MOTION: A Motion to pass the Consent Agenda was moved by Assistant Mayor Seth
Salver seconded by Councilman Jeffrey Freimark.

R5 - ORDINANCES - This item was heard at 7:54 PM after the Budget Hearing resolutions.
R5A AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA, AMENDING
CHAPTER 6 "BUILDINGS AND BUILDING REGULATIONS," AT ARTICLE II "
PERMITS AND INSPECTIONS" OF THE VILLAGE'S CODE OF ORDINANCES
TO REVISE SECTION 6-42 " CONSTRUCTION ACTIVITIES IN THE SECURITY
DISTRICT OF RESIDENTIAL SECTION" TO PROVIDE FEES RELATED TO
CONSTRUCTION ACTIVITIES TO FUND ENHANCED SECURITY, ROAD,
AND OTHER IMPROVEMENTS RELATED TO CONSTRUCTION ACTIVITIES;
PROVIDING FOR CODIFICATION, SEVERABILITY, CONFLICTS, AND FOR
AN EFFECTIVE DATE. (First Reading)
Mr. Gonzalez introduced the item saying that the Civic Association had requested that the
Village re -institute a 0.5% fee on construction activities in the Security District fee to cover
impacts associated with construction.
There were no comments from the public.
Councilman Sklar said that he hated over-feeing and that this could be applied to any
construction on any building.
Councilman Freimark said that his building association did charge a fee, to which
Councilman Sklar suggested that the Civic Association should collect the fee.
MOTION: A Motion to pass the Ordinance, on first reading, was moved by Assistant
Mayor Seth Salver and seconded by Councilman David Albaum.

FIRST BUDGET HEARING
These items were considered at 7:02 PM at the beginning of the meeting. The Village Clerk
read the titles of Budget Agenda Items R7A and R7B into the record. Mr. Gonzalez then
introduced the items saying that the Budget is set on the established vision, mission and
values for the Bal Harbour Experience, which strive for a beautiful environment, an
unmatched destination, exclusivity and access to amenities, and safety.
Mr. Gonzalez presented highlights of the proposed Budget, recommending keeping the
current millage as it has been for the last several years (1.9654 mils), the third lowest in
Miami -Dade County. He provided a summary of the Budget revenues by the four funds
(General, Resort Tax, Water/Wastewater and Security/Landscaping), highlighting the
dollars now being received as a result of the development agreement with the Bal Harbour
Shops. He then summarized the proposed expenditures, highlighting the increase in
capital projects expenditures including the Waterfront Park, the Jetty and utility
improvements, and proposed enhancements. Mr. Gonzalez then read the State -required
budget statement
Jose Biton (168 Park Drive), Chair of the Budget Advisory Committee, briefly described the
actions of his Committee and acknowledged the staff efforts. Mayor Groisman thanked
Mr. Biton and the other members of the Budget Committee, Don Jacobs, Neca Logan, Raj
Singh and Raymond Slate.
R7 - BUDGET RESOLUTIONS
R7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE,
FLORIDA; ADOPTING THE PROPOSED MILLAGE RATE OF THE VILLAGE
FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2019 THROUGH
SEPTEMBER 30, 2020, PURSUANT TO SECTION 200.065, FLORIDA
STATUTES
There were no comments from the public.
MOTION: A Motion to pass the Resolution was moved by Assistant Mayor Seth Salver
and seconded by Councilman Buzzy Sklar.

R713 A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR, VILLAGE,
FLORIDA, APPROVING AND ADOPTING THE TENTATIVE BUDGET AND
CAPITAL IMPROVEMENT PLAN FOR BAL HARBOUR VILLAGE FOR FISCAL
YEAR 2019-20

Holly Sanders Looby (220 Bal Bay Drive) asked the what percentage of the Budget related
to the Civic Association, to which Mr. Gonzalez clarified that the Village collected and
administered security and landscape assessments, which would be further discussed in
Agenda Item R7D, and that the Civic Association had a separate budget, to which the
Village was not privy.
MOTION: A Motion to pass the Resolution was moved by Mayor Gabriel Groisman and
seconded by Councilman Buzzy Sklar.

RX A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE
COLLECTION AND DISPOSAL OF SOLID WASTE AND RECYCLABLE
MATERIALS IN BAL HARBOUR VILLAGE, FLORIDA; DESCRIBING THE
METHOD OF ASSESSING SOLID WASTE COSTS AGAINST ASSESSED
PROPERTY LOCATED WITHIN BAL HARBOUR VILLAGE, FLORIDA;
DETERMINING THE SOLID WASTE COST AND THE INITIAL SOLID WASTE
SERVICE ASSESSMENTS; DIRECTING THE PREPARATION OF AN
ASSESSMENT ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING
THE PROVISION OF NOTICE THEREOF; AND PROVIDING AN EFFECTIVE
DATE.
Mr. Gonzalez described the item saying that there was an entitled CPI increase this year of
2.2% that accounted for the increase for multi -family dwellings to $229.68 per unit and
$490.89 for single-family households. He noted that Miami -Dade County needed to send
a corrected TRIM notice, due to their own mistake in calculations.
Babak Raheb (128 Balfour Drive) commented that it was not fair that smaller residences
paid the same assessment as larger residences that generate more waste, and suggested
basing the assessment on square footage.

R7113 A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE
PROVISION OF SECURITY AND LANDSCAPE SERVICES, FACILITIES AND
PROGRAMS IN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR
VILLAGE, FLORIDA; ESTABLISHING THE RATE OF ASSESSMENT; IMPOSING
SECURITY AND LANDSCAPE SERVICE ASSESSMENTS AGAINST ASSESSED

PROPERTY LOCATED WITHIN THE GATED RESIDENTIAL SECTION OF BAL
HARBOUR VILLAGE, FLORIDA; APPROVING THE ASSESSMENT ROLL;
CONFIRMING THE INITIAL ASSESSMENT RESOLUTION; AND PROVIDING
AN EFFECTIVE DATE.
Mr. Gonzalez described the item saying that members of the Gated Community had
requested a increased to a flat fee of $3,000 for each single-family unit, and $1,500 for
unimproved properties to fund a series of security enhancements.
Holly Sanders Looby (220 Bal Bay Drive) related her concern that the Civic Association
would not share their budget.
Babak Raheb (128 Balfour Drive) related his opposition thatthe Civic Association could ask
the Village for an assessment increase because of its status as a private organization. He
said that Miami -Dade County denied the creation of a special taxing district because the
streets were private and the Miami -Dade County needed to approve its existence.
Jose Biton (168 Park Drive) described the assessment collected by the Village and the Civic
Associations budget based on membership.
MOTION: A Motion to pass the Resolution was moved by Mayor Gabriel Groisman and
seconded by Councilman Buzzy Sklar.
VOTE: The Motion passed by unanimous voice vote (5-0).
R7E A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, ESTABLISHING
SANITARY SEWER AND WATER RATES FOR THE 2019-20 FISCAL YEAR;
ESTABLISHING AN EFFECTIVE DATE.
Mr. Gonzalez introduced the item saying that Miami -Dade County was decreasing their
water rate and that Miami Beach was increasing their sewer rates based on rate study.

and seconded by Councilman David Albaum.

BY THE VILLAGE FOR THE PROVISION OF SERVICES; PROVIDING FOR
CONFLICT; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR AN
EFFECTIVE DATE.

Mr. Gonzalez summarized the item saying that the rates, with the exception of water and
sewer and new Building Department fees, were generally unchanged.
There were no comments from the public.

R9 - NEW BUSINESS AND COUNCIL DISCUSSION
R9A Discussion Regarding Bal Harbour Village potentially providing funds to the
Miami -Dade County Homeless Trust
This item was considered at 7:59 PM, after Agenda Item RSA.
Councilman Albaum first complimented the Bal Harbour Village Police Department on
their policy for compassionate engagement with homeless individuals, after which
summarized the item and introduced Victoria Mallette from the Miami -Dade Homeless
Trust. Ms. Mallette described a brief history of the activities of the Trust.
Councilman Freimark asked, in regardstothe potential contribution tothe Homeless Trust,
what was the status with Miami Beach, to which Ms. Mallette responded that Miami -Beach
did not wantto have a ballot issue for having the 1 % implemented. She said that the State
would first have to amend the legislation then go back to the Miami -Dade Commission for
approval. She said that instead, they had designated a maximum of up to $1.9 million in
future years from short-term rental fees. She added that Surfside similarly offered $50,000.
Mayor Groisman proffered a recurring budget line item to fund the Homeless Trust from
the Resort Tax. Councilman Albaum added that although his was not thinking of a
recurring item, that the amount that he was considering was $50,000.
Councilman Sklar agreed that something should be done, but cautioned using public
funds to donateto charitable causes. Mayor Groisman agreed, but said that the Trust acted
more as a government in providing their services.
Councilman Freimark described his organization's efforts with affordable housing and
elderly needs, and agreed that he did not see this a supporting a charitable endeavor and
said that he was in support in that Bal Harbour was part of larger community.
Assistant Mayor Salver agreed that he was supportive of the concept.

Mayor Groisman asked that the item be brought back to the Council as a Resolution, to
which Mr. Gonzalez said that he could bring an item back to Council at the second Budget
Hearing, with initial funding from the fund balance and subsequent funding added to the
budget process.
R913 - PUBLIC COMMENT
Mel Colombo (10175 Collins Avenue) acknowledged the Bal Harbour Police Department,
and in particular, Office George Weisman, for rescuing her from being locked out on her
17th-Floor balcony. She than praised the Villages work in clearing the beach of seaweed.
Steve Greenburg (9930 Collins Avenue) agreed with the $50,000 for the Homeless Trust,
and suggested that more be done, by have the Trust contact the condo associations.
Mayor Groisman thanked the Manager, the Chief and the Department Heads for their
efforts during Hurricane Dorian. Mr. Gonzalez echoed his sentiments for the team.
