savannah Beach, Tybee I9'end, in the City of Sav- annah, State of Georgia, uQon presentation of this coupon, for the interest then due on that date on its Paving Bond of 1947. 1 1 Dated August 1st, 1947. 103 Mayor Attest: Clerk of Council BE IT FURTHER ORDAINED by the authority aforesaid thet there shall be endorsed on each of said bonds a certificate signed by the Clerk of the Superior Court of Chatham County, Georgia, under the seal of said Court, as follows : - STATE OF GEORGIA 0 COUNTY OF CHATHAM The undersigned, Clerk of the Superior Court of Chatham County, Georgia, does hereby certify that this bond was validated and confirmed by judgement of the Superior Court of Chatham County, Georgia, on the day of 19 , and that no ex- ceptions to said judgement have been filed, and that the time within which exceptions might be filed has expired. IN vITNESS WHEREOF I have hereunto set my hand and affixed the seal of the Superior Court of Chatham County, Georgia, this day of 19 Clerk, Superior Court, Chatham County, Georgia. BE IT FURTHER ORDAINED by the authority aforesaid that all said bonds shy -11 have the following form of registration certi- ficate: "At the request of the holder of the within bond for its conversion into a registered bond,- I have this day cut off all cou- pons attached thereto whereby this bond is converted into a regis- tered bond, with principal and interest payable to the registered owner. Hereafter no transfer of this bond shell be effected unless made on the books of the Clerk of Council and ex- officio Treasurer of the town of Savannah Beach, Georgia, by the registered holder and noted thereon, but this bond may be discharged from registration by being-so transferred to bearer, in which case said Clerk of Council nd ex- officio Treasurer will re- attach hereto all coupons then un- matured, which have been detached therefrom. In whose name registered Treasurer BE IT FURTHER ORDAINED by the authority aforesaid that for the purpose of providing funds for the payment of the interest as it shall accrue upon the aforementioned $90,000.00 of bonds designated as “Savannah Beach, Tybee Island Paving Bonds of 1947u a tax is hereby levied, assessed and shall be collected annually upon all taxable property within the corporate limits of the town of Savannah Beach, Georgia, as now existing or within any extension of said limits, sufficient to produce the following sums in each of the following years: 1948 $475.00 1949 2,475.00 1950 2.475.00 and $2,475.00 each year thereafter up to and including August let, 1967, less the decrease of annual interest payments upon the face value of those bonds that shall have matured and been retired and paid, which said sums above mentioned shall be irrevocably pledged and appropriated to the payment of the interest se it shall accrue upon said bonds. And for the purpose of providing funds for the payment of the principal of said "Savannah Beach, Tybee Island Paving Bonds of 1947f at their maturity, there stall be and is hereby levied a further additional tax to produce the sum of $5,000.00 for each of the years 1950 to 1967, both inclusive, which said several sums shall be irrevocably pledged and appropriated to the payment of the prin- cipal of said bonds at their maturity. provision to meet the re- quirements of this section shall, in due time and manner, be ann- ually made in the annual budget. The faith and taxing powers of the mayor and Councilmen of Savannah Beach, Tybee Island is hereby appropriated to the full and punctual payment of the principal and interest of the issue of honds provided for in this ordinance, and all of said bonds are hereby declared exempt and shall be exempt from all taxes imposed by the Mayor and Councilmen of Savannah Beach, Tybee Island. BE IT FURTHER ORDAINED by the authority aforesaid that the mayor of Savannah Beach, Tybee Island be, and he is hereby, authorized to notify in writing this Solicitor General of the Eastern Judicial Circuit of Georgia of the fact that the fore- 00 1 1 1 105 going ordinance providing for the issuance of said bonds, was duly adopted by the Mayor and. Councilmen of Savannah Beach, Tybee Island and to request him to take the necessary steps for the valadation of said bonds, as provided by Statute. BE IT FURTHER ORDAINED by the authority aforesaid that all ordinances and parts of ordinances in conflict with the pro- visions of this ordinance be, and the same are hereby, repealed. Councilman Slotin suggested that thought should be given to c',evising ways and means now to repair the groins that are in need of it and that it might be well to appoint a comm- ittee to look into this. Councilman Slotim moved that the following Resolution be adopted, Councilman Lovell seconded and the motion passed. A RESOLUTION WHEREAS, on June 12th, 147, at its regular meeting held on that date, the Mayor and Councilmen of the Town of Savannah Beach received the resignation of the Honorable Joel T. Farrell, as a Councilman of said Town, the resignation being caused by Mr. Farrell's desire to be relieved of his duties in order to _preserve his good health; AND, WHET EAS, Mr. Farrell has served as a member of Council of the Town of Savannah Beach since , and during all of that_time has been one of the hardest working members of Council and has rendered very valuable services to the Town largely because of his interest in the welfare of the Town and its people; AND, rdHE`_EAS, at a special meeting held on June 24th, 1947, Council with regret accepted Mr. Farrell's resignation in view of the reasons which prompted him to submit it. BE IT THEREFORE RESOLVED by the Vayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, that Council express to Mr. Farrell, on behalf of the Town of Savannah Beach and its citizens, its deep regret at receiving his resignation and its hope that his health will continue to improve and that he will be able, for many .years, as a citizen, be able to continue his interest in the Town of Savannah Beach and its welfare. BE IT FURTHER RESOLVED that a copy of these resolutions be spread upon the minutes of Council and a. copy sent to Mr. Farrell. Councilman peters moved that the following Resolution be adopted, Councilman Lovell seconded and the motion passed. 1 106 A RESOLUTION BE IT RESOLVED by the Mayor and Councilmen of Savannah Beach, Tybee Island, that the time of the regular meeting of Council be changed from 4:oo P.M. on the first Thursday in each month to 8:0o o'clock P.M. on the first Thursday in each month, unless otherwise ordered by the Mayor or Acting Mayor of said Municipality, this change to become effective with the meeting to be held on the first Thursday in August, 1947. 1 1 1
