ORDNANCE NO. 66-138
AN ORDINANCE OF THE CITY OF TEMPLE CITY ENACTING
AN INTERIM ZONING ORDINANCE PURSUANT TO THE PRO-
VISIONS OF SECTION 65858 OF THE CALIFORNIA GOVERN-
MENT CODE IMPOSING A MORATORIUM ON NEW USES RELAT-
ING TO, AND ON BUILDING AND OCCUPANCY PERMITS FOR
ANIMAL HOSPITALS AND KENNELS PENDING PLANNING
COMMISSION STUDIES WITH RESPECT THERETO.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. The City Council does hereby find and determine
that the Planning Commission of this City has heretofore undertaken
in good faith studies to determine the appropriate zone classifica-
tion for animal hospitals and kennels, in order to prescribe neces-
sary regulations to safeguard against noise, nuisance and devalua-
tion of neighboring residential properties.
SECTION 2. The City Council finds further that the recom-
mendations of the Planning Commission on such matters should be
forthcoming within the next few months, and that to permit construc-
tion or new uses of structures for animal hospitals and kennels
prior to the consumation of said studies would in large measure
emasculate the benefits to be derived from such study, and would
be contrary to the best interests and general welfare of the resi-
dents of this City.
SECTION 3. Pending completion of such studies and the
recommendations of the Planning Commission, and pursuant to the pro-
visions of Section 65856 of the Government Code; a moratorium is
hereby imposed upon the construction or new use of structures for
animal hospitals and kennels in the City of Temple City; and any
and all provisions of the Temple City municipal Code authorizing
such construction or use are hereby suspended.
SECTION 4. This Ordinance shall remain in effect until
June 1, 1966, and the Building Inspector of this City is directed
not to issue any building or occupancy permit for an animal hospital
or kennel during the term of this Ordinance; nor during the term
hereof shall any person use any property on the City for a new or
expanded animal hospital or kennel.
SECTION 5. This Ordinance shall become immediately effec-
tive pursuant to the provisions of Section 65858 of the Government
Code and for the reasons above stated, and is adopted pursuant to
the authority of Anderson v. Pleasant HII1s, 229 CA 2d 79; Metro
Realt v. Co of E Dora o, 222 CA 2d Ors; Hunder v Adams, 0 CA
2d 51 ; Los An e es v, Su erior Court, 221 ACA 5 ; 44 AG Ops 14;
and Slater v. os Anoe,es, 2 C 757.
SECTION 6. The City Clerk of the City of Temple City
shall certify to the passage and adoption of this Ordinance and to
its approval by the Mayor and shall cause the same to be published
in the Temple City Times, a semi-weekly newspaper, published and
circulated in the City of Temple City.
