Young 1,101.49 $13,374.88 17 MINUTES The City Council of Medina, Minnesota met in regular session on February 1, 1994 at 7:30 p.m. in the City Hall Council Chambers. Present: Council Members John Ferris, Ann Thies, Philip Zietlow and Mayor Anne Theis. Absent: Council Member James Johnson. Also Present: Police Chief Rick Rabenort, Public Works Director Jim Dillman, City Engineers Glenn Cook and Shawn Gustafson, Zoning Administrator Loren Kohnen, City Attorney Ron Batty and Clerk -Treasurer Jeff Karlson. 1. ADDITIONS TO THE AGENDA Moved by Thies, seconded by Ferris, to approve the addition of the following agenda items: a. Discussion of Loretto's Sewer Problem b. Notice from LaPlant Sanitation Regarding Change of Rates Motion carried unanimously. 2. CONSENT AGENDA Moved by Thies, seconded by Zietlow, to adopt the consent agenda, as follows: a. Approval of Lawful Gambling License and One -day Beer Permit for Holy Name Church b. Resolution No. 94-06, "Resolution Approving a Premises Permit Renewal Application to the Hamel Volunteer Fire Department to Conduct Lawful Charitable Gambling" Motion carried unanimously. 3. MINUTES Moved by Mayor Theis, seconded by Thies, to approve the minutes of the regular meeting of January 18, 1994, as amended, as follows: Page 1, item 4, paragraph 3, to read, "...the Orono City Council had directed staff to advice Medina that they are 'neither interested nor willing to amend the (Medina/Orono/Long Lake) agreement to provide sewer units for additional development.'" Page 3, paragraph 7, line 3, to read, "Keller pointed out that he had submitted a petition at the last council meeting in which 75% of the residents in Medina Morningside had signed to show support for the Planning Commission's recommendation that the Comprehensive Plan be amended and that Keller's property be rezoned from rural residential to suburban residential." Motion carried unanimously. 18 4. ASSESSMENT HEARING ON PART III OF MEDINA ROAD IMPROVEMENT PROJECT Mayor Theis stated that the purpose of this public hearing was to consider objections to the proposed assessments for the construction of Medina Road from Tamarack Drive to County Road 24. City Attorney Ron Batty stated that a written objection had to presented before the close of the hearing or a property owner would lose his or her right to appeal the assessment. Batty said an owner of property could then serve notice of the appeal upon the mayor or clerk within 30 days after the adoption of the assessment and filing such notice with the district court of Hennepin County within ten days after service upon the mayor or clerk. Project Engineer Shawn Gustafson said the subdrain tile, grading, stabilization fabric and gravel base would be constructed by the city's public works department and the street surfacing, gravel shoulders and restoration would be contracted. The roadway would have a 24 foot wide bituminous surface with six foot gravel shoulders. Gustafson said the total cost of the project was estimated at $545,460. Gustafson said the city's policy was to assess 75% of the contracted costs to the benefiting properties on a unit basis. The assessed cost per unit was $4,615. Mayor Theis pointed out that the assessment would be payable in equal assessments extended over a period of 10 years. Phil Zietlow asked Public Works Director Jim Dillman what it cost the city to maintain the gravel base on the west section of Medina Road. Dillman estimated that the city spent about $25,000 to $30,000 a year maintaining this section of Medina Road. Dillman compared this to Tamarack Drive which was paved nine years ago. He said Tamarack was seal -coated once since it was paved. Dillman added that there was usually very little maintenance costs for a paved road the first ten years. John Ferris said another factor to consider was having an additional paved access through the city. Ferris said the cost of the road would be a one-time occurrence. He added that the cost would be considerably higher in the future if the road were not paved this year. Richard Linck, 1762 Morgan Road, asked what the likelihood would be of the city going outside of the right-of-way and if a property owner received any kind of compensation for the taking of right-of- way. Jim Dillman said it was possible that the city would have to go outside of the right-of-way in some spots. Dillman said the city had not provided compensation for right-of-way. Linck asked if the speed limit would be affected by the new road. 19 Gustafson said the road would accommodate a 40 mile per hour speed limit. Dan Pelak, 880 Navajo Road, said he was assessed for Part II of the Medina Road project. Pelak said the property owners included in Part II were over -assessed based on the dollars that were actually expended for the construction of the road. John Ferris pointed out that when the construction of Medina Road was originally proposed in 1992, the assumption was that the entire road would be completed in three parts. Ferris said the assessments were based on the premise that everyone should be assessed the same for the construction of all of Medina Road. Palek said if this was the case, then why didn't the construction begin on the east section of the road and move west? Ferris said the property owners in the middle portion of the road between Tamarack Drive and Hunter Drive expressed the most interest in having the road paved when the project was originally proposed. Dick Townsend, 650 Navajo Road, asked if the assessment rate for Part III, in relation to the total cost of the project, was the same as Part II. City Engineer Glenn Cook said each property owner would share in the entire cost of the road. Cook said the council's intention was to treat everyone along Medina Road the same. Holly Leuer, 1522 Medina Road, said there was considerably more homes on the west end of Medina Road and only one home on the east end that would benefit from the road. Leuer expressed her support for the paving of the west section of the road. Leuer felt the off -road assessments were fair. She reminded everyone that property owners off of Tamarack were also assessed for the paving of that road. Jim Fenning, 1151 Hunter Drive, said the council should consider paving the east portion of Medina Road. Ann Thies said she was not in favor of paving the east section because it would open up the road to Plymouth and increase the amount of traffic into Medina. Ed Lundgren, 1582 Medina Road, said he had lived on Medina Road since 1972 and was ready for a change. Mary Osgood, 2120 Mohawk Drive, said she had lived in Medina for a year and a half and had used Medina Road once. Osgood said she objected to the assessment because the paving did not benefit their property at all. She asked if the council would be taking a vote on whether to pave the road. 20 Ron Batty said the first step in the process was the public hearing to consider any objections from the property owners being assessed and then to adopt the assessment roll. Batty said if too many property owners appealed their assessment within 30 days after the hearing, the council would not order the project. Dale Kunz, 1752 Morgan Road, said he favored the paving of Medina Road. He asked if the council would consider paving the small portion of Morgan Road to complete the process. Kunz also asked the council to consider reducing the speed limit to 30 miles per hour because of poor visibility from the west going east on Medina Road. Glenn Cook said the only way to change the speed limit would be to have MnDOT prepare a traffic study. Cook said there were advisory plates underneath warning signs with 30 miles per hour posted along the hills and curves. Bud Eisinger, 1832 Medina Road, said Morgan Road would have to be rebuilt before being paved and would be an expensive project. John Schulz, 2100 Mohawk Drive, asked why his property was included in the project when there were no plans to resurface Mohawk Drive. Schulz said he did not use Medina Road and had no reason to use it. Cook said when the city's assessment policy was established in 1987, the intent was to try to include every property owner in an assessment for a collector road. Cook said the same amount is assessed to on -road and off -road properties. Schulz said if the policy of the city was to assess every property, why weren't more residents on County Road 24 being assessed for the project? Cook said it was possible that some property owners would never be assessed for a road. Ann Thies said it came as a surprise to her that not every property would be assessed for a collector road. Thies said if this was the case, the council needed to take a closer look at the policy of assessing every property. Moved by Mayor Theis, seconded by Thies, to close the public hearing at 8:51 p.m. Moved by Ferris, seconded by Zietlow, to adopt Resolution No. 94- 05, "Resolution Adopting Assessment Roll for the Improvement of Medina Road between Tamarack Drive and County Road 24." Ayes: Ferris, Thies, Zietlow and Mayor Theis. Nays: None. Resolution No. 94-05 adopted on 4-aye and 0-nay vote. 21 5. KELLER COMPREHENSIVE PLAN APPLICATION City Attorney had prepared a resolution denying Fred Keller's request for a comprehensive plan amendment for the council to consider. Keller asked why the council's denial of his request was stated in the form of a resolution. Batty said it was consistent with past practice. Batty said a resolution would have likewise been adopted if the amendment had been approved. Keller said a statement in the resolution regarding Orono's opposition to an amendment to the Medina/Orono/Long Lake sewer agreement should not be included because Orono was not the one providing sewer units. Phil Zietlow said the Met Council's statement that it did not support further urban development in the Medina Morningside area should be added to the resolution. Moved by Mayor Theis, seconded by Thies, to table the adoption of the resolution denying Fred Keller's request for a Comprehensive Plan amendment and to direct City Attorney Ron Batty to redraft the resolution. Motion carried unanimously. 6. APPOINTMENT OF ALTERNATE COMMISSIONER TO PIONEER-SARAH CREEK Moved by Mayor Theis, seconded by Ferris, to appoint Mary Ann Huseth, 2715 County Road 19, as Medina's alternate commissioner to the Pioneer -Sarah Creek Watershed Management Commission. Motion carried unanimously. 7. LONG LAKE CLEANWATER IMPROVEMENT PROJECT Ellen Sones, district administrator for the Minnehaha Creek Watershed District, gave an overview of the Long Lake Cleanwater Improvement project which focused primarily on improving the water quality in Long Lake. As part of the implementation plan for the Long Lake Clean Water program, the District intended to establish a Public Information Committee which would assist in the development of public education and lake monitoring programs. Sones said the District needed local support in establishing a public education program in order to sell the project to the MPCA. Sones added that the District expected to receive substantial funding in 1995 from the Minnesota Pollution Control Agency (MPCA). Mayor Theis appointed Phil Zietlow as Medina's representative on the Public Information Committee. 8. PLANNING COMMISSIONER APPOINTMENTS In a memo to the council, Planning & Zoning Assistant Sandie Larson informed the council that the terms of Planning Commissioners Penny Elsenpeter, Dave Onan and Frank Mignone would expire in March. 22 John Ferris said the council should stick with the policy of advertising all openings, including those members who wished to be reappointed. Commissioners desiring to serve another term would have to reapply for the position. Moved by Ferris, second by Zietlow, to direct Clerk -Treasurer Karlson to place an advertisement in the city's official newspaper announcing that the city would be receiving applications for three openings on the planning commission. Motion carried unanimously. 9. RATE INCREASE FOR PROSECUTING ATTORNEY Prosecuting Attorney Steve Tallen said the prosecution rates had remained unchanged since January of 1991. Tallen proposed that the hourly rates be increased from $70 to $75, effective February 1, 1994 and from $75 to $77 per hour, effective January 1, 1995. Tallen said this amount reflected the "going rate" for prosecution services in Hennepin County. Moved by Thies, seconded by Mayor Theis, to approve the fee schedule proposed by City Prosecutor Steve Tallen, as follows: 1. Hourly rate to be increased from $70 to $75, effective February 1, 1994. 2. Hourly rate to be increased from $75 to $77, effective January 1, 1995. Motion carried unanimously. 10. PARK COMMISSIONER APPOINTMENT Galen Bruer, 2815 Capriole Drive, said he was interested in serving on the Park Commission because of his desire to make a contribution to Medina and to help the city achieve some of its short and long- term goals. Mayor Theis said there was another resident who had applied for the opening on the park commission but he had left early due to the lateness of the meeting. Theis informed Bruer that the council strived to balance representation on the commission geographically. Theis said she would like to give the other candidate another opportunity to address the council before a decision was made. Moved by Ferris, seconded by Thies, to table the appointment of a park commissioner until the next meeting on February 15, 1994. Motion carried unanimously. 11. UPDATED FEE SCHEDULE Moved by Mayor Theis, seconded by Ferris, to authorize Ron Batty to prepare a resolution with the city's updated fee schedule. Motion carried unanimously. 23 12. APPOINTMENT OF WEEKLY NEWS AS MEDINA'S LEGAL NEWSPAPER Moved by Thies, seconded by Zietlow, to appoint the Weekly News as the city's legal newspaper. Motion carried unanimously. 13. PROPOSAL FOR NETWORK CABLING Moved by Mayor Theis, seconded by Zietlow, to approve a proposal from Banyon Data Systems to replace the existing coaxial computer network cabling with an 8-Port Ethernet Hub network cabling configuration at a cost of $1,025. Motion carried unanimously. 14. 1994 LOCAL BOARD OF REVIEW Moved by Mayor Theis, seconded by Thies, to establish Wednesday, April 6, 1994 at 7:00 p.m. as the date and time of the 1994 Local Board of Review. Motion carried unanimously. 15. MEETING CHANGE Moved by Mayor Theis, seconded by Zietlow, to change the date of the first council meeting in March to March 2, 1994 due to the precinct caucuses being held on the first Tuesday of the month. Motion carried unanimously. 16. NOTICE FROM LAPLANT SANITATION REGARDING CHANGE OF RATES Mayor Theis submitted a letter she received from LaPlant Sanitation which asked the city to approve their new basic rates. Ron Batty said the city has an agreement with the garbage haulers which states how much the rates could increase. Batty said according to the agreement, the haulers could increase their rates each succeeding year only by the cost of living. Batty said LaPlant had simply sent a notification showing what the new rates would be which was in compliance with the agreement. He said no action had to be taken. 17. CITY OF LORETTO'S SEWER PROBLEM In a letter to Mayor Theis, Loretto Mayor Tom Van Beusekom said Medina's decision to not actively support Loretto's efforts in trying to gain approval from the Met Council to discharge into the Medina Interceptor could significantly damage their proposal. Van Beusekom added that Medina's support was pivotal to Loretto's success with the Met Council. He asked that Medina outline its position to the Met Council of not wanting to give up sewer units and offer conditional support on that basis. Phil Zietlow said he was uncomfortable not knowing all the pieces of the puzzle in regard to Loretto's plans for sewer expansion. Mayor Theis said she would contact Van Beusekom and ask that he meet with the council to discuss Loretto's plans. 24 18. PAYMENT OF BILLS Moved by Zietlow, seconded by Ferris, to approve payment of Order Check Numbers 12844-12901 for $72,627.11 and Payroll Check Numbers 13752-13770 for $13,374.88.
