March 12, 1946 The regular meeting of Town Council was held today at 4 p.m. and was attended by Chairman of Council, Slotin, who presided and Councilmen Brown, Young,Hosti, Peters and Lovell. A Committee of the Tybee Community Club protested: 1- The closing of the ditch which is causing water to back up and flood part of the area in Fort Screven, causing consider- able inconvenience to a number of the residents. Mr. Alexander stated that the Tybee Beach Co. closed the ditch on the property which causes the water to back up on Fort Screven. They were requested not to do so, They are liable. 2- Requested that paid firemen be employed and also pro- tested the bad condition of the fire- fighting equipment and requested that additional fire plugs be installed, Councilman Brown asked if one of the policemen could not run the truck in place of using the Police car and suggested that if Mr. Reed checked the equipment once or twice a week would that be agreeable, the Committee agreed to this. 3- Had heard rumors that A Whiskey license was to be transferred to a place operated by John Williams just outside the old Fort Screven area, they were opposed to it at this location or any' other location that would be operated by negroes and requested that the application be turned down. 4- Dr. Tarawell stated that in connection with Beach pro- tection that he was informed that the Coast Guard would repair the area in front of their property He asked what plans the Town has toward replacing the sea -wall, Councilman Slotin informed him that Congress- man Preston was working on it. The Committee was excused. A Committee from the Volunteer Fire Department requested the Town to take out a blanket policy to cover all of the Volunteer firemen, the cost would be about $200 per year, after some discus- sion the Committee was informed that Council would consider the mat- ter, after which the Committee was excused. Councilman Slotin stated that the Assessment Committee had met with the Fort Screven Development Co. and they had agreed that 1948 assessments be increased to $100,000 on the same terms as before. They to report sales twice a year. Councilman peters moved that it be approved, Councilman Brown seconded and the motion passed. official adopted, Mr. S. P. Keyhoe, Civil Engineer wants to make a new map of the Town. No action was taken at this time. Councilman Young moved that the following resolution be Councilman Hosti seconded and the motion passed. A RESOLUTION WHEREAS, on June 17, 1947, the Mayor and Councilmen of Savannah Beach, Tybee Island, entered into a contract with Chatham Construction and Equipment Company, contractors, for the construction of a temporary groin on the Strand between 16th and ,17th Streets, and a permanent groin on the Strand near its intersection with lst Street in the said Town of Savannah Beach; 143 AND, WHEREAS, said contract has been completed and Thomas and Hutton, engineers, representing said municipality in supervis- ing the performance of said contract, have reported to the Mayor and Councilmen that said work has been completed in accordance with said contract, giving -the number of feet of groin construaned, and listing certain material turned over by said contractors is said municipality, and the value thereof; BE IT THEREFORE RESOLVED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, that said work be, and the same is hereby, accepted as being in accordance with the plans and specifications, and the work as having been done in accord- ance with said contract. BE IT FURTHER RESOLVED that the Clerk of Council of said town be, and he is hereby, directed to pay to Chatham Construction and Equipment Company, contractors, the sum of $2,901.62, as pay - ment in full of the amount due under said contract. Councilmen Slotin stated that in an endeavor to held down expenses, that no purchase over $10.00 should be made except approved by the Chairman of Committee of the department making the purchase. Councilman Peters moved that bills for the month of Feb - ruary amounting-to *1539.25 be approved, Councilman Young seconded and the motion passed. The petition to transfer the Whishey license from J. B. Wolfson to T. B. MoCarroll was denied as the application did not show to what location the transfer was to be made. A petition was received from the Savannah Beach Chamber of Commerce requesting additional funds, was upon motion of Coun- cilman peters and seconded by Councilman Young, was received as in- formation. P. J. Dieppe petitioned having a reduction in the assess- ments on Lot 34, Horsepen Hammock, Fort Ward, Councilman young moved that the petition be denied, Councilman Peters seconded and the motion passed. Miss Ola Wyeth requested the Town to pave a portion of an easement adjacent to her property, Sec. 7, Lots 19 -20, Ward 1, request denied. A letter was read from the Tybee Water Works requesting that they be paid $30 for water service inthe Public Park other than that furnished for watering shrubs, etc. Referred to Council- man Slotin. A plat of Lot 13, Ward 6, was submitted by Mrs. Jemima Dowell dividing this property, Councilman Young moved that it by approved, Councilman Brown seconded and the motion passed. Mrs. Lula S. Grimes requested that the hole on Butler Ave. adjacent to her property, Sec. 5,6, of 19 -20, Ward 1, be re- paired, it was referred to the Department of Public Works. 144 The matter of purchasing coal for use at the Convict Camp was referred to the Mayer. The matter of repairing the cash registers at parking areas was referred to Councilman Young. Councilman Hosti asked to be repaired, Councilman Young be barricaded at both ends until referred to Councilman Host/ and back at the next meeting. when the Parking areas were going stated that the parking Lot should they are repaired, the matter was young to investigate and report Councilman Biotin wanted to know what was the status of Tybrisa Pavilion, Mr. Alexander stated that E. J. Haar was to let him know. Councilman Biotin wanted to knew what the status-of the, homes that have net connected to the sewerage system. It was decided to report back at the next meeting. Town Attorney Alexander stated that the Tybee Beach Co. wants the Town to eonveyr to them part of Tilton St. from Fourth Ave., west. It was decided to hold up on this. Wm. W. Lucas requested that he be permitted tO use parts of Lots 15 and 16, Ward 4, for a Trailer park, and requested that the Zoning Ordinance be amended in order for him to d• this. Re- ferred to the Department.•f Public Works. A petition from Earl C ©pus for permission to operate an ice -cream wheel cart on the streets for the coming season was held up. Councilman Lovell moved that the License Ordinance for 1948 be adopted as fellows, Councilman Peters seconded and the motion passed. AN ORDINANCE: AN ORDINANCE TO PROVIDE FOR THE RATE OF LICENSES FOR DOING BUSINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORU GIA, FOR THE FISCAL YEAR ENDING APRIL 30th, 1949; FIXING PENALTIES FOR THE VIOLATION; AND FOR OTHER PURPOSES. SECTION 1. Be it ordained by the Mayor and Councilmen of the Town-of Savannah Beach, Tybee Island, Georgia, in Council assembled, and it is hereby ordained by the autiority•f the same,, that. the licenses for doing business in the Town of Savannah Beech, Tybee Island, Georgia, for the fiscal year ending April 3Oth, 1949, shall be payable on or before the commencing of such business and shall be as follows : - Each and every keeper of an apartment house or building, containing more than two apartments, or a tourist court or camp, each dwelling unit $3.00, with a minimum license of $ 35.00 Every keeper or keepers of a hotel or rooming house that contains ever twelve (12) rooms or less. 35.00 1 Every - Keeper or keepers of a hotel or rooming house that contains over twelve (12) rooms, each room Every owner or keeper of a riding academy, livery stable, or place where horses and ponies are kept for use by the public. $ 3.00 50.00 Each and every owner or keeper of a public bath house, each room-. .50 Each owner or keeper of a rifle range or shooting_ galleryr. 50.00 Every owner or keeper of a ball game. 25.00 Every owner, operator or lessee of a billiard or pool room. 50.00 Every keeper or owner of a bowling alley, each alley'. For transferring from one person to another, or from one location to another, any license for the sale of intoxicating liquors, or for the sale of beer, provided no transfer shall be authorized without the approval of Council. 25.00 50.00 25.00 25.00 SECTION 2. In the event any business or calling not specifically mentioned in the above list set forth shall be estab- lished in the Town of ,'Savannah Reach, Tybee Island, Georgia, the Mayor and Councilmen reserve the right to establish a license fee for same by ordinance, which fee is to be of equal dignity as the license specifically mentioned in the above Section, provided, how - ever,.tha.t such license shall not be more than the sum of Five Hun- dred Dollars ($500.00). SECTION 3. Thtsprdinance shall be subject to alterations or repeal in whole or in part at any time during the fiscal year beginning May lst, 1948, should it be deemed advisable, and no such amendment or repeal shall be construed to impair the right of Coun- cil to assess or levy tax for the whole of such year when ever made. SECTION 4. Any person, firm or corporation owning or oper- ating any riding devices, or passenger vehicles for hire, before being issued a license, therefore, shall deposit with the Clerk of Council a policy of insurance against personal injury and property damage, with a receipt showing that the premium thereon has been paid for the length of time covered by the license, in such com- pany and in such amount as may be approved by the Mayor and Coun- cilmen, for the benefit of any person or persons who may be killed or injured or sustain damage to property by reason of the operation thereof. 150 SECTION 4-A. In lieu of such policy of insurance, any person, firm or corporation owning or operating passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk of Council a surety bond in the amount of Five Thousand Dollars ($5,000.00) for each vehicle operated by said per - eon, firm or corporation, signed by a surety company acceptable to the Mayor and Councilmen of Savannah Beach, said bond guarantee- ing the payment_of any loss or damages sustained any person or per- sons by reason of the operation of such vehicle, the exact form of such bond to be approved by the Mayor and Councilmen of Savannah Beach. SECTION 5. The Mayor and Councilmen reserve the right to refuse to Issue to any one any licenses for any purpose for reasons deemed sufficient by them. SECTION 6. Any person procuring a license on or after November 1, 1948, shall pay one -half the fee therefor set forth in this Ordinance. SECTION 7. Any person, firm or corporation violating any of the provisions of Section 1. of this Ordinance shall, upon conviction before the Mayor's Court of said Town, be subject to be fined in the_sua:of not more than One Hundred Dollars ($1 00.00) or be imprisoned not more than thirty (30) days, either or both or any portion of either or both in the discretion of the Court. SECTION 8. All ordinances or parts of ordinances con- flicting with the provisions of this Ordinance are herebyrepealed. Councilman peters moved that the Budget Ordinance for 1948 be adopted, Councilman Young seconded and the motion passed. AN ORDINANCE TO ADOPT AND FIX A BUDGET'FOR SAVANNAH BEACH, TYBEE - -ISLAND, FOR THE FISCAL YEAR ENDING APRIL 3Oth, 1944, AND FOR EACH - - -AND EVERY FISCAL YEAR THEREAFTER UNTIL REPEALED BY ORDINANCE. BE IT ORDAINED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, that the attached bud- get be, and the same is hereby, adopted as the budget for said municipality for the fiscal year ending April 30th, 1948, and for each and every fiscal year thereafter until repealed or modified by ordinance. BE IT FURTHER ORDAINED that the salaries set forth in said budget shall be the salaries of the employees of said munici- pality until changed by ordinance, and shall be paid in twelve (12) equal monthly installments. BE IT FURTHER ORDAINED that no amounts shall be expend- ed in excess of the amounts allocated to each account in said bud - get, without authority from the Mayor and Councilmen. BE IT FURTHER ORDAINED that at the end of each fiscal year the amount of any appropriation for any particular account, which has not been expended, shall lapse and shall not be avail- able for the use of that particular account during the following year. 1 1 BE IT FURTHER ORDAINED that the amounts set forth after each item in said budget be, and the same are hereby, appropriated for the purposes set forth in said budget. BE IT FURTHER ORDAINED that all parts thereof,.ineonfliet herewith be, and pealed. A. Brown between Butler and. First Ave., and the cost will be about $800.00,.it was the opinion of Council that the work should be done. Councilman Slotin moved that the Town buy one drum of LARVICIDE at $1.75 per gal., Councilman Peters seconded and the motion passed.
