HomeMy Public PortalAbout19470807CCMeetingAN ORDINANCE TO AMEND AN ORDINANCE CREATING AREA3 'TITHIN THE CORPORATE LIMITS OF THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, AND ZONING THE SAME; AND FOR OTHER PURPOSES. BE IT ORDAINED by the rayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, end it is hereby ordain- ed by authority of the same. SECTION ONE. That Section 9 of an ordinance creating areas within the corporate limits of the Town of Savannah Beach, Tybee Island, and zoning the same, be, and. the same is hereby amended by adding to the third paragraph in said Section 9 the following language, to-wit:- "Building Lots in a subdivision of Lot Ten (10) and the Southeastern half (*) of Lot Eleven (11), Ward Six (6), may be at least forty by sixty feet (0 X 60).1 SECTION TWO. That all ordinances and parts of ordinances in conflict herewith be, and the same are hereby, reoepled. There being no further business, Council adjourned subject to the call of the Mayor. The regular meeting of Town Council eras held today at 4:00 P.m, in the Town Hall and was attended by Mayor Dutton, who presided, and Councilmen Peters, Young, Brown and Town Attorney Alexander. adopted. The minutes of the meeting of July 10th were read and Mr. Hubert, L. Ellzey petitioned to have a. portion of a 20 foot street in Fort Screven adjacent to his property, conveyed to him. Referred to Twon Attorney. The Mayor stated that the Georgia. Health Department was conducting a sanitary school for sanitary inspectors et Georgia Tech in Atlanta, he recommended that several of the Department heads etend this school, Councilmen Young, moved that 1 1 111 S. R. Kent and Thomas Reed attend expenses to be paid by the Town, Councilmen Brown seconded and the motion passed. Councilman Peters moved that the whiskey, beer, soft drink, pinball machine and automatic music machine license in the name of the Kozy Korner by F. P. Hear be transferred to the Kozy Korner by J. M. Hear, Councilmen Young seconded and the motion passed. Councilman Peters stated that Mr. A. F. Solms had object- ed to paying 310.00 for a soft drink license as he had already paid a. license to operate a soda. fountain. It was the opinion of Council that he should o y it. J. T. Ellerby, Secretary of the Colored Y.M.C.A. in Sav- annah appeared before the board in connection with establishing an area on the beach for the use of colored people where a pavil- ion and bath houses, etc., could be erected for the use of the colored people, he steted no liquor or gaiibling would be tolerated. He was excused. A petition was also presented signed by several hundred colored people requesting the same thing. The Mayor appoint- ed Councilmen Peters, Brown and Young to investigate the matter and report back nt the next meeting. Councilman Young stated that Dr. Henderson had written calling attention to the unsanitary condition of the public rest rooms, that they were dirty and flies were all over the place. It was agreed that the condition be corrected. • A petition was presented by a majority of the property owners on Eleventh_ Street from Butler Avenue to the Strand re- questing :that this street not be _)aved when the new paving pro- gram is started. Petition granted. The Mayor naked what streets was going to be paved, the matter was referred to a committee consisting of Councilmen Peters, Brown and Slotin. Councilman Young moved that bills for the month of July amounting to 34,867.49 be paid, Councilman peters seconded and the motion passed. Councilman Young moved that the following resolution be adopted, Councilman peters seconded and the motion passed. A RESOLUTION WHEREAS it has been brought to the attention of the Mayor and Councilmen of Savannah ;?each tfnat on May F3, 1947, Mr. James Bentley, by his presence of mind and skill rescued a woman, whose name is not known, from the surf near the De Soto Beach Club at Savannah Beach, and by his application of artificial respiration succeeded in saving her life; And whereas the Mayor and Councilmen of Savannah Beach think that such services should be noted officiilly and commended; Be it therefore resolved by the Mayor and Councilmen of Srvannah Beach, Tybee Tslnd in o embled, thpt the thanks of the town be extended to Mr. Bentley for his splendid work in Laving the life of the aforesaid woman. Be it further resolved that n copy of these resolutions be written upon the minutes of Council and v copy be sent to r. Bentley. 1 1 1 113 The meeting was then recessed to 8 :00 P.M., Thursday August 7th, 1947. Savannah Beach Tybee Island, Ga. -; August 7th, 1947. The meeting held a :.t 4;00 PM this afternoon was recessed until 8 :00 p.m. tonight and was attended by Councilman Biotin) who presided and Councilmen Brown, Young, Lovell, Hosti and. Town Att- orney Alexander also by Mr. Sam L. Varnedoe and Mr. William J. Lynch. Se-.led b.''s for the 190,000.00 of paving Bonds were pre- sented by the following: Varnedoe, Chisholm & Company, Inc., Joiinson Lane Space & Company, Inc. and The Citizens and Southern National Bank, through Varnedoe, Chisholm and Company, Inc. whose bid was 1190,000.00 plus the Premium of $2,556.00. The other bid was from Brooke, Tindall and Company and the Trust Company of Georgia, through Brooke, Tindall and Company offering $90,000.00 plus 11,179.00. Mr. Varnedoe stated try; t if the cost of the legal opinion went obove 5150.00 they would pay any amount above ;150.00, also that the Town would psy the cost of printing the bonds. The bid of Varnedoe, Chisholm and Company, Inc. being the high bid, Councilman Young moved that the following resolution be adopted, Councilman. Brown seconded and the motion passed. A RESOLUTION WHEREAS announcement was made by the Mayor and Councilmen of savannah Beach, Tybee Island, that sealed bids would be received for the purchase of $90,000.00 face value of Savannah Beach, Tybee Island, Paving Bonds of 1947, said bids to be opened et the regular meeting of Council to be held at 8 o'clock p.m, on August 7, 1947, at the Town Hall at Savannah Beach, Georgia.; And whereas the bid of Varnedoe, Chisholm and Company, Johnson, Land, Space end Company and the Citizens end Southern National Bank was in the amount of $92,556 plus accrued interest from August 1, 1947, subject to the opinion of Messrs. Spalding, Sibley, Troutman and Kelly of Atlanta, reorgia., as to the validity of the issue, the bidder agreeing to pay any amount by which the fee of said counsel exceeded the sum of :150.00, and the municipal ity to pay said fee to the extent of 1150.00 and to pay the cost of printing said bonds; And whereas said bid was the highest and best bid received at said meeting of Council; BE IT .THEREFORE resolved by the Mayor and Councilmen of Sevenneh Beach, Tybee Island, in Council assembled, thst said bid of Vernedoe, Chisholm and Company and their associates, in the amount of $92,556, and subject to the contraditions and agreements above recited be, and the some is hereby accepted. Be it further resolved that the Town Attorney be, and he is hereby directed to secure an opinion as to the validity of seld bonds from said counsel in Atlanta PS soon as possible; and he is further directed to proceed with having said bonds and Interest coupons printed and signed as soon as possible. Councilman Young moved that the following resolution be adopted, Councilman Hosti seconded and the motion passed. A RESOLUTION WHEREAS, in connection with the issuance of $90,000.00 face *selue, Savannah Retch, Tybee Islend, Paving Bonds of 1947, • it it necessary that the Mayor and Councilmen of Sevannah Reach, Tybee Island, designate a. banking institution in the City of Savannah, GeOrgial which sahll act te e depository and paying agent for stid bonds as they mature, and. for the interest coupons attached to said bonds as they shall be payable; BE IT THEREFORE resolved. by the Mayor and Councilmen of Savennah Beach, Tybee Island in Council assembled, that the Citizens and Southern National Bank of Savannah, Georgia be, and the same is hereby, designated as depository of Savannah Beach, Tybee Island and paying agent in connection with said bond issue, so that ell persons desiring to surrender tny of sn.id bonds for payment when mature or desiring to present said interest coupons es the same shall become due, may present the seme to said deposi- tory as paying agent4: Be it further resolved that the Clerk of Council and e26;; officio, treasurer of Savannah Beach, Tybee Island be and he is hereby authorized and directed, to aposit with said depository and paying agent, from time to time, sufficient funds to pay said • bonds as they mature and to pay said interest coupons es the same come due. Re it further resolved that said Clerk of Cosncil and ex-officio treasurer be, and he is hereby authorized and directed to pay to said depository nd paying agent its charges for acting as such, the amount of which may be hereafter agreed upon by the municipelity end seid depository and paying agent.
