D'Avellino Construction, Inc. $166,428.00 3. JAG Paving, Corp. $187,550.00 4. S. Brothers, Inc. $204,581.50 WHEREAS, Shore Top Construction, Corp., of Freehold, NJ has submitted the lowest bid for said contract as evidenced by the response on file with the Borough's Purchasing Department and with the Borough Engineer; and WHEREAS, the Borough Engineer has reviewed the above bid proposals and has recommended the award of a contract to Shore Top Construction, Corp., in a total amount not to exceed $149,670.00 - Base Bid Items 1 through 16, Alternate Item "A" and Addition Item "A" inclusive per attached award letter; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. Acct.# NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as follows: 1. That the appropriate Borough Officials are hereby authorized to enter into a contract with Shore Top Construction Corp., of Freehold, NJ for the Project for the sum of $149,670.00 in accordance in all respects with the request for proposals and bid on same. 2. That a copy of this Resolution shall be forwarded to the Borough's Purchasing Department,* the Borough's Consulting Engineers CME Associates and the Borough's Director of Engineering. 3. That the aforementioned award of bid is contingent upon formal approval from the New Jersey Department of Labor, Division of Wage and Hour Compliance. Four (4) bids were submitted, ranging from an apparent low base bid of $129,220.00 by Shore Top Construction Corp. to a high base bid of $204,581.50 by S. Brothers, Inc. The Engineer's Estimate for the base bid was $166,500.00 Please find enclosed a complete Summary of Bids for the Council's review. Upon review, irregularities were noted in some of the bid proposals submitted. However, none were found in the proposal submitted by the apparent low bidder; therefore, the outcome of the bid is unaffected. We note that Local Public Contract Law limits the aggregate dollar value of alternate and addition items to no more than 50% of the value of the base bid. Accordingly, Addition Item V, which includes the resurfacing of Sumutka and Ash Streets, cannot be included in an award resolution. As a matter of procedure, our office has contacted Shore Top Construction Corp. to discuss their bid. The representatives we spoke to indicated they are comfortable with the bid as submitted and there is no objection to completing the project based on the bid prices submitted and the contract time. The award should be subject to review and approval by the DCA and the Borough Attorney, including concurrence to waive any minor irregularities, the review of the bid bond and surety from the low bidder, and submission of the required bonds and insurance certificates for the project. 2. Retain bid securities of the second and third low bidders pending award and execution of the contract with Shore Top Construction Corp.; and, 3.
