April 15, 1948 The regular meeting of town Council was held today at 4;00 P.M. and was attended by Mayor Dutton who presided and Coun- cilmen Peters, young, Brown, Lovell, Siotin and Town Attorney Alex- ander; Also Mr. Dixon of the Puritan Chemical Co. and Mr. Wm. J. Lynch. Mr. Dixon quoted D.D.T. to the Town for $3.50 per gal. Mr. Lynch stated that Espy would start on the streets to- day and that it would take about two weeks to finish the /ob, he informed Council that he did not design the streets and due to the heavy rains some of the asphalt had _washed out and that native sand was used but that this was not very good, a courser grade of sand should have been used, that there was approximately seven miles of paving and the final cost would be about $13,000, that in several instances sewer lines had been out after the asphalt was laid and that to seal these openings = the cost would be about $15.00 for each. The minutes of the meeting of March 12, were read and adopted. The Mayor stated that the Chief of Police had been instruc- ted to collect licenses promptly after May 1. It was decided that applications requesting the transfer of Whiskey licenses at the same location would be presented to the Police Committee for their handling. The Mayor informed Council that he was advised that the Coast:Guard had awarded a contract to C. J. Keys amounting to $43,000 for work on the sea wall in the Coast Guardia. area in front of the Light House. The Mayor informed Council that a. Dr. D. L. Stamer wanted to rent an office on the Island at a low rent to practice dentistry, no action was taken. Mr. Reed stated that ditching was needed in several areas and to run a line down Third Str. to Jones Ave. into the marsh would cost about $1000, Councilman Peters moved that the work be done, Coun- cilman young seconded and the motion passed. The Mayor informed Councilmen that the Town could repair the paving in the Parking areas and that it would require about 50 barrels of asphalt and also that it was necessary to purchase lum- ber to build steps leading to the beach from the walk -way. Councilman Peters moved that the necessary material be purchased and that the Dept. of Public Works do the work, Councilman Lovell seconded and the motion passed. The request of the Savannah Beach Chamber of Commerce fir additional funds was denied due to lack of funds of the Town. Cotno.ilman. Siotin moved that the Stubbing fee for the apartments being erected by J. A. Brown be made $334 instead of $434 as Mr. Brown' had agreed to hookup to two stubs instead of using 154 four. Councilman peters seconded and the motion passed. Councilman Biotin moved that the bill of Thomas & Hutton for $115 be paid out of the Groin & Sea -wall Account, Councilman peters seconded and the motion passed. Councilman Biotin moved that bills for the month of Mardi amounting to $1562.25 be paid, Councilman Peters seconded and the motion passed. Town Attorney/Alexander stated that the Lutheran Church and the Episcopal Church requested permission to hold services in the auditorium in the Town Hall, Councilman Peters moved that the permis- sion be granted, the hours to be arrived at by them, Councilman Young seconded and the motion passed. Mayor Dutton stated that on the request of Lucas Bros. for permission to operate a Trailer park at 14th St. and FirstAve., that the Committee appointed, could not agree on granting it, Councilman .Lovell moved that the request be denied, Councilman Peters seconded and the motion passed. Councilman Young moved that the request of Earl Copus to operate a bending machine on the streets to sell ice cream be denied, Councilman Lovell seconded and the motion passed. The Mayor informed Council that in connection with the petition of the Volunteer Fire Dept. for group insurance, Town Attor- ney Alexander stated that it would be all right for the Town to take it if it wanted to, Councilman Brown moved that the Town take out the group insurance for the Volunteer Firemen, the cost to be $187.50 and to be effective May 1, 1948, Councilman Peters seconded acid the motion passed. Councilman Slotin stated still heavy and conditions are not after some discussion, that in the a major expense be approved by the mittee, Councilman Lovell seconded that the bills of the Town are improving, Councilman Peters moved, future any purchase that involves Mayor and Chairman of Finance Com- and the motion passed. Councilman Slotin called attention to the dangerous condi- tion of the Tybrisa pavilion and asked if the Town would be liable, he stated that there was no watchman on duty, and asked if it would be closed to the public., Councilman Young stated that a fence would be built:around it. Town Attorney Alexander stated that the Tybrisa Company has entered suit against the Town for appreximatelr$35,000 for damage to the pavilion, that the case is now pending. Town Attorney Alexander stated that; he had a letter from Wylly 8e- Javetz, Attorneys for the Chatham paving & Construction Co. in which they requested an additional $544, it was the opinion of Council that the acts of the previous meeting took care of this matter. Councilman Young called attention to the bad condition of the two cash registers and also the high estimate submitted for reP- pairing them, it was decided to repair one at. this time and that Councilman Young handle the matter. 155 It was decided that the respirator should be checked at once to ascertain if any repairs or parts were needed. Councilman Young called attention to-some acts of vandalism that were permitted last Saturday night in the area of the Brass Rail and stated that extra policemen should be employed. Councilman Young stated that it was necessary to have some new tires for the Sewerage Dept. The Mayor informed Council that a new police car was needed, Councilman Young stated that if a new motor were put in and some ad- justments were made that a new police car would not have to be pur- chased. It was decided to charge for use of parking areas on the week -ends effective May 1, and on May 15, a daily charge would take effect. Councilman Slotin moved that on Lot 32 A -B, Ward 2 in the name of the Roman Catholic Bishop of Savannah that is to be used for a school, that taxes be cancelled, Councilman Peters seconded and the .motion passed. k request was made from Herman Diamond that a garbage can taken from his property-by the garbage truck be replaced. Council denied the request. Councilman Peters moved that the following- assessments for 1947 be reduced and that for those property owners who have already paid their taxes that they be refunded whatever difference is due them, Councilman young.- seconded and the motion passed. Zealey 329 340 3.00 Councilman Peters moved that the following ordinance be adopted, Councilman Hosti seconded and the motion passed. AN ORDINANCE AMENDING AN ORDINANCE TO FIX THE AMOUNT OF LICENSES FOR DOING BUSINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, FOR THE YEAR BEGINNING MAY 1, 1948, BY PROVIDING LICENSES FOR COIN OPERATED TELESCOPES AND FOR AMPHIBIOUS VEHICLES, COMMONLY KNOWN AS "DUCKS"; AND FOR OTHER PURPOSES. BE IT ORDAINED by the Mayor and Councilmen of Savannah Beach, 156 Tybee Island, that an ordinance adopted March 12, 1948, providing for the rate of licenses for businesses in said town for the year beginning May 1, 1948, be, and the same is hereby, amended in the following respects : - 3.. By adding to Section One of said ordinance the follow- ing language;- For each and every coin operated telescope, or telescope for the use of which a charge is made to the public; provided that such telescopes maybe operated on the streets and publie places of said town, including the strand, as authorized by the Mayor. *5.00 For each and every amphibious vehicle, commonly known; as a "Duck," or similar vehicle, for riding in which a charge is made to the public; provided that any such vehicle shall be permitted to operate only on such portions of the strand as maybe designated by the Mayor, and before the issuance of any licenses, the owner or operator-shall furnish the Municipality with an insurance policy in some companyrto be approved by the Mayor and Councilmen, in an amount to be approved by them, insuring the paymentof damages to any person or persons who may be killed or injured or suffer damage to their property by reason of the operation of such.vehicle. $25.00 Section Two That all ordinances and parts of ordinances in conflict herewith be, and the same are, hereby, repealed. Councilman Young moved that the following ordinance be adopted, Councilman Lovell seconded and the motion passed. AN ORDINANCE TO PROVIDE FOR THE TAXATION OF REAL AND PERSONAL PROPERTY IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR COMMENCING MAY lst, 1948, AND FROM YEAR TO YEAR UNTIL REPEALED; AND FOR OTHER PURPOSES. SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in Council assem- bled, and it is hereby ordained by the authority of the same, that the rate of taxation upon real estate and personal property) within the limits of the said Town of Savannah Beach, Tybee Island, Georgia, for the fiscal year commencing ay lst:, 1948, shall be TWO AND TWENTY- TWO HUNDREDTHS (2.22) PER CENT upon the assessed or returned value of same, the value of real estate improvements to be ascertained from the returns of the Committee on Assessments of said Mayor and Coun oilmen, and the valuation of personal property to be ascertained from the returns of the owners thereof, in pursuance of the scheme and plan contained in Sections One, Two, Three and Four of the Ordinance to provide for the assessment of taxable property in the Town of Savannah Beach, Tybee Island, Georgia, and the mode of valuing such property-for taxation and to carry into effect, the provisions of the Act of the General Assembly-of the State of Georgia, approved August 19, 1922, Section 21, passed in Council assembled October 13, 1922; and it is further ordained that if any person or persons shall refuse- to pay any DOUBLE TAX' assessed as above provided within thirty (30) days after same shall become due, theClerk of Council, as Ex- 1 15` Officio Treasurer of said Town, shall issue execution therefor and the further sum of One Dollar ($1.00) for costs, and the Chief of Police and Ex- Officio Tax Collector shall proceed with such ex ecution in the same manner as now provided by law in suchicases- of execution lodged with the Sheriff of Chatham County. SECTION 2. Every person who shall pay one -half (1/2) of his taxes on or before the 15th day'of May, 1948, and the bal- ance of said taxes on or before the 15th day of November, 1948, shall be entitled to a deduction of ten (10) per cent on account thereof, and the Clerk of Council and Ex- Officio Treasurer of said Town is hereby authorized to make such deduction upon receipt, of tax. The provisions of this Section -shall not apply to licenses for doing business in said Town, the rate for such licenses being net. The provisions of this Section shall apply, - however, to those persons or companies required by the provisions ofSection 92 -5902 of the Code of Georgia to make returns to the Comptroller General of Georgia. SECTION 3.. This ordinance shall continue in effect,for each and every fiscal year hereafter unless and until repealed or changed by ordinvnce. SECTION 4. All ordinances or parts of ordinances conflict - ing with the provisions of this ordinance are hereby /repealed; pro - vided,' however, that, so much and such parts of ordinances passed as provided for the execution of tax assessments, or part, thereof, shall continue and remain in force so as to authorize:the Clerk of Council andEx- Officio Treasurer to issue executions and the Chief ofPolice and Ex- Officio Tax Collector to collect.: same until said taxes or assessments shall be fully paid.
