Mayer Inc. 11,637.50 O The Council of the City of Medina met in regular session on Tuesday, February 2, 1982 at 7:30 P.M. Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, Thomas Crosby, William Reiser, Sarah Lutz; Clerk -Treasurer, Donna Roehl; Planning and Zoning Admin- istrator, JoEllen Hurr; Police Chief, Charles Hoover; Attorney, Richard Schieffer; Engineer, Paul Pearson 1. ADDITIONAL AGENDA ITEMS Council agreed to discuss the following additional items: Resolution accepting legal description of the Minnehaha Creek Watershed District. 2. MINULLS OF JANUARY 19, 1982 Motion by Reiser, seconded by Scherer to accept minutes of January 19, 1982, as presented. Motion declared carried 3. POLICE DEPARTMENT Reserve Officers Chief Hoover explained that he is looking into organizing a police reserve unit. He de- tailed his plans very briefly and satated that the Northwest Chamber of Commerce has agreed to sponsor supplying the uniforms. 4. PUBLIC WORKS DEPARTMENT, WICHITA TRAIL Paul Pearson explained the drainage problem that exists on Wichita Tr. and other reasons why the city has not accepted the street as a city street and refunded escrow funds to Jerry Gobel. Discussion of cost estimates to make the corrections. Council asked Mr. Pearson to prepare a cost estimate for completion of the project in the Spring of 1982. Councilmembers were informed that the city snowplows had pushed back the snowbanks on the street because the residents were unable to keep the street open with their equipment. 966 Front-end Loader Wilfred Scherer reported that Barbarossa and Sons has agreed to store a front-end loader at the Medina utility building for use in removing snow, at a cost to the City of $50.00 per hour. Fire Hydrants Discussion of snow that has accumulated around fire hydrants. Clerk was asked to write letters to residents that have hydrants on their property asking them to keep the snow shoveled away from the hydrants in an effort to cut costs and in- crease protection in the event of a fire. Medina Morningside Sewer Paul Pearson stated that Nodland and Associates are planning to resume work late in February, weather permitting. Richard Schieffer stated that two property owners have not responded to offers for storm sewer easements and that condemnation may be necessary. Motion by Crosby, seconded by Lutz to authorize the City Attorney to begin condemnation proceedings on those properties for which owners have not responded. Motion declared carried 5. PLANNING AND ZONING DEPARTMENT Hennepin County Landfill Discussion of the possibility of the Board of County Commissioners acting to designate a 180 acre site in Baker Park as a landfill site. JoEllen Hurr stated that she would be attending the February 9th Ways. and Means Committee meeting to respond to the proposed resolution. Motion by Crosby, seconded by Lutz to adopt Resolution 82-3 opposing placement of a land- fill in County parks for reasons given several years ago, which still apply; and that other alternatives such as resource recovery be explored for disposing of garbage. Motion dclared carried Woodlake Sanitary Landfill JoEllen Hurr reported that she had attended a meeting of PCA officials and represent11 - atives of Woodlake regarding the fact that Woodlake is not taking care of its responsibilities under PCA directions for conduct at the landfill site. 6. ROLLING GREEN COUNTRY CLUB Discussion of what action the city should take in view of the fact that Rolling Green has file bankruptcy under Chapter 11. Richard Schieffer stated that he would appear at a meeting scheduled for February 24th for those having claims against the club. He also reported that he had talked with a member of the club the possibility of the city acquiring one of their existing wells. Donna Roehl asked several questions regarding renewal of a club license if taxes are not paid and whether or not a private club is allowed to cater to private non-member parties using their club license to serve liquor. Mr. Schieffer stated that he would do some research into the matter. 7. METROPOLITAN COUNCIL PLANNING ASSISTANCE GRANT Motion by Crosby, seconded by Lutz to authorize amendment to local Planning Assistance Grant for purposes of processing the cities 1980-81 grant request. Motion declared carried 8. COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS Motion by Lutz, seconded by Scherer to set a Public Hearing for Year VIII of Community Development Block Grant funding, for March 16, 1982 at 8:00 P.M. Motion declared carried Donna Roehl reported that application has been made for all of the outstanding rehabilitation funds through Year VII and that an income survey of the Independence Beach area residents would be taken so that a determination could be made regarding their eligibility for funds. Discussion of the possibility of pooling funds with a neighboring community for a housing project. Motion by Reiser, seconded by Scherer to appoint Sarah Lutz as a member of the Citizens Advisory Committee for purposes of Community Development Funding. Motion declared carried -9. CONSENT AGENDA Motion by Reiser, seconded by Crosby to renew membership in the following organizations: Northwest League of Cities, $326.31; Minnesota Parks and Recreation, $50.00; Elm Creek Watershed District, $2738.00. Motion declared carried 10. WCCO JoEllen Hurr reported that the Planning Commission has a scheduled Public Hearing on Tues- day, February 9th at 7:45 P.M. and urged councilmembers to attend. Discussion of the procedure the city would follow to deal with the application. 11. PLANNING COMMISSION APPOINTMENTS JoEllen Hurr reported that the terms of Ron Fortin, Jack Wahlfors and Anne Theis expire on March 1st. Council requested that they be asked if they wish to continue as Planning Commission members. 12. MINNEHAHA CREEK WATERSHED DISTRICT Motion by Crosby, seconded by Reiser to adopt Resolution 82-2 amending the boundaries of the Minnehaha Creek Watershed District. Motion declared carried 12 13. BILLS Motion by Lutz, seconded by Scherer to pay the bills; Order Checks # 1025-1079 in the amount of $113,709.81; Payroll Checks # 6535-6561 in the amount of $11,146.20 and Rev- enue Sharing Check # 1031 in the amount of $11,637.50. Motion declared carried 14. BRUCE NEUMANN Discussion of the fact that the 30 day time period for removal of machinery, etc. from Bruce Neumann's yard, has expired. Richard Schaeffer and JoEllen Hurr were asked to work out a solution to the zoning question and the clean-up order. 15. COLONIAL DRIVE-IN THEATRE Emil Jubert reported that the perimeter fence at the Drive -In Theatre is badly in need of repair. JoEllen Hurr stated that she would check the fence and aeport to Council.
