DIRECTING THE PLANNING BOARD OF THE BOROUGH
OF CARTERET TO UNDERTAKE A STUDY TO DETERMINE IF AN
AREA QUALIFIES AS A REDEVELOPMENT AREA
WHEREAS, the Borough is desirous of creating a Carteret Chrome Waterfront
Redevelopment Area in the Borough in accordance with the Local
Redevelopment and Housing Law (codified at N.J.S.A. 40A: 12A-1 et seq.); and
VOtEREAS, the Local Redevelopment and Housing Law requires that a tract of
land must first be delineated as an "area in need of redevelopment" or
"redevelopment area" prior to designation as a Redevelopment Area; and
WHEREAS, the Borough now wishes to consider the designation of an area as a
Redevelopment Area, which designation, as stated above, must be preceded by
such area's delineation as an "area in need of redevelopment" or a
"redevelopment area"; and
WHEREAS, Section 6 of the Local Redevelopment and Housing Law provides
that no area can be designated as an area in need of redevelopment or
redevelopment area unless the governing body of a municipality, by resolution,
authorizes the planning board of such municipality to undertake a preliminary
investigation to determine whether an area is a redevelopment area according to
the criteria set forth in Section 5 of the Local Redevelopment and Housing Law;
and
WHEREAS, the Borough now wishes to authorize the Borough Planning Board
to undertake a preliminary investigation of that area more particularly described
in Exhibit A annexed hereto (the "Study Area") to determine if such area qualifies
as a redevelopment area as set forth in the Local Redevelopment and Housing
Law.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Board of the
Borough of Carteret is directed to undertake a preliminary investigation of the
Study Area to determine if such area qualifies as a redevelopment area according
to the criteria set forth in Section 5 of the Local Redevelopment and Housing Law
(codified at N.J.S.A. 40A: 12A-3).
BE IT FURTHER RESOLVED that the Planning Board shall conduct its
investigation in accordance with the provisions in Section 6 of the Local
Redevelopment and Housing Law (codified at N.J.S.A. 40A: 12A-6) and shall
recommend to this Council whether said Study Area should be determined a
redevelopment area.
