Bal Harbour Village Council Regular Council Meeting Minutes March 16, 2021 At 6:30 PM Bal Harbour Village Hall • 655 - 96th Street • Bal Harbour • Florida 33154 CALL TO ORDER/ PLEDGE OF ALLEGIANCE Mayor Groisman called the meeting to order at 6:34 P.M. The following were present: Mayor Gabriel Groisman Assistant Mayor Seth Salver Councilman David Albaum Councilman Jeffrey Freimark Councilman Buzzy Sklar Also present: Jorge M. Gonzalez, Village Manager Dwight S. Danie, Village Clerk Susan L. Trevarthen, Village Attorney Mayor Groisman acknowledged the passing of Jamie Sanz, former Bal Harbour Village Councilman, and most recently, a Resort Tax Committee Member, also a good friend and most importantly, a Bal Harbour Village family member. He recounted Mr. Sanz's kindness and positive attitude in working with and for the community. He then led a moment of silence for Jaime. The Pledge of Allegiance was then led by Mayor Groisman. REQUESTS FOR ADDITIONS, WITHDRAWALS AND DEFERRALS Councilman Albaum said that he would like to add a discussion item on the Weiss-Serota Contract. Councilman Sklar said that it was his understanding that the contract would be discussed in a workshop setting. Mayor Groisman recommended that the Councilman Albaum raise the issue in the Public Comment part of the Agenda and ask the Village Manager for an update. Mayor Groisman said that he would be deferring the discussion item on term limits (R9A). PRESENTATIONS AND AWARDS PA1 Fire Chief Presentation Alan Cominsky, Miami -Dade County Fire Chief provided a presentation of the 2020 Annual Service Delivery for Bal Harbour Village providing an overview of his department and highlighting that in 2020 the Village had a total of 259 life threatening incidents with an average response time of 6:16 minutes and in 2021 to date there had been 38 life threatening incidents with an average response time of 7.31 minutes. He added that he had received positive reviews from Village customers through feedback surveys. Mayor Groisman acknowledged the positive experiences with Miami -Dade County Fire and Rescue of friends and family members commending the Department's cooperative relationship with Hatzalah. PA2 GFOA Presentation Mr. Gonzalez introduced Agenda Items PA2, PA3 and R7A as companion items suggesting that they be heard together. He then introduced Bob Feldman and Anil Harris from RSM. Mr. Feldman presented the Certificate of Achievement Excellence in Financial Reporting say that this was the 6th consecutive year that the Village had received this award. PA3 Proclamation Government Finance Workers Week Mayor Groisman presented this proclamation at 7:02 PM following the discussion of Agenda Item R7A. R5 - ORDINANCES R5A AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA; AMENDING CHAPTER 18 "TAXATION AND FINANCE," ARTICLE V, "SPECIAL ASSESSMENTS," AND CHAPTER 2, "ADMINISTRATION," ARTICLE IX, "ASSESSMENTS," OF THE CODE OF ORDINANCES, TO REMOVE THE CITY'S REQUIREMENT TO PROVIDE PUBLICATION OF NOTICE IN A NEWSPAPER OF GENERAL CIRCULATION AND NOTICE OF ANNUAL ASSESSMENTS BY U.S. MAIL, AND TO RELY SOLELY ON THE STATUTORY NOTICE PROVISIONS REQUIRED BY THE "UNIFORM METHOD OF COLLECTION" AS PROVIDED IN SECTION 197.3632, FLORIDA STATUTES; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, CONFLICTS, AND FOR AN EFFECTIVE DATE. Mr. Gonzalez introduced the item saying that this ordinance would bring the Village Code in line with State of Florida notice requirements. There were no comments from the public. Bal Harbour Village Council Regular Meeting Minutes — March 16, 2021 Pa g e 13 R5B AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA, AMENDING CHAPTER 10 "MARINE STRUCTURES, ACTIVITIES, AND WAYS," OF THE VILLAGE'S CODE OF ORDINANCES TO CREATE ARTICLE I II "BEACH EQUIPMENT"; PROVIDING FOR SEVERABILITY, CONFLICTS, AND FOR AN EFFECTIVE DATE. Mr. Gonzalez introduced the item saying that first reading the Council had requested exploring opportunities for properties with less than a 300 foot beach front, and the inclusion of a security deposit, for which he would be recommending a $2,000 security deposit. Councilman Sklar thanked Assistant Mayor Salver for suggesting a deposit saying that it was a good idea. He said that he had walked the beach a said that he did not think the beach would look overcrowded with beach huts on each property, regardless of the size of the beach front. He said that he would be in favor of one beach hut per property as long as they were spaced 200 feet apart and met the design standards. Assistant Mayor Salver said that he liked the idea that Councilman Sklar had presented. He asked Mr. Gonzalez if there was a plan for the placement of chairs and storage boxes, to which Mr. Gonzalez that he would be developing guideline to present to the Council. Councilman Freimark and Council Albaum also agreed with the idea one hut per building. Mayor Groisman suggested amending Section E of the resolution by changing the wording from "a beach hut" to "one beach hut" and to delete the second sentence and delete the part that says "at least 300 feet", with the size being up to 8 feet width and 10 feet height. MOTION: A Motion to amend the Resolution with the above suggested changes to Section E was moved by Mayor Gabriel Groisman and seconded by Assistant Mayor Seth Salver. Lauren Koplowitz (177 Bal Cross Drive) asked if there would be a future opportunity for west side buildings and or the residential district to be able to have a beach hut, and whether or not the huts would be uniform in size and building material. Brian Mulheren (10245 Collins Avenue) commented that much of the beach was gone, and that beach raking needed to be continued. Mayor Groisman responded that this ordinance only included the east side of Collins, but the future is open. He said that by the end of this year, there should be a full renourishment of the beach. Councilman Albaum asked Mr. Gonzalez to give an update of raking of the jogging path, to which Mr. Gonzalez said that Resort Tax revenues have exceeded expectations and that resources are being applied to the jogging path and hard pack. Councilman Freimark suggested that the building managers should be informed of this ordinance to provide them the opportunity to band together and generate a price concession. R5C AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA; AMENDING CHAPTER 5, "ANIMALS," SECTION 5-5, "DOGS IN PARKS, ON BEACHES; DOGS RUNNING AT LARGE; CANINE EXCREMENT," OF THE CODE OF ORDINANCES TO ALLOW DOGS ON THE JOGGING PATH OF VILLAGE BEACHES WEST OF THE SAND DUNES; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, CONFLICTS, AND FOR AN EFFECTIVE DATE. Mayor Groisman announce that he had received a petition of signatures from Brian Mulheren with dozens of residents opposed to this ordinance, which he said had totally changed his mind. Mr. Gonzalez introduced the item stating that at the last meeting, allowing dogs to be walked on the jogging path had been considered to relieve congestion resulting from the increased activity on the jogging path. He said that he had received an email from Raj Singh expressing opposition and the copies of the petition had been provided to the Council. Councilman Sklar acknowledged the efforts of Mr. Mulheren and said that this would be the first step in easing some of the congestion on the hard pack, and that this is an issue of public safety, considering that the Jetty project is coming online. Assistant Mayor Salver said that he had been swayed by the petitions, but the golden standard should be that pedestrians should be able to walk on the path getting a breeze, Bal Harbour Village Council Regular Meeting Minutes — March 16, 2021 Page 1 5 in comfort and safety, with things like bicycles and dogs being secondary. He said that there should be a beach path visioning, by Council discussion or public workshop. Councilman Freimark said that he had spoken with Mr. Mulheren and members of the community and that he found the safety argument to be more compelling to keep the dogs off the path, adding that existing ordinances should be enforced. He said that he would not be supportive of this ordinance. Councilman Albaum said that he had worked on the petition with Mr. Mulheren and that he would not be supportive of the ordinance. He reiterated his support for having a (traffic) study conducted for the beach path. Councilman Sklar pointed out that most municipalities separate vehicular and pedestrian traffic which was more important that the issue of dogs. Mayor Groisman said that removing bicycle traffic would create a greater problem in that that the beach path is safer than Collins Avenue. He said that it would be an improper use of the police to be out enforcing bicycles and dog walkers. He suggest exploring a public path through the sea grapes. Councilman Sklar suggested exploring the widening of the jogging path that would alleviate fear of dogs walking on the same path. Councilman Freimark agreed that an engineering study should be considered, to which Mr. Gonzalez responded that with money and engineering anything could be done, adding that it would not be an inexpensive project. Lauren Koplowitz (177 Bal Cross Drive) suggested that a bike path could be delineated on the hard pack to separate bicycle traffic. She said that Haulover already has a dog park and a dog beach. She said people and trees come first, dogs second. Penny Sepler (10275 Collins Avenue) said that the larger path should be for everyone, adding that a bike lane would be more beneficial. She agreed that police officers should utilized for enforcement and agreed that a public workshop would be the way to proceed. Brian Mulheren (10245 Collins Avenue) said that Surfside only allows dogs on its hard pack. He said that safety is a primary concern. Mayor Groisman asked the Mr. Gonzalez if there were some type of engineer that could provide guidance to which Mr. Gonzalez said that the Village could engage a traffic engineer, that would spend money and time in getting a baseline, or the Village could reimagine the area as a new capital project. Mayor Groisman recommended exploring landscaping options to make a space where people could walk safely. Bal Harbour Village Council Regular Meeting Minutes — March 16, 2021 Page 16 Councilman Sklar said that he was surprised that there was as much opposition as there was since most people do not use the walking path. Mr. Gonzalez said that he would really like to get the Council's objectives and the purposes for any modifications or redesigns in moving forward. He added that it would be important to get a baseline. Councilman Sklar said that his end goal would be to separate pedestrian from vehicular traffic' Councilman Freimark said that given that the beach path is one of the Village's most important assets, it would be important to provide the public the opportunity for input in a workshop setting. He said that some supervision is necessary. There was a general discussion regarding whether or not the beach path improvements should be minor improvements in traffic flow or a complete redesign to enhance projects at the Jetty and 96th Street. Mr. Gonzalez suggested bringing the discussion to the Council Retreat where he can bring ideas for different options and costs. Bal Harbour Village Council Regular Meeting Minutes — March 16, 2021 Pa g e 17 R5D AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA; AMENDING CHAPTER 5, "ANIMALS," SECTION 5-7, "CONTROL OF DOGS," OF THE CODE OF ORDINANCES TO REQUIRE FASTENING OF DOGS ON THE JOGGING PATH AND AREA OF HARDPACK SAND ON VILLAGE BEACHES WEST OF THE SAND DUNES TO NON -RETRACTABLE LEASHES THAT DO NOT EXCEED SIX FEET IN LENGTH; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, CONFLICTS, AND FOR AN EFFECTIVE DATE. Mr. Gonzalez introduced the item saying that this focuses on the beach front area limiting dog leashes to six feet in length and prohibiting retractable leashes, adding that there would be an inconsistency with regulations for the rest of the Village. MOTION: A Motion to amend the ordinance to encompass all of Bal Harbour except the Gated Community was moved by Councilman Buzzy Sklar and seconded by Assistant Mayor Seth Salver. VOTE: The Motion passed by unanimous voice vote (5-0). Penny Sepler (10275 Collins Avenue) commented that enforcement would be difficult in the same way that enforcing people to pick up their dog's waste. Brian Mulheren (10245 Collins Avenue) said that the ordinance should just say - no retractable leashes. Councilman Freimark said that he was supportive of the ordinance but was not supportive of a police state, saying that signage should be adequate. Mayor Groisman said that he would not be in favor of passing an ordinance that would not be enforced. Assistant Mayor Salver said that it is important to notify the community before the ordinance takes effect. MOTION: A Motion to amend the ordinance to provide a written warning for the first violation was moved by Mayor Gabriel Groisman and seconded by Councilman Buzzy Sklar. VOTE: The Motion passed by unanimous voice vote (5-0). Assistant Mayor Salver suggested offering residents a Bal Harbour Branded leash. R5E AN ORDINANCE OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; AMENDING CHAPTER 21 "ZONING" OF THE CODE OF ORDINANCES, BY AMENDING SECTION 21-358 "WALLS, FENCES AND LANDSCAPE PLANTINGS" TO DEFINE AND REGULATE PERIMETER WALLS AND FENCES SURROUNDING THE GATED RESIDENTIAL SECTION OF THE VILLAGE; PROVIDING FOR INCLUSION IN THE CODE, CONFLICTS, AND FOR AN EFFECTIVE DATE. Mr. Gonzalez introduced the item saying this ordinance creates a maximum height often - feet for the perimeter wall that separates the buildings on the west side of Collins and the Gated Community, to enhance security. Mayor Groisman asked the Village Attorney to ensure, before second reading, that the twenty -foot wall separating the Bal Harbour Shops from the Gated Community would not be in violation. Lauren Koplowitz (177 Bal Cross Drive) asked for clarification of the boundary at the new park, to which Mr. Gonzalez said that a ten -foot wall is planned to be constructed. Bal Harbour Village Council Regular Meeting Minutes — March 16, 2021 Pa g e 1 9 R7 - RESOLUTIONS R7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; ACCEPTING THE COMPREHENSIVE ANNUAL FINANCIAL REPORT FOR THE FISCAL YEAR ENDED SEPTEMBER 30, 2020, RELATING TO THE ANNUAL AUDIT PERFORMED BY THE VILLAGE'S INDEPENDENT AUDITOR, RSM US LLP; PROVIDING FOR AN EFFECTIVE DATE. This item was heard at 6:55 PM following Agenda Item PA2. Mr. Anil Harris (RSM) presented highlights of the Comprehensive Annual Financial Report saying that the audit opinion was clean/unmodified. He pointed out a $20 million contribution on the income statement stemming from the Bal Harbour Shops Development Agreement, $31.3 million in total assets on the balance sheet with a net position of 29.8 million and $14 million unassigned and a $2 million increase in fund balance. He said that there were no findings with the controls that were in place, and that they were operating properly. Councilman Freimark asked if there were any adjusting to which Mr. Harris responded that there were not. Mr. Feldman commended Mr. Gonzalez, Claudia Dixon and the Finance group for doing a tremendous job adding that all information was readily available. Mr. Gonzalez and Councilman Sklar also thanked Ms. Dixon and the Finance team. MOTION: A Motion to pass the Resolution was moved by Assistant Mayor Seth Salver and seconded by Councilman David Albaum. VOTE: The Motion passed by unanimous voice vote (5-0). Mr. Harris provided highlights of the required communication to the Council stating that the audit resulted in an unmodified clean opinion and that there were no significant issues or transactions. He said the audit team had access to all records and that there were no new recommendations. He described the significant estimates that were required to put the financial statements together adding that the assumptions and methods used were reasonable and can be relied upon. R7B A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; ADOPTING THE BEACH EQUIPMENT PERMIT APPLICATION FEE; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR AN EFFECTIVE DATE. Mr. Gonzalez introduced the item saying that this was a companion item for the beach hut ordinance that establishes a fee structure. R9 - NEW BUSINESS AND COUNCIL DISCUSSION R9A Discussion Regarding Term Limits - DEFERRED R9B Discussion Regarding Special Event Process - Councilman Sklar Councilman Sklar said this item was brought to his attention after a fireworks show at the St. Regis. He said that he was told the show would be on the deck, but instead it was on the beach. He really is no special event process except for fireworks and for the police department assigning an off -duty officer. Mr. Gonzalez explained that the two types of events monitored by the Village are fireworks and beach access permit events, like weddings. He agreed that there ought to be a document that details what is approved for the requested evert. Councilman Freimark added the consideration of a certificate of insurance where necessary. There was a general consensus from the Council to provide direction to the Village Manager to formalize the process. R9C Discussion Regarding Procedure/Policy for Honorific Namings (Streets, Paths) - Councilman Freimark R9D Discussion Regarding Procedure for Namings at Founders Circle - Councilman Freimark R9E Discussion Regarding Potential Funded Naming Opportunities to Support Expenditures (New Park, Jetty) - Councilman Freimark Councilman Freimark introduced Items R9C, R9D and R9E together saying that he wanted to see if a process could be developed for the honorific naming of streets, and names at Founders' Circle saying that he sees funding and opportunities and sponsorships in the ongoing projects for the Park and the Jetty. Bal Harbour Village Council Regular Meeting Minutes — March 16, 2021 P a g e 1 11 Councilman Sklar said that revenue is not as important as having the opportunity to be a part of the community. Mr. Gonzalez described his experience from Miami -Beach, saying that major namings for facilities were done through referendum. He said the County has a program to name streets for fallen officers. He said the streets in Bal Harbour are State-owned streets, except for the streets in the Gated Community. He added that sponsorships opportunities could be considered for the Jetty and that the Founders' Circle could be considered for other possibilities. Mayor Groisman suggested that a proposed process should be done by ordinance and that naming would be for deceased persons. He said he was in favor of a referendum to name facilities. Assistant Mayor Salver said that he was interested to hear what other municipalities are doing but would be cautious of cheapening the Bal Harbour Brand. Councilman Albaum suggested added the topic to the May Council Retreat, to which there was a general consensus from the Council R9F Discussion Regarding 75th Anniversary Celebration - Village Manager Mr. Gonzalez introduced the item. Ramiro Inguanzo, Assistant Village Manager and Trip Barrett, Chief Marketing Officer and Director of Tourism gave a presentation, with suggestions from the Resort Tax Committee, highlighting a historical overview of past anniversary celebrations and listing the proposed events for 2020, including a ribbon cutting the at the Operations Facility, a groundbreaking for the Waterfront Park, a Time Capsule in the Waterfront Park, and a Fourth of July Celebration. They presented a choice of four 75th Anniversary Logos, to which there was a general consensus to choose the first logo, which was also the choice of the Resort Tax Committee. They then presented the Village -wide activation of Fleurs de Villes, for which the Council agreed that the expenditure of $20,000 in Resort Tax dollars was appropriate. R9G - PUBLIC COMMENT Penny Sepler (10275 Collins Avenue) asked when the Village Council meetings would be open for the public to attend, to which Mr. Gonzalez responded that the next meet would be conducted virtually for the public, but that he was looking into opening up in the near future. She asked for the status of the Ethan Gordon case, to which Mayor Groisman responded that the status was the same. She then commented that she was not in favor of naming facilities but did like the idea of pavers and the like. Bal Harbour Village Council Regular Meeting Minutes — March 16, 2021 Page 1 12 Brian Mulheren (10245 Collins Avenue) also commented that the cases involving the two young men killed in Bal Harbour and Sunny Isles were unbelievably slow adding that speeding on Collins Avenue continued to be a problem. Councilman David Albaum and Councilman Buzzy Sklar both commented Chief Raleigh Flowers and the Police Department for increased traffic enforcement. Mayor Groisman added that it was aggravating that traffic homicides get assigned to the County. He suggested having a resolution at the next meeting urging the County to step up speeding enforcement in Haulover.
