CALL TO ORDER Mayor Man called the City Council Regular Meeting to order at 7:45 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 1. ROLL CALL PRESENT: Councilmember — Sternquist, Vizcarra, Yu, Chavez, Man ABSENT: Councilmember — None ALSO PRESENT: City Manager Cook, City Attorney Murphy, City Clerk Kuo, Administrative Services Director Paragas, and Public Safety Supervisor Ariizumi 0.4 3. INVOCATION — Pastor Kelty provided the invocation. 4. PLEDGE OF ALLEGIANCE — City Manager Cook lead the pledge of allegiance. 5. CEREMONIAL MATTERS — PRESENTATION A. RECOGNITION OF TEMPLE CITY HIGH SCHOOL SKILLS USA City Council recognized students of Temple City High School Skills USA for winning the California State Championship two years in a row. Temple City's health knowledge team is the third best in the country for Health Knowledge Bowl. Mayor Man and City Council presented the students with a certificate. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA — None 7. CONSENT CALENDAR Administrative Services Director Paragas requested City Council's consideration to correct a typo on the special check serial number for Consent Calendar Item 7D. The special check numbers should be 60792-60796 instead of 60792-60793. Mayor Pro Tem Chavez made a motion to approve the Consent Calendar Items with correction to Consent Calendar Item 7D. APPROVAL OF MINUTES The City Council is requested to review and approve: 1. The Minutes of the Special City Council Meeting of August 1, 2023; and 2. The Minutes of the Regular City Council Meeting of August 1, 2023. Action: Approved the Minutes of the City Council Meetings. B. PLANNING COMMISSION MEETING ACTIONS The City Council is requested to receive and file the actions of the Regular Planning Commission Meeting of July 25, 2023. Action: Received and filed the Planning Commission regular meeting actions of July 25, 2023. C. TRANSPORTATION AND PUBLIC SAFETY COMMISSION MEETING ACTIONS The City Council is requested to receive and file the actions of the Regular Transportation and Public Safety Commission Meeting of July 12, 2023. Action: Received and filed the Transportation and Public Safety Commission regular meeting actions of July 12, 2023. D. ADOPTION OF RESOLUTION NO. 23-5695 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2022-23 The City Council is requested to adopt Resolution No. 23-5695 authorizing the payment of bills. Action: Adopted Resolution No. 23-5695 authorizing the payment of bills. E. ADOPTION OF RESOLUTION NO. 23-5696 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2023-24 The City Council is requested to adopt Resolution No. 23-5696 authorizing the payment of bills for fiscal year 2023-24. UNFINISHED BUSINESS — None 10. NEW BUSINESS A. INTRODUCTION OF ORDINANCE NO. 23-1073 AMENDING SECTION 2-1-2 OF THE TEMPLE CITY MUNICIPAL CODE PERTAINING TO CITY COUNCIL COMPENSATION IN LIGHT OF SENATE BILL 329 The Governor signed Senate Bill 329 ("SB 329") in June which allows cities a one- time chance to "reset" city council salaries to take into account inflation, the work done by local government officials, and the need to ensure that people are not discouraged from seeking city office due to the low pay and high demands of that office. City Manager Cook gave a brief summary of the previous discussion regarding SB 329. NEM City Council asked questions and made comments regarding the proposed ordinance. Mayor Man opened public comment. Hearing no request to speak, Mayor Man closed public comments. Councilmember Yu made a motion to: 1. Introduce for first reading by title only and waive further reading of Ordinance No. 23-1073, amending Title 2, Chapter 1, Section 2-1-2 "Expenses' and Compensation" of the Temple City Municipal Code; and 2. Schedule the second reading of Ordinance No. 23-1073 for September 5, 2023. Seconded by Mayor Pro Tem Chavez and approved by the following votes: AYES: Councilmember — Sternquist, Vizcarra, Yu, Chavez, Man NOES: Councilmember — None ABSTAINED: Councilmember — None 0.4 ABSENT: Councilmember — None City Clerk Kuo read the title of Ordinance No. 23-1073. EMPLOYER MEDICAL HEALTH BENEFIT CONTRIBUTION AMOUNT TO THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT (PEMHCA) MINIMUM AND HEALTH BENEFIT AMOUNTS TO EMPLOYEES, RETIREES AND COUNCILMEMBERS City Council is requested to consider establishing tiers of City healthcare contribution levels for active full-time city employees, Council, and retired annuitants to control the City's future other post -employment benefits. City Manager Cook gave a brief overview of the proposed tiers of City healthcare contribution levels for active full-time city employees, Council, and retired annuitants to control the City's future other post -employment benefits. Administrative Services Director Paragas gave a summary of the staff report. City Council made comments and asked questions regarding the proposed changes to City's healthcare contribution levels for active full-time city employees, Council, and retired annuitants to control the City's future other post -employment benefits. Mayor Pro Tem Chavez made a motion to: 1. Adopt Resolution No. 23-5690 (Attachment "B"), fixing the City's contribution under PEMHCA for employees and retired annuitants to the PEMHCA minimum effective October 1, 2023; 2. Adopt Resolution No. 23-5691 (Attachment "C"), rescinding Resolution No. 78- 1747 (Attachment "A"), the current resolution with the California Public Employees' Retirement System (CaIPERS) regarding the participation of the City of Temple City (City) and stating its contributions to CaIPERS' medical healthcare insurance program, effective October 1, 2023; 3. Adopt Resolution No. 23-5692 (Attachment "D"), establishing the side letter agreement between the City and the Temple City Employee Association (TCEA) employee group regarding revisions to health benefits effective October 1, 2023 with change to Exhibit B, Section 5.7 Retiree Health Insurance, paragraph "B" Hire Date on or after October 1, 2023 of the side letter, to state that "Employee must be employed full-time with the City for a total of five years consecutively to receive the following retiree health benefits...". Adopt Resolution No. 23-5693 (Attachment "E"), revising the City's health benefit contributions for full-time non -represented employees effective October 1, 2023 with clarification that employees hired on or after October 1, 2023 must stay employed with the City for 5 years consecutively to be vested for health benefits after retirement; 5. Adopt Resolution No. 23-5694 (Attachment "F"), revising the City's health benefit contributions for Council members effective October 1, 2023, with clarification that Councilmember elected after October 1, 2023 must serve 5 consecutive years (either via election to two terms or service of a partial term and then elected to a term) to be vested for health benefits after retirement. Seconded by Councilmember Vizcarra and approved by the following votes: AYES: Councilmember — Sternquist, Vizcarra, Yu, Chavez, Man NOES: Councilmember — None ABSTAINED: Councilmember — None ABSENT: Councilmember — None C. ILLEGAL FIREWORKS ENFORCEMENT MIMI The City Council is requested to have a discussion regarding the enforcement of illegal fireworks. City Manager Cook gave a brief overview of current enforcement procedures for discharge of illegal fireworks. Public Safety Supervisor Ariizumi gave a summary of the staff report. City Council made comments and asked questions regarding suppressing and enforcing the use of illegal fireworks. Councilmember Vizcarra left the meeting at 9:28 p.m. and returned at 9:30 p.m. Mayor Man opened public comment. Jerry Jambazian, Temple City business owner, spoke in favor of the city creating an illegal firework hotline. Hearing no further request to speak, Mayor Man closed public comment. e..., City Council made final comments regarding the City's efforts in suppressing and enforcing the use of illegal fireworks. City Council directed staff to bring this item back for ongoing discussion regarding suppression of illegal fireworks. City Council Minutes August 15, 2023 Page 6 of 8 11. UPDATE FROM CITY MANAGER — Shared that during Closed Session, City Council has been discussing potential litigation regarding a code enforcement matter. The City Council authorized the City Manager to negotiate and execute a purchase and sales agreement for the city after the previous Closed Session meeting, to purchase a property in lieu of proceeding with civil litigation. He reported that as of yesterday, the purchase and sales agreement was signed by the property owner and the city. The city is now moving through with escrow and is authorized to give the name and address of the property. The property is located at 5003 Sereno Drive and owned by Ms. Mary Dahbour. This purchase and sales agreement is now a public record and is accessible through the City Clerk's office. He will report back to Council when escrow closes and when city begins remediation of the code enforcement violations of this property. 12. UPDATE FROM CITY ATTORNEY — no report. 13. PLAYGROUND RENOVATION AD HOC COMMITTEE (Councilmember Sternquist and Mayor Man) — Formed 7/11/23 Mayor Man reported on the ad hoc committee's meeting with SWA Landscape Architect. The ad hoc committee reviewed the updated designs for the playgrounds. The final designs will be brought back to City Council for consideration and approval in September. „„ 14. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER STERNQUIST — encouraged the public to support the relay for life booth at the Concerts in the Park. B. MAYOR MAN — Congratulated Captain Meza for assuming his new role as Captain for the Temple Sheriff Station, invited everyone to attend the last Concerts in the Park tomorrow night, and announced next week's Neighborhood Watch. 15. RECESS TO SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY DEVELOPMENT AGENCY MEETING At 10:12 p.m., the City Council recessed to the Successor Agency Meeting.
