PROCEDURE.-
THE CITY COUNCIL OF THE :,CITY OF TEMPLE CITY DOES ORDAIN
AS FOLLOWS•
SECTION l,... That Sect ion. 1822 is hereby added to the Temple
City Municipal Code to r. ead as follows:
"1822. PLANNING COMMISSION TIE VOTE, EFFECT OF. Where,
by reason of disqualification, abstention or absence of any member
or members of the Planning Commission, said Commission is unable to
reach a determination by a majority vote thereof, as to a zone
variance or a conditional use permit application within forty (40)
days after the close of the public hearing relating thereto, said
matter shall be deemed automatically appealed to the City Council,
without decision by the Planning Commission. In such event, the
said matter shall be placed upon the City Council's Agenda and a de
novo public hearing held thereon, and the matter shall be finally
Tetermined by the City Council."
SECTION 2. That Section 1915 is hereby added to the
Temple City Municipal Code, to read as follows:

"1915. PLANNING COMMISSION TIE VOTE, EFFECT OF.
Aenever the Planning Commission by reascn of the disqua,-
ification, abstention or absence of any member cr members, is unabe
to render a decision upon a )ro7osed amendment within Forty (LO)
days after the conclusion of the DubHic hearing or hearings, such
amendment or other proceeding Pursuant to this Article shall be deeme
be denied by the Planning Commission and shall be subject to
appeal to the City Council."
SECTION 3. That the City Clerk shall certify and attest
to the adoption of this Ordinance and shall cause the same to be
published once in the Temple City Times, a semi - weekly newspaper,
published and circulated in the City of Temple City.

on the 20th day of July , 1965, by the following vote of the
Council:
