SUBJECT: APPROVAL OF CHANGE ORDER FOR THE LIVE OAK PARK
PLAYGROUND EQUIPMENT REPLACEMENT PROJECT (P10-04)
SUMMARY
The City Council is requested to approve a change order from Heisler Landscape
General Engineering Inc. in the amount of $5,495.67, for the Live Oak Park Playground
Equipment Replacement Project (P10-04) to cover the cost of additional poured in place
rubber surfacing.
BACKGROUND
1. In the City's Fiscal Year (FY) 2009-10 budget, the City Council appropriated
$35,000 for the purchase and installation of new playground equipment at Live
Oak Park (P10-04).
2. On June 15, 2010, the City Council approved the design and specifications
submitted by Dave Bang Associates, Inc. for the new playground equipment for
Live Oak Park and authorized staff to solicit construction bids. The project, as
approved by the Council, consisted of removing one damaged piece of equipment
in the older children's play area which was installed in 1997 and replacing it with a
new element. The project also included repair of the rubber surfacing required for
the removal and replacement of the playground equipment, as well as repair of
several wear patches within the existing rubber playground surfacing.
3. On July 20, 2010, the City Council awarded a contract.in the amount of $25,981.80
to Heisler Landscape General Engineering Inc. for the purchase and installation of
the new playground equipment. Consistent with past practice a 10% contingency
($2,598) was added to be used at the discretion of the City Manager should
additional project -related expenditures be required.
4. On September 20, 2010, Heisler Landscape began installation of the playground
equipment. Installation of the equipment was completed on September 22, 2010.
The rubberized surfacing was scheduled to be installed on September 23`d. Due to
concerns with the existing surface a meeting was scheduled for September 28th
with the surfacing subcontractor (ProDek), Heisler Landscape, and staff.
Consistent with the bid specifications, the proposal submitted by Heisler
Landscape included a lump sum for poured in place rubber surfacing to repair 5

old post holes (from the equipment that was removed), 16 new support holes, and
10 wear patches within the existing playground surface. During the meeting on
September 28th, the surfacing subcontractor identified a minimum of 25 wear
patches that should be repaired to avoid additional damage to the existing rubber
surface. He further recommended the entire area in the vicinity of the new
playground equipment, approximately 1,200 square feet, be recapped.
5. Heisler Landscape provided a change order to staff on October 6, 2010 which
provides for recapping 1,268 square feet of rubber surface in the immediate vicinity
of the new equipment. The change order includes a credit for the original scope of
work for the rubber surfacing which will no longer be required. The net cost for the
additional work is $5,495.67, more than the 10% contingency authorized by the
Council.
DISCUSSION
As part of several renovations to Live Oak Park in the late 1990s, a new playground
was installed in 1998. In addition to the new playground equipment, poured in place
rubber surfacing was installed over most of the playground. Over the past twelve years,
several pieces of equipment have broken and several areas of the rubber surfacing
have failed requiring repairs. For many years the Park Maintenance Workers were able
to purchase the supplies to repair the worn areas. Recently however, over the past two
years, staff has not been able to purchase the supplies to make necessary repairs. As
a result more and more worn areas have developed on the playground, in particular in
the area where the new equipment was to be installed. The surfacing in that area is
soft, almost squishy, in some places, and very firm in others. In the soft areas cracks
easily develop if children (or adults) jump causing the surfacing to move significantly.
Once the surfacing begins to crack, children begin to pick at the rubberized surface
where holes eventually develop.
When the specifications for the playground replacement project were being developed
last spring, staff requested the existing holes and worn areas be repaired as part of the
project. Sufficient funds had been budgeted to cover both the cost of the new
equipment and repairs to the surfacing. As stated above, staff included repair of 10
wear patches in the bid documents for the project. The 10 wear patches had been
identified by staff and the representative from Dave Bang Associates. Subsequently,
several additional wear patches and holes have developed, or are developing. If the
additional worn areas are not repaired now they will get larger and will become more of
a trip hazard. Since the surfacing subcontractor is already scheduled and has mobilized
to complete work at Live Oak Park for the playground replacement project, adding
repairs for the additional worn areas now will cost less than if they were to be called
back out at a later time. In terms of safety, staff recommends all the holes in the
surfacing be filled and capped now, rather than having only some filled now and
scheduling additional repairs in a few months. Because there are so many worn areas
where the new equipment has been installed, the surfacing subcontractor recommends
the entire area, approximately 1,268 square feet, be recapped which would eliminate

having over 20 patched areas on the rubber surface. Through this process the top layer
of the surfacing is removed and replaced with new rubber surfacing allowing one
smooth seamless surface.
In addition to the recap of the existing surface around the new play equipment, staff is
recommending the worn areas under each of the swings in the older children's play
area be replaced with rubber tiles. Due to the nature of the activity, the surfacing under
the swings is constantly wearing away. If rubber tiles are installed under the swings,
instead of the poured in place rubber surface, the tiles could more easily be removed
and replaced when the areas again become worn. The cost to install the rubber tiles is
included in the proposed change order.
FISCAL IMPACT
As part of the Fiscal Year (FY) 2009-10 City Budget, the City Council approved a
funding appropriation of $35,000 for the Live Oak Park Playground Equipment
Replacement project (P10-04). When the contract for this project was awarded to
Heisler Landscape General Engineering inc. on July 20, 2010, staff requested the
Council approve reallocating the balance, approximately $34,500, to FY 2010-11. As
such, sufficient funds are available to cover the original bid of $25,982 from Heisler
Landscape as well as the net increase for the proposed change order in the amount of
$5,496.
RECOMMENDATION
Approve change order from Heisler Landscape General Engineering Inc. in the amount
of $5,496.
