Members present: Mayor, Wayne Neddermeyer; Councilmembers, William Reiser, Arthur Theis, Nancy Laurent, Thomas Crosby; Clerk, Donna Roehl, Attorney, Richard'Schieffer; Planning and Zoning Adm. Anne Dorweiler. Wayne Neddermeyer asked that Item 9, page 96, be corrected by deleting was supporting" to "thinks highly of". Motion by Nancy Laurent, seconded by Arthur Theis to approve the minutes as corrected. Motion carried unanimously 1. OTTO SEIDENBERG Mr. and Mrs. Otto Seidenberg presented plans and photos of a second house they wish to move onto their property to be used as a guest house. They have 10 acres to the west of their home and would situate the house as near to the north property line as allowed. The deed restrict- ions indicate that the parcel may not be subdivided until 1981. Motion by Thomas Crosby; seconded by Arthur Theis to approve moving of a guest house onto the Otto Seidenberg property, Lot 1, Block 1, Oldwoods Farm, subject to the following: 1. No commercial or rental usage 2. Must comply with covenants and restrictions 3. Must be approved by City Building Inspector 4. Must obtain the necessary city permits, IE: moving, driveway. Richard Schieffer explained that to include Item 2, compliance with covenants, may involve the city if it were violtated. Motion by Thomas Crosby, seconded by Arthur Theis to amend the motion by excluding Item 2. Motion carried unanimously Voting on original motion excluding Item 2, carried unanimously 2. KEN WEESTRAND Mr. Weestrand presented plans for the construction of a barn on 9.2 acres on Medina Rd. and Hunter Dr. Approximate size of barn is 36' by 40' located 50' from the north and east property line. Council requested written approval be secured from the neighboring property owners. Motion by Thomas Crosby, seconded by William Reiser to approve a variance for Mr. Weestrand to construct a barn subejct to furnishing the city Planning and Zoning Administrator with letters of approval from property owners to the north, east and west. Motion carried unanimously 3. CIGARETTE LICENSES Motion by Arthur Theis, seconded by William Reiser to approve 1977 cigarette licenses to: Medina Service, Countryside Cafe, Cardinal Oil Co., Village Auto Clinic and Disk and Stein. Motion carried unanimously 4. HAMEL WATER LINE PROBLEMS C. 0. Dorweiler explained the problem of water leaking into the basement of the bank in Hamel. Leo Leuer explained what had been done to try and correct the problem. Council recommended that the engineer be consulted and that William Reiser be given a report as to the engineers recommendations. 5. PLANNING COMMISSION MEMBER Matter was tabled until present members whose terms expire March 1st have been approached. Also a list of prospective new members was drawn up. 6. COMMUNITY EDUCATION SERVICES Motion by Arthur Theis, seconded by Thomas Crosby to enter into a contract with the Orono Education Services for $269.30 for 1977. Motion carried unanimously 7. POLICE MUTUAL AID Motion by Thomas Crosby, seconded by Nancy Laurent to approve Resolution 77-3, regarding Police Mutual Aid agreement as discussed at the January i$,1977 meeting, Item 6, Page 95. Motion carried unanimously 8. DENNIS BURGESS BONDS 99 Richard Schieffer explained that the City had received a new performance bond from the purchaser of the Burgess property and Medina had been asked to return the previous bond. 1He stated that there is a development contract to use in such cases and a resolution could be passed to approve the new bond and the contract. Discussion of the use of such contracts and whether or not the amount of the bond is sufficient. Council tabled action until the engineer has computed the amount of the bond that is now needed. 9. BILLS Thomas Crosby question the use of vendors and what determines where purchases are made. He was informed that some repair items must be gotten from specific companies and that most of the other purchases were made locally. Motion by Arthur Theis, seconded by Nancy Laurent to pay the bills. Order checks # 6493-6548 in the amount of $88,557.20 and Payroll cheeks # 4378-4402 in the amount of $5099.92. Motion carried unanimously 10. VOCATIONAL TECHNICAL SCHOOL Discussion as to whether or not work should be done on the Vo Tech School in view of the fact that the application had been withdrawn. Richard Schieffer explained that the Council may wish to consider the zoning question. Thomas Crosby suggested a meeting be held with the Planning Commission to discuss the report of the Planning Commission and whether changes should be made in the zoning. Motion by Wayne Neddermeyer, seconded by Nancy Laurent to hold a special meeting on February 8, 1977 at 8:30, or after the Planning Commission has completed their regular business. 11. MINNEHAHA CREEK WA.LEktSHED PROJECTS Discussion of submitting a project for consideration by Minnehaha Creek Watershed District. Clerk reported that previous project regarding drainage ditch cleaning had never been approved. Nancy Laurent will contact Minnehaha Creek personnel for information on what types of projects they might approve. .2. SALARIES Road Discussion of the amount of raise to be given to present employees and the necessity of hiring another full time employee. Motion by Nancy Laurent, seconded by Arthur Theis to increase wages by 10%, Ron Duran to $6.05 per hour and Robert Dressel to $5.50 per hour and to hire another full time person to be paid $4.00 per hour for 6 months and $4.50 after that time, with no fringe benefits for 6 months unless governed by rules and regulations of city and state. Raises to be retroactive to January 1, 1977. Motion carried unanimously Nancy Laurent reported that Steve Tillmans had asked for a slaary increase to $5.00 per hour. Discussion of amount that part time help should be paid. Thomas Crosby felt that paying $4.50 would be more in line with pay of other part time help. Wayne Neddermeyer felt that $4.00 per hour should be paid to general part time help and $4.50 if chauffeurs licensed. Motion by Thomas Crosby, seconded by William Reiser to pay Steve Teilmans $4.50 per hour beginning February 1, 1977. Motion carried unanimously Clerk Thomas Crosby discussed the possibility of hiring a city manager and combining several posistions He has contacted the League of Minnesota Cities for information regarding the procedure. Richard Schieffer stated that Medina would need to adopt Plan "B" if they wished to hire a city manager and that a city manager has authority to make decisions without Council action. 'homers Crosby stated that he would secure idditional information regarding the matter. ewer and Water Council discussed the 6 month report of work that had been done, hours spent and miles traveled by Leo Leuer. Mr. Leuer asked if it would be possible to purchase a pick-up truck for use by the Sewer and Water Department as the amount of money he is receiving for mileage is not sufficient. 1 0 0 Discussion of what was allowed in the budget for equipment purchases. Clerk will provide the 1976 report of r$ceipts and disbursements. Wayne Neddermeyer felt that increasing the mileage rate would be one way of taking care of the problem. Matter tabled along with salaries of clerk, planning and zoning administrator and building inspector. 13. MORRIS HOLMBERG, CHESTNUT ROAD Richard Schieffer explained that Morris Holmberg had sent a form for Quit Claim Deed for the north 33 ft. of mile along his property on Chestnut Woad. He asked that a contract be signed regarding the city haveing easements on the south side of the road. Thomas Crosby asked whether or not it was the cities responsibility to investigate the matter or should the property owner be responsible. He stated that he would contact Robert Scott as to who is selling and what is being sold. 14. TRAIL SYSTEM Arthur Theis reported that he had talked with previous members of the committee as to what had been done by them. Suggestions were made regarding reactivating the committee. Thomas Crosby stated that he would ask Robert McCrea to be chairman. 15. COMMUNITY HEALTH SERVICES Council agreed that there was ne need for any of the additional services as set forth in the questionaire that had been received. Any additional services would mean spending city funds. 16. NANCY LAURENT Nancy Laurent reported on the meeting she had attended for newly elected officials and requested to be reimbursed $30.00 for the registration fee. Wayne Neddermeyer felt that advance approval should be gotten before attending any meetings as there is no promise that fees will be reim- bursed. Motion by Thomas Crosby, seconded by Arthur Theis to pay Nancy Laurent the $30.00 fee for attending the Government training session for newly elected city officials. Motion carried unanaimouisly 17. CHEMICAL DEPENDENCY SESSION Arthur Theis reported that Marge Gasch of the Orono School Board had requested a councilmember to attend a session on chemical dependency and that he would attend as Medina's representative.
