CALL TO ORDER Mayor Vizcarra called the City Council Regular Meeting to order at 7:30 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. INVOCATION Reverend David Palmer, First United Methodist Church, provided the Invocation. 4. PLEDGE OF ALLEGIANCE Temple City resident Nick Stratis led those present in the Pledge of Allegiance to the Flag. 5. CEREMONIAL MATTERS — PRESENTATIONS A. ADOPTION OF RESOLUTION NO. 10-4711 CONFIRMING APPOINTMENTS TO THE PUBLIC SAFETY COMMISSION. The City Council was requested to adopt Resolution No. 10-4711 appointing five members to the Public Safety Commission. Councilmember Yu moved to adopt Resolution No. 10-4711, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY CONFIRMING APPOINTMENTS TO THE PUBLIC SAFETY COMMISSION, seconded by Mayor Pro Tem Chavez and unanimously carried by the following roll call vote: AYES: NOES: ABSENT: Councilmember-Blum, Sternquist, Yu, Chavez, Vizcarra Councilmember-None Councilmember-None City Council Minutes December 7, 2010 Page 2 ABSTAIN: Councilmember-None City Clerk Flandrick administered the Oath of Office to the five members to the Public Safety Commission: Brian Baudendistel, Jim Clift, Ousama Nimri, Patricia Shen and Nicholas Stratis. City Attorney Vail recommended that Council stagger the terms of the Commissioners to have the terms of two Commissioners ending June 30, 2012 and the terms of three Commissioners ending June 30, 2013. Council concurred and Mayor Vizcarra suggested a drawing at the Commission's first meeting to determine terms with an amended resolution to then come back to Council for approval. B. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Tianyi Cheng, Temple City High School student liaison, provided an update of upcoming student Holiday activities and events. City Council Minutes December 7, 2010 Page 3 Audrey Lee and John Wu, Youth Committee Members, asked the Council to share any project suggestions they may have for the Youth Committee to accomplish this year. Mayor Pro Tem Chavez, Youth Committee Liaison Member, said although he was not able to attend the last Committee meeting, that he had suggestions for the next meeting, including fundraisers for the Youth Committee to get involved in. Franklin Ruedel, Temple City resident, suggested the City look at hiring a local CPA firm as the City's auditors, in light of a recent newspaper article naming the accounting firm presently used by the City as the same as that used by the City of Bell. He also thanked the City Council for the City's co-sponsorship of the outstanding Chamber mixer held at the Historical Society. 7. CLOSED SESSION STATEMENT City Attorney Vail stated the City Council met with legal Counsel and gave direction to the City Attorney regarding both potential cases. Council will address the remaining closed session item at the end of the agenda. City Council Minutes December 7, 2010 Page 6 8. UNFINISHED BUSINESS — None 9. NEW BUSINESS A. REQUESTS FROM FIVE BUSINESSES TO HAVE LIMITED DURATION STREET PARKING ON LAS TUNAS DRIVE Community Development Manager Lambert stated the City Council was requested to consider the requests from five businesses on a two -block stretch of Las Tunas Drive to install green curb, which would result in limited duration street parking. Between July 2009 and January 2010, four different food service uses were approved by the City through the Conditional Use Permit process. The four establishments are located on the south side of Las Tunas Drive within a two -block area at 9578, 9608, 9618, and 9664 Las Tunas Drive. Five businesses located at 9600, 9624, 9628, 9668, and 9674 Las Tunas Drive requested limited duration (green curb) parking adjacent to their businesses. The business owners felt that the green curb parking is essential to their survival with the increased traffic and parking demand from the nearby restaurants. Most of the businesses requesting the green curb have customers that come in for a short duration (i.e. liquor store, pet store, bike shop, uniform shop). Currently, there are no guidelines, policies, or procedures for green curb requests in the City's commercial corridors. Staff is seeking direction from the City Council to process such green curb requests in a consistent manner. Temple City adopted the Los Angeles County Code by reference for purposes of traffic control. Section 15020.010 states that the board (i.e. City Council) shall determine and designate the character and location of all warning, regulatory, and directional signage, other than those signs established by the California Vehicle Code. Therefore, any decision regarding the placement of green curb shall be subject to the review and approval of the City Council. Although the liquor store and bike shop are immediately adjacent to one another, the other three businesses are not. Staff felt that the placement of green curb parking in front of the subject businesses will result in a patchwork of green curb on this two block stretch of Las Tunas Drive, with patches of regular curb in between green curb. With the reinstatement of the Public Safety Commission in January 2010, issues relating to public safety such as public parking and street parking City Council Minutes December 7, 2010 Page 7 can be reviewed in greater detail by the Commission for recommendation to Council. Staff recommends that the City Council take one of the following three actions: Option One: Refer this matter to the Planning Commission for them to develop guidelines for the 15 minute green curb street parking in the commercial corridors; Option Two: Refer this matter to the newly created Public Safety Commission for them to develop guidelines for the 15 minute green curb street parking in the commercial corridors; and/or Option Three: Direct staff to install the 15 minute green curb parking as requested by five businesses on Las Tunas Drive. Community Development Manager Lambert provided a visual representation of the businesses requesting green curb via a power point presentation, and responded to questions from Council. Tony Sarkis, liquor store owner at 9624 Las Tunas Drive, said his customers are in and out in a few minutes, but the parking in front of his store is taken and there is no place for customer parking in the whole block. Conrad Urquiddi, pet shop owner at 9674 Las Tunas Drive, said he appeared before the Planning Commission to express his concerns about the restaurant at 9664 and asked that the Conditional Use Permit be denied. He emphasized the effect on his business as there is no parking behind it and most of his customers use the front door access on Las Tunas Drive as public parking is physically inconvenient for them. Currently there is 2 -hour parking on Las Tunas Drive. He felt that retail businesses were not allowed the same consideration as restaurants. Restaurant parking needs are far greater than retail and because businesses need immediate relief, he urged Council to direct staff to install green curb parking as requested. Councilmember Blum stated bringing in new businesses helps with the revitalization but the City has been experiencing problems for a long time with inadequate parking. The new businesses coming in went through the Conditional Use Permit (CUP) process as required. Council needs to address the larger parking problem and spend more time addressing that. The City does not want to drive current businesses out when bringing new businesses into town. Council needs to take action for these businesses to give them relief by green curbing in front of their businesses, but also to address long term parking issues. City Council Minutes December 7, 2010 Page 8 Mayor Pro Tem Chavez stated issues such as this is why the Public Safety Commission was reinstated. It may delay the process but would be better to make an informed decision rather than a piecemeal program and then have to take it out. It seems to be a walk -able distance to the public parking lots and use of the school district lot could solve some of that problem as well. To install green curbing here and there would just be a band -aid effect and this requires careful thought. He recommended referring this to the Public Safety Commission to develop guidelines for the entire parking district. Councilmember Sternquist stated the in -lieu parking fees have been suspended so there is no mitigation in place for these restaurants coming into town. Community Development Manager Lambert noted that all restaurants are conditioned to pay the in -lieu parking fee in the future. This area is in the City Center District of the Downtown Specific Plan, which is the only district where additional parking is not required, as this 3-4 block stretch is pegged for intense use. Councilmember Sternquist stated the City needs to do whatever it can to stop this process from getting bigger. These businesses need immediate relief. It is no fault of their own that these new businesses have come in, so she had no problem with the 15 minute parking, even on a temporary basis for 3-6 months until the Public Safety Commission reviewed the issue or to see how well it works. Councilmember Yu believed the parking issue needs to be studied thoroughly and did not think the green curbing should be patchwork. While it may be beneficial to some businesses, it would be detrimental to other businesses. The demand for parking for restaurants is very different from other businesses, so he would like to see a more comprehensive plan. This would be a good issue to refer to the newly formed Public Safety Commission with a recommendation from staff. He did not believe this is a real parking issue as there are parking lots fairly close. They just may not be as convenient. He recommended referring this to the Public Safety Commission. Mayor Vizcarra stated the City has been conscious of this problem for a long time. There are a number of cars parked along the street, usually employees or business owners. In talking to these businesses, it seems their customers can rarely park in front of their businesses. This is an ongoing problem, but at times like this becomes more evident, and at this time, the impact is one of financial hardship for these business owners. He felt they need relief and believed Council should move on this immediately, and refer it to the Public Safety Commission. City Council Minutes December 7, 2010 Page 9 City Manager Pulido suggested a joint meeting of the Planning Commission and Public Safety Commission to bring a recommendation on this issue at a later date. Mayor Vizcarra said he wished to move on this now and give it to the Commission. At a later date, he would like to see what impact it has on the businesses. Councilmember Yu noted that all businesses in this area may be impacted by green curbing, but all were not notified of this meeting to be here and present their side. Council discussed this issue further. Councilmember Blum moved to direct staff to come back in 30 days with a proposed ordinance, time limit recommendations and strategy for standards for green curb requests in a 2 -block area of Las Tunas Drive, with notices sent to the affected property owners and tenants, and further directed referral to the Planning Commission and Public Safety Commission for further review and recommendation, seconded by Mayor Pro Tem Chavez and unanimously carried by the following roll call vote: AYES: NOES: ABSENT: ABSTAIN: Councilmember-Blum, Sternquist, Yu, Chavez, Vizcarra Councilmember-None Councilmember-None Councilmember-None B. FIRST READING OF PROPOSED ORDINANCE NO. 10-938 AMENDING SECTIONS 3320, 3322, 3323, 3325 AND 3329 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO OVERNIGHT PARKING ON CITY STREETS Public Safety Officer Ariizumi reviewed his staff report, stating on October 19, 2010, the City Council reviewed the overnight parking ordinance and directed staff to prepare an ordinance amendment to implement the following changes: • The restricted hours for overnight parking will now be from 2 a.m. to 5 a.m.; • Residents with a take home company vehicle may apply for an annual overnight parking permit if the applicant provides a copy of the registration for the work vehicle and a letter from their supervisor indicating that the vehicle is issued to the applicant and the applicant is authorized to take the vehicle home at night; City Council Minutes December 7, 2010 Page 10 • An annual overnight parking permit may now be placed in two (2) locations on the vehicle: 1) on the lower left hand corner of the rear window; or 2) on the left hand side of the rear bumper; • Residents may now apply for up to two (2) temporary conditional permits per year when a vehicle with a valid annual overnight parking permit is disabled and is in the shop for repair. The resident must provide documentation from the repair shop. The issuing officer may issue the temporary conditional permit at no charge for a duration up to thirty (30) days; and • The Public Safety Commission will hear residents appeal for a hardship review if the resident does not met the criteria for an annual overnight parking permit or is requesting an exemption from the criteria. Sandra Hakim, Temple City resident, said she has three cars and only parking space for one car, so it is a financial hardship to get parking permits for two cars. Mayor Pro Tem Chavez stated that part of the ordinance amendment addresses hardship requests that may be appealed to the Public Safety Commission. Christopher Kline, Temple City resident, spoke of his concerns regarding permitting for recreational vehicles and trailers which he considered a hardship. Public Safety Officer Ariizumi stated he would look into Mr. Kline's concerns, as they were not addressed in this ordinance amendment. At the request of Council, City Clerk Flandrick read the title of proposed Ordinance No. 10-938. Councilmember Blum moved to waive further reading and introduce on first reading proposed Ordinance No. 10-938, an ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, REVISING THE OVERNIGHT PARKING PERMIT PROCESS AND FEE PROVISIONS OF PART 3 OF ARTICLE A OF CHAPTER 3 OF TITLE 3 OF THE TEMPLE CITY MUNICIPAL CODE, seconded by Councilmember Yu and unanimously carried by the following roll call vote: AYES: Councilmember-Blum, Sternquist, Yu, Chavez, Vizcarra NOES: Councilmember-None ABSENT: Councilmember-None City Council Minutes December 7, 2010 Page 11 ABSTAIN: Councilmember-None 10. COMMUNICATIONS A. CHAMBER OF COMMERCE MONTHLY UPDATE Linda Payne, Chamber of Commerce President/CEO, provided an update of the Chamber's recent and upcoming events and membership status. 11. RECESS TO COMMUNITY REDEVELOPMENT AGENCY MEETING At 10:22 p.m., the City Council recessed to the Community Redevelopment Agency Meeting. Minutes of the Agency Meeting are set forth in full in the Agency's records. RECONVENE AS CITY COUNCIL The City Council Meeting was reconvened at 10:23 p.m. with all Councilmembers present. 12. ACTION ON REQUEST BY CRA — None 13. UPDATE FROM CITY MANAGER — None 14. MATTERS FROM CITY OFFICIALS — None 15. COUNCIL REPORTS REGARDING AD HOC OR COMMISSION MEETINGS Councilmember Yu reported on recent meetings of the Rosemead Boulevard Improvement Project Ad Hoc Committee at which time interviews were conducted and an architectural design firm was selected. The Project Manager and City Manager are now negotiating with the finalist and will bring back an agreement for Council approval at the next meeting. 16. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNC1LMEMBER BLUM 1) Establishment of a Public Art Advisory Committee Councilmember Blum stated the Rosemead Boulevard Improvement Project includes an element for public art. As it is important to move forward with this project and there is no one on staff to advise on this matter, he proposed putting some type of advisory committee together who could report to the Planning Commission and/or Parks City Council Minutes December 7, 2010 Page 12 and Recreation Commission. He requested this issue be placed on the next meeting agenda for Council to decide how to proceed. In response to Council, Councilmember Blum said he talked to several people with skills in this area that could brainstorm and provide recommendations. He felt at least one member should be from the school district. Councilmember Yu stated this is a community building process, and as a beautification and enhancement component, could involve transitional at Council concurred to authorize Councilmember Blum and Mayor Vizcarra to report back to Council at the next meeting on their recommendations regarding the formation, makeup and specific tasks of a public art advisory group for inclusion of public art as part of the Rosemead Boulevard Improvement Project. B. COUNCILMEMBER STERNQUIST Councilmember Sternquist asked for an update on the proposed senior meal program. Parks & Recreation Director Burroughs responded that staff has had a few meetings with the County and they have looked at the facility at Live Oak Park. There are not enough details yet to bring to Council for a decision, but she will put an update in the City Manager's report. C. COUNCILMEMBER YU Councilmember Yu requested that when the tabled agenda item regarding City holidays return, that it include a more comprehensive staff report on vacation, sick leave and holidays as compared to other cities. D. MAYOR PRO TEM CHAVEZ 1) City Donation Requests for TCHS Student Organization Fundraisers Mayor Pro Tem Chavez stated he would withdraw this item for now as he did not have the opportunity to obtain details. Mayor Pro Tem Chavez congratulated the Parks and Recreation Commission and staff for all their efforts this past year on behalf of the City's 50th Anniversary events. City Council Minutes December 7, 2010 Page 13 Mayor Pro Tem Chavez suggested the Council consider, as an agenda item next meeting, to disband some of the Ad Hoc Committees that are no longer necessary. E. MAYOR VIZCARRA 1) Review of Effectiveness of City Commission Memberships Mayor Vizcarra said the City has a number of commissions over which the Council really doesn't have any oversight or know what is happening with them on a regular basis. Also, there is now a vacancy on the Parks and Recreation Commission and Council needs to address how to fill that vacancy. He suggested reviewing the list of those who applied for that Commission last year and make a selection from that list. City Attorney Vail stated the Maddy Act requires that the City post notification of the vacancy and the term of office. The process of appointment is completely up to Council. The full Council does have to vote on the selection, but is not just limited to those who previously filed applications. Council can solicit people from the community. Council discussed the process and changes they wished to be made in the next appointment/reappointment process next year. Mayor Vizcarra appointed Councilmember Sternquist and Mayor Pro Tem Chavez to review and recommend a selection process for the Parks and Recreation vacancy. Mayor Vizcarra also directed staff to agendize at a later date the process of yearly Commission appointments for Council discussion. 17. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Mary Burke, Temple City resident, thanked Council for all their hard work this year. She previously has spoken about improvements to the Council Chambers and hoped that the Council would not put these off any longer. She also asked to keep residents more informed of what is happening on the corner of Rosemead and Las Tunas and said she would appreciate more detail. Mary Kokayko, Temple City resident, spoke of her concerns regarding the green curb item, saying the City should not penalize current businesses or drive away businesses because of more and more restaurants coming into the City. These businesses are losing money and she suggested putting a moratorium on any more restaurants until the parking situation has been figured out. Jerry Jambazian, Temple City businessman, commented on last night's mixer, stating it was a good fun evening, but maybe could have included a chronicle of this last year of celebration of the City's 50th Anniversary. Parks and Recreation Director Burroughs stated a recap of the entire year's events will be presented before year's end. 19.
