HomeMy Public PortalAbout076-2006 INTERLOCAL AGREEMENT, LeaINTERLOCAL AGREEMENT This Agreement is entered into this _16th day of November, 2006, by and between the City of Richmond, Richmond, Indiana (hereinafter "City") and the Richmond Sanitary District (hereinafter "Sanitary District"). WHEREAS, the City has in previous years handled the collection of leaves during leaf season for the Sanitary District; and WHEREAS, upon review of the feasibility of the City's collection of leaves for the Sanitary District, it was recommended that an Interlocal Agreement transpire between the City and the Sanitary District; and WHEREAS, the City now desires, for purposes of cost and efficiency, to adjust the fee for leaf collection for the Sanitary District; and WHEREAS, this increase of the fee will substantially reduce the excess costs for the Street Department associated with leaf collection in the Sanitary District; and WHEREAS, the City and the Sanitary District desire to set forth in writing the terms of their agreement through this Interlocal Agreement regarding the collection of leaves for the Sanitary District by the City; NOW, THEREFORE, in consideration of the terms and conditions contained herein, including the above stated recitals, the parties agree as follows: 1. PURPOSE — The purpose of this Contract is to provide for the collection of leaves throughout the Sanitary District. The City does hereby agree to provide said services for the Sanitary District and arrange for the disposal of such waste upon the terms and conditions set forth herein. 2. TERM - The City and Sanitary District do mutually agree to honor the Agreement and the commitments contained herein for the 2006 leaf season, consisting of five (5) leaf collections, commencing October 7th and terminating December 2nd.. Collections missed may be collected beyond the December 2nd end date, if necessary. 3. COSTS - This Agreement is intended to cover all costs incurred by City's Street Department for the collection of leaves for the Sanitary District. The costs of services to be provided to the Sanitary District shall not exceed Twenty Nine Thousand Eight Hundred Seventy Four Dollars and Twenty Cents ($29, 874.20). Contract No. 76-2006 4. FORCE MAJEURE — Neither City nor Sanitary District will be liable for failure to perform their obligations under this Agreement nor shall such failure be a default under this Agreement when the failure is due to fire, flood, storms, epidemics, earthquakes, volcanic eruptions, war, riot, insurrection, governmental restraints, or labor disturbances against entities other than the City. 5. MISCELLANEOUS — This Agreement shall be construed according to the laws of the State of Indiana. 6. AMENDMENTS — No amendment or modification to this Interlocal Agreement shall be made except in writing and signed by both parties. 7. AUTHORIZATION — The individuals signing below represent that they have full authorization to execute this document on behalf of either the City of Richmond or the Richmond Sanitary District.
