Lambert, Com unity Development Manage' 1--- SUBJECT: REQUESTS FROM FIVE BUSINESSES TO HAVE LIMITED DURATION GREEN CURB STREET PARKING ON LAS TUNAS DRIVE. RECOMMENDATION: The City Council is requested to consider the requests from five businesses on a two - block stretch of Las Tunas Drive to install green curb, which would result in limited duration street parking. Staff recommends that the City Council take one of the three following actions: Option One: Refer this matter to the Planning Commission for them to develop guidelines for the 15 minute green curb street parking in the commercial corridors; Option Two: Refer this matter to the newly created Public Safety Commission for them to develop guidelines for the 15 minute green curb street parking in the commercial corridors; and/or Option Three: Direct staff to install the 15 minute green curb parking as requested by five businesses on Las Tunas Drive. BACKGROUND: 1. Between July 2009 and January 2010, four different food service uses (three restaurants and one tea station) were approved by the City through the Conditional Use Permit process. The four establishments are located on the south side of Las Tunas Drive within a two -block area at 9578, 9608, 9618, and 9664 Las Tunas Drive, respectively. 2. Five businesses located at 9600, 9624, 9628, 9668, and 9674 Las Tunas Drive, respectively have requested limited duration (green curb) parking adjacent to their businesses. The business owners feel that the green curb parking is essential to City Council December 7, 2010 Page 2 their survival with the increased traffic and increased parking demand from the nearby restaurants. Most of the businesses requesting the green curb have customers who come in for a short duration (i.e., liquor store, pet store, bike shop, uniform shop). 3. Currently, there are no guidelines, policies, or procedures for green curb requests in the City's commercial corridors. Staff is seeking direction from the City Council to process such green curb requests. Once direction is received, these requests will be handled in a consistent manner. ANALYSIS: Temple City has adopted the Los Angeles County Code (LACC) by reference for purposes of traffic control. LACC Section 15020.010 (attached) states that the board (i.e., City Council) shall determine and designate the character and location of all warning, regulatory, and directional signage, other than those signs which are established by the California Vehicle Code (CVC). Therefore, any decision regarding the placement of green curb shall be subject to the review and approval of the City Council. Pat Lang, the City's Contract Traffic Engineer, has stated that he can support the placement of green curb parking in front of all of the businesses that have requested it; with the exception of the dentist at 9600 Las Tunas Drive. That is because typical dentist trips are usually not limited to 15 -minutes. However, Mr. Lang also indicated that green curb parking is essentially a "band -aid" which may provide some relief to the parking situation, but it is not necessarily the only solution. Although the liquor store and bike shop are immediately adjacent to one another, the other three businesses are not. Staff feels that the placement of green curb parking in front of the subject businesses will result in a patchwork of green curb on this two block stretch of Las Tunas Drive, with patches of regular curb in between green curb. With the reinstatement of the Public Safety Commission in January 2010, issues relating to public safety such as public parking and street parking can be reviewed in greater detail by the Commission. As an advisory Commission, this body can make a recommendation to the City Council regarding current and future green curb requests, among their other duties. This can provide an opportunity for staff and the Commission to review the impacts and benefits of installing green curb on these two blocks, and the findings of the Commission would be forwarded to the City Council for final approval. (2) Yellow indicates stopping only for the purpose of loading or unloading passengers or freight for the time as may be specified by local ordinance. The board hereby determines that insofar as they are applicable to country highways, all warning, regulatory and direction signs appearing on the Uniform Sign Chart as approved by the California Sign Committee are official signs. 15.64.010 TCMC (LACC) Signs limiting parking time authorized when. We operate two small shops next doors to these two Restaurants, an currently the parking spaces in front of our business have been ideal for people to park and hop in to our shops. Although these stalls are designated for "2hours" only parking, we have witnessed, on several occasions. People parking there for the majority of the day, without moving their vehicles, Previously, these spots have been utilized almost exclusively by our clientele who park there for almost exclusively no more than 1 hour at a time. And be advised that our shops are almong the retails in our bloc who generate taxes for our city of Temple City. And therefore. We humbly request that the city re -designate that least the three stalls directly in front of our business to I hour only or limited minutes. We feel that this re -designation of parking time would Greatly help all the business, without any detriment Whatsoever on the restaurants, we do not wish to cause any harm to these restaurants, and we feel that these three stalls Will help our customers without impacting theirs. Our business has been in Temple City for 12 enjoyable years. Our customers have become accustomed to the quick street access to our store. We pride ourselves in providing our customers with excellent customer service within a reasonable time frame. To maintain a reasonable time frame for our customers, we are requesting a 20 -minute green parking store be established from our store to the end of the corner of Las Tunas and Kauffman. Street parking is the easiest way to access our store. With the incoming store, The Golden Deli, we would like to eliminate a struggle to find parking for our customers. The Golden Deli will most likely have patrons that plan on spending more than 20 minutes to use their services. If the patrons of The Golden Deli are parked in our store front for large amount of time, it will limit the parking available to our customers. Based on those findings, I am making a formal request for a green limited time parking zone. Las Tunas Drive January 12, 2010 A well managed restaurant can be a positive addition to a community. Not only in the service it can provide, but also as an important economic stimulus as well. If successful, it will attract patrons near and far. The re- sulting increase in foot traffic will offer greater visibility to neighboring re- tail businesses, augmenting their chances of success, which in turn benefits the city with increased sales tax revenue. However, unless proper steward- ship is exercised to insure constructive co -existence between businesses with different characteristics, a potentially positive situation will result in a negative state of affairs. The nature of a retail business is to attract customers that are expedient in their purchases with transactions generally short in duration. By contrast, a restaurant will characteristically attract patrons at their leisure, who intend to take their time and enjoy a meal. Obviously, in terms of time, the parking demands of restaurant customers are far greater. 1 have no private parking directly behind my building. Ninety-five per- cent of my customers avail themselves to on -street parking on Las Tunas Drive to access my business through the front entrance. Many of my cus- tomers are elderly. Public parking to the rear and west of my establishment (about 100 feet away) is physically inconvenient for them. Front parking is immeasurably important to my business. 2 After reviewing the parking study based on KOA's analysis, Patrick Lang, City Traffic Engineer, has determined that, and I quote, "While the proposed project parking can be accommodated within the existing adjacent parking lot, it will have a cumulative impact on the overall parking within the business district." He also recommends possibly charging a yearly miti- gation fee that could be used to construct new parking facilities. In other words Gentlemen, customer parking will inevitably come un- der additional stress in the business district. And since the applicant is ex- panding his enterprise to a third restaurant at 9664 Las Tunas Drive, 4 doors away from my establishment, I believe this restaurant will hit the ground running, and parking, (public or on -street), will be overwhelmed almost im- mediately. And as to the prospect of exacting parking fees on the applicant, any parking construction that may result from them would be years away. My business could not suffer the wait. At present my business is highly dependant on front street parking. Regardless of public parking availability, these spaces will always be pre- ferred. And because of their close proximity to the proposed project, they will constantly be monopolized by restaurant customers; albeit unknow- ingly. This restaurant will be open for 12 to 13 hours, seven days a week. And in deference to peak hours, I am sure restaurant customers will not be turned away in between them. The only immediate solution would be to change parking restrictions on Las Tunas Drive from two hours to 30 minute zones on the effected block, or offer posted 24 minute green zones to retailers in need. Either op- tion must be strictly enforced to encourage restaurant patrons to use public parking lots. The Labor Department has just released a report stating a severe in- crease in retail business closures in 2010. I am trying my best not to be- come a Labor Department statistic. Losing ones business due to economic forces is one thing, but losing it because of an administrative decision is quite another. n c a a
