Bal Harbour Village Council Regular Council Meeting Minutes May 25, 2021 At 6:30 PM Bal Harbour Village Hall • 655 - 96th Street • Bal Harbour • Florida 33154 On March 13, 2020, Village Manager Jorge Gonzalez declared a State of Emergency for Bal Harbour Village due to the Coronavirus (COVID-19) pandemic. This meeting was conducted in -person and virtually via "Zoom" in order to minimize exposure to Councilmembers and members of the public. The meeting was also broadcast on the Village's website (www.balharbourfl.gov) and members of the public were encouraged to participate by email (meetings@balharbourfl.gov) or by telephone at 305-865-6449. CALL TO ORDER/ PLEDGE OF ALLEGIANCE Mayor Groisman called the meeting to order at 7:10 P.M. following the General Employees' Retirement Board Meeting. The following were present: Mayor Gabriel Groisman Assistant Mayor Seth Salver Councilman David Albaum Councilman Jeffrey Freimark Councilman Buzzy Sklar Also present: Jorge M. Gonzalez, Village Manager Dwight S. Danie, Village Clerk Robert Meyers, Deputy Village Attorney The Pledge of Allegiance was led by Mayor Groisman REQUESTS FOR ADDITIONS, WITHDRAWALS AND DEFERRALS There were no requests for withdrawals or deferrals. Mayor Groisman thanked the Bal Harbour Police Department for their response to an incident where visitors from New Jersey were harassed, and said that we was wearing a kippah to show respect and to set an example that no one needs to be afraid to show their religion in a time when anti-Semitism is prominent. Chief Raleigh Flowers, thanked the Council for his Department having access to the best technology that helped in this investigation. PRESENTATIONS AND AWARDS PA1 Police Annual Report Chief Flowers provide an overview of crime statistics for the calendar year 2020 highlighting that Bal Harbour remains one of the safest places to live in Miami -Dade County. He showed a continuing decrease in Part 1 property crimes and an increase in clearance rates. He explained that community policing and community outreach continued to be cornerstones of the Bal Harbour Police Department philosophy. Chief Flowers described activities that positioned the Department as regional leaders in policing, crime prevention and proactive training. He then described the addition to staffing, including three reserved officers and the Beach Safety Officer, the Department's Employee Recognition program, and the encouragement of officer training and career development. Council members thanked Chief Flowers for his leadership, approach and philosophy that make Bal Harbour a safer place to live, being well -represented in Miami -Dade County. PA2 Community Service Award - Police Department Chief flowers presented Raj Singh with the Community Service Award, saying that Mr. Singh was a strong and passionate supporter of the Bal Harbour Village and the Police Department. Mr. Singh, thanked Chief Flowers and the Council, adding that he has lived in the community for thirty-three years and that the Department's Community Policing program is greatly appreciated. Bal Harbour Village Council Regular Meeting Minutes — May 25, 2021 Pa g e 1 3 R5 - ORDINANCES R5A AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA, AMENDING CHAPTER 8 "ELECTIONS" OF THE VILLAGE'S CODE OF ORDINANCES DEFINING PROCEDURES FOR CHARTER CHANGES BY THE VILLAGE COUNCIL AND CHARTER CHANGES BY PETITION OF ELECTORS; PROVIDING FOR CODIFICATION, SEVERABILITY, CONFLICTS, AND FOR AN EFFECTIVE DATE. Mr. Gonzalez described the item before the Council on second reading. He said that this ordinance would align the procedures for a petition for a Charter amendment with the procedures for Referendum and Initiative petitions. In responding to the Council's request to research if there could be a cooling off period after a failed referendum, Mr. Meyers said that there was nothing in the law to prevent a person from petitioning their government, adding that since the signatures could not be reused, and new petition process would need to be initiated, there would natural gap in time. Mr. Gonzalez said that, at the Council's request, the language in Section 18-13.3(c) regarding the duty for the Council to act at its next regular meeting after the certification of the petition, was added to Section 18-13.4(a) to clarify any ambiguities. There were no comments from the public. MOTION: A Motion to pass the Ordinance on Second reading was moved by Assistant Mayor Seth Salver and seconded by Councilman David Albaum. Bal Harbour Village Council Regular Meeting Minutes — May 25, 2021 Page 14 R7 - RESOLUTIONS R7A A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, AUTHORIZING THE USE OF THE TITLE OF VICE MAYOR TO HAVE THE SAME MEANING AS ASSISTANT MAYOR FOR ALL PURPOSES; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR AN EFFECTIVE DATE. Assistant Mayor Salver said that he would have brought this issue to the Council four and a half years ago, if he knew how easy is would have been, saying said that during that time he had received many phone calls regarding the Mayor's schedule. He said that new title would distinguish the position, not only for him, but for all future Vice Mayors, from an assistant to the Mayor, to Vice Mayor, Vice Mayor being more commonly used in the State of Florida. There were no comments from the public. MOTION: A Motion to pass the Resolution was moved by Assistant Mayor Seth Salver and seconded by Mayor Gabriel Groisman. VOTE: The Motion passed by unanimous voice vote (5-0). Vice Mayor Salver thanked the Council members for their consideration. R9 - NEW BUSINESS AND COUNCIL DISCUSSION R9A - PUBLIC COMMENT Penny Sepler (10275 Collins Avenue) asked if there had been any update on Ethan Gordon, to which Mayor Groisman said that he and Chief Flowers have been in contact with State Attorney's Office and Miami -Dade County, who run the traffic homicide investigations for the Village, and that they were expecting movement soon regarding the case. R10 - VILLAGE MANAGER REPORT R1 OA Update on Village's Efforts Pertaining to the Coronavirus (COVID-19 Mr. Gonzalez reported that immunizations rates were up and positivity rates were down, and that a sense of normalcy was occurring. Bal Harbour Village Council Regular Meeting Minutes — May 25, 2021 Page 1 5 He then provided an update on the FDOT lighting illumination enhancement program and the pedestrian crossing at the Oceana, saying that the Village's contractor will be following up at the end of the project to replace the what is needed to meet the standards of Bal Harbour Village. Mayor Groisman asked if there had been an update on the study/audit of the pedestrian crossing where Ethan Gordon was killed, to which Chief Flowers responded the last that he had heard were recommendations for additional signage, a modification of landscaping, a speed bump, or raising the crosswalk.
