BE IT FURTHER RESOLVED that the thanks of the Mayor
and Councilmen and citizens of Savannah Beach be especially
extended to the Honorable E. W. Cubbedge and to the Honorable
L. C. Burns for their efforts in this worthwhile accomplish-
ment.
The Mayor called attention to the bad condition ofthe
sea -wall from Tilton Avenue to let Street and stated that some-
thing must be done now, after some discussion as to the method
of financing the work, Councilman Peters moved that the Mayor
and the Chairman of the Finance Committee be empowered to ne-
gotiate a loan of *20,000.00 payable in five years at one of
the Savannah banks. Councilman Young seconded and the motion
passed.
Mayor Dutton asked what plan would be used in erecting
the sea -wall. Councilman Lovell moved that the compromised plan
of Mr. C. L. Stewart be used, in which the sea -wall will be ex-
tended slightly eastward from the original plan. Councilman
Brown seconded and the motion passed.
The Mayor informed Council that the several Lutheran
Churches have requested the use of the auditorium to hold services
on Sunday morning during the summer season and that the request
had been granted.
There being no further business Council adjourned sub-
ject to the call of the Mayor.

April 14, 1949
The regular meeting of Town Council was held today at
4 p. M. in the Council room and was attended by Mayor Dutton,
who presided, Councilmen Brown, Young, Hosti, peters, Lovell,
and Meddin, Town Attorney Solms, Jr., also Mrs. Ruth Miller,
Chas. H. Walsh, J. L. Oates, Mr. Reed, Hubert Ellzey and Thos.
L. Fitzgibbon.
Mrs. Miller protested against the assessment placed on
her property and asked that Council reconsider its action, Mrs.
Miller was excused, the matter was referred to the Assessment
Committee for reconsideration.
Mr. Walsh appearing for Mr. Simon Gaza.n requested per-
mission to build two houses on lot no. 8, w 6, this being a
"zoned area the request was denied. Mr. "Walsh was excused.

Mr. Oates requested that his plumbing license be re-
newed, he having been refused a license by Mr. Lang the plumb-
ing Inspector, who stated that his work was very unsatisfactory,
complaints having been received from several property owners.
Mr. Oates was excused.
Mr. Thos. L. Fitzgibbon appearing for American Legion
Post # 154 requested that the whiskey, beer and soft drink
license be reduced to $250.00 a.s it formerly was, that new
officers are now operating the Post. Mr. Fitzgibbon was excused.
Mr. Ellzey protested against the assessment placed on
his property in Ft. Screven. He was excused.
The minutes of the meeting of March 10th were read and
adopted.
In connection with petition of Mr. Simon Ga.zan to erect
two buildings on one lot, Councilman Meddin moved that the peti-
tion be denied as the zoning ordinance must be complied with,
but -that a subdivision would be approved. Councilman Lovell sec -
onded and the motion passed.
Councilman Meddin moved that the petition of Mr. J. L.
Oates for a Plumbing license be granted. Councilman Lovell sec -
onded and the motion passed.
American Legion Post 154 petitioned that the license for
the sale of whiskey be reduced to $250.00 As it was formerly,
Councilman Peters moved that the request be granted, Councilman
Meddin seconded and the motion passed.
The Savannah Beach Chamber of Commerce presented a bill
for $250.00 covering expenses of their Float and the entertain-
ment for the Nancy Hanks Celebration. Councilman Young moved that
it be paid, Councilmen peters seconded and the motion passed.
Councilman Lovell moved that bills for -the month of April
amounting to 11710.98 be paid. Councilman Young seconded and the
motion passed.
Councilman Brown informed Council that Mrs. Willis, Prin-
cipal, of the public School wants a curtain or the stage in the
auditorium so that school plays and other activities can be prop-
erly conducted. The coet will be $106.00 installed. Councilman
Young moved that they be purchased, Councilman Peters seconded
and the motion passed.
Mr. Solms stated that in connection with the opening of
6th Street to the 4 H Camp that the Tybee Beach Company would
not agree to quit claiming the Street to the Town, Councilman
Lovell moved that if the Tybee Beach Company would not agree to
opening the Street within thirty days it be condemned. Council -
man peters seconded and the motion passed.
The Mayor suggested that the State Highway Department be
requested to change the location of the Wilmington River bridge

at Thunderbolt and also that the mayor and Councilmen of the
Town of Thunderbolt be requested to discontinue the traffic
light at the auto road and Bon Adventure Road. Councilman
Young moved that a committee be appointed to handle the matter
with the authorities of Thunderbolt. Councilman peters seconded
and the motion passed.
The request of Mrs. Ruth Miller to be permitted to place a
sign on lst Street on the property of Mrs. Estelle McMillan was
granted.
Mr. E. M. Carpenter presented a map showing a subdivision
of lot 8, Ft. ward, and requested that Council approve it. Council-
man peters moved that the request be granted, Councilman Lovell
seconded and the motion passed.
Mr Reed stated that he was ready to start work in connec-
tion with the erection of the sea -wall from Tilton Avenue to lst
Street, and that arrangements had been made to replace the steps
along the board walk from 14th to 16th Streets.
The Assessment Committee recommended that the assessment
on the property of Mrs. Ruth Miller, section 3 of lot $3, ward 4
be reduced to $8,000.00 for the year 1949, and denied that the
request of Hubert K. Ellzey for reduction on his assessment on
lots 3, 4, 5, N. pt. of 10, Blk. 32, Ft. Screven ward.
Councilman Young moved that the following ordinance be
adopted. Councilman Lovell seconded and the motion passed.

Councilman Lovell moved that the following ordinance be adopted,
Councilman Peters seconded and the motion passed.
ORDINANCE
TO PROVIDE FOR THE TAXATION OF REAL AND PERSONAL PROPERTY
IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR
THE FISCAL YEAR COMMENCING MAY 1st, 1949, AND FROM YEAR TO
YEAR UNTIL REPEALED: AND FOR OTHER PURPOSES.
SECTION 1. Be it ordained by the Mayor and Councilmen of the
Town of Savannah Beach, Tybee Island, Georgia, in Council assembled
and it is hereby ordained by the authority of the same, that the rate
of taxation upon real estate and personal property within the limits
of the said Town of Savannah Beach, Tybee Island, Georgia, for the
fiscal year commencing May let, 1949, shall be TWO AND TWENTY -TWO
HUNDREDTHS (2.22) PER CENT upon the assessed or returned value of
same, the value of real estate improvements to be ascertained from
the returns of the Committee on Assessments of said Mayor and Council-
men, and the valuation of personal property to be ascertained from the
returns of the owners thereof, in pursuance of the scheme and plan
contained in Sections One, Two, Three and Four of the Ordinance to
provide for the assessment -of taxable property in the Town of Savannah
Beach, Tybee Island, Georgia, and the mode of valuing such property
for taxation and to carry into effect the provisions of the Act of
the General Assembly of the State of Georgia, approved August 19, 1922,
Section 21, passed in Council assembled October 13, 1922; and it is
further ordained that if any person or persons shall refuse to pay
any DOUBLE TAX assessed as above provided within thirty (30) days
after same shall become due, the Clerk of Council, as Ex- Officio
Treasurer of said Town, shall issue execution therefor and the further
sum of One Dollar( *1.00) for costs, and the Chief of Police and Ex-
Officio Tax Collector shall proceed with such execution in the same
manner as now provided by law in such cases of execution lodged with
the Sheriff of Chatham County.
SECTION 2. Every person who shall pay one -half () of his tax-
es on or before the 15th day of May, 1949, and the balance of said
taxds on or before the 15th day of November, 1949, shall be intitled
to a deduction of ten (10) per cent on account thereof, and the Clerk
of Council and Ex- Officio Treasurer of said Town is hereby authorized
to make such deduction upon receipt of tax. The provisions of this

Section shall not apply to licenses for doing business in said Town
the rate for such licenses being net. The provisions of this Section
shall apply, however, to those persons or companies required by the
provisions of Section 92 -5902 of the Code of Georgia to make returns
to the Comptroller General of Georgia.
SECTION 3. This ordinance shall continue in dffect for each
and every fiscal year hereafter unless and until repealed or chang-
ed by ordinance.
• SECTION 4. All ordinances or parts of ordinances conflicting
with the provisions of this ordinance are hereby repealed; provided,
however, tha.t'so much and such parts of ordinances passed as provided
for the execution of tax assessments, or part thereof, shall continue
and remain in force so as to authorize the Clerk of Council and Ex-
Officio Treasurer to issue executions and the Chief of police and
Ex Officio Tax Collector to collect same until said taxes or assess-
ments shall be fully paid.

ORDINANCE_
AN ORDINANCE TO PROVIDE FOR THE RATE OF LICENSES FOR DOING
B3USINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GA.,
FOR THE FISCAL YEAR ENDING APRIL 39th, 1950; FIXING PENALTIES
FOR THE VIOLATION; AND FOR OTHER PURPOSES.
SECTION 1. Be it ordained by the Mayor and Councilmen of the
Town of Savannah Beach, Tybee Island, Georgia, in Council assembled,
and it is hereby ordained by the authority of the same, that the
licenses for doing business in the Town of Savannah Beach, Tybee
Island, Georgia, for the fiscal year ending April 30th, 1950, shall
be payable on or before the commencing of such business and shall
be as follows;.■
Each and every keeper ingaged in the business of renting to trans -
ient'guests of an apartment house or building, containing four or
more apartments, or a tourist court or camp, each dwelling unit
$3.00, with a minimum license of $ 35.00
Every keeper or keepers of a hotel or rooming house that contains

SECTION 2. In the event any business or calling not specifically
mentioned in the above list set forth shall be established in the
Town of Savannah Beach, Tybee Island, Georgia., the Mayor and Council-
men reserve the right to establish a license fee for same by or-
dinance, which fee is to be of .equal dignity as the license speci-
fically mentioned in the above Section, provided, however, that
such license shall not be more than the sum of Five Hundred Dollars,
($500.00).
SECTION 3. This ordinance shall be subject to alteration or
repeal in whole or in part at any time during the fiscal year be-
ginning May lst, 1949, should it be deemed advisable, and no such
amendment or repeal shall be construed to impair the right of
Council to assess or levy tax for the whole of such year when ever
made.
SECTION 4. Any person, firm or corporation owning or operat-
ing any racing devices, or passenger vehicles for hire, before be-
ing issued a license, therefor shall deposit with the Clerk of
Council a policy of insurance against personal injury and property
damage, with a receipt showing that the premium thereon has been
paid for the length of time covered by the license, in such Co. and
in such amount as may be approved by the mayor and Councilmen, for
the benefit of any person or persons who may be killed or injured
or sustain damage to property by reason of the operation thereof.

SECTION 4 -A In lieu of such policy of insurance, any person
firm or corporation owning or operating passenger vehicles for hire,
before being issued a license thereof, shall deposit with the Clerk
of Council a surety bond in the amount of Five Thousand Dollars,
($5,000.00) for each vehicle operated by said person, firm or cor-
poration, signed by a surety company acceptable to the Mayor and
Councilmen of Savannah Beach, Tybee Island, Georgia, said bond guar-
anteeing the payment of any loss or damages sustained any person
or persons by reason of the operation of such vehicle, the exact
form of such bond to be approved by the Mayor and Councilmen of
Savannah Beach.
SECTION 4 -B In lieu of such policy of insurance and /or such
surety bond, any person, firm or corporation owning or operating a
passenger vehicle for hire, before being issued a license therefore,
shall deposit with the Clerk of Council a real estate bond in the
amount of Five Thousand Dollars (t5000.00) for each vehicle operated
by said person, firm or corporation, signed by an owner of real es-
tate who holds merchantable fee simple title to the same and accept-
able to the Mayor and Councilmen of Savannah Beach, said bond guar-
antees the payneent of any loss or damage sustained by any person
or persons by reason of the operation of such vehicle, the exact
form of such bond to be approved by the Mayor and Councilmen of
Savannah Beach. If said real estate bond is approved by the Mayor
and Councilmen of Savannah Beach, the applicant for license shall
pay the fee for recording os said bond in the Clerk's office of the
Superior Court of Chatham County, Georgia.
SECTION 5. The Mayor and Councilmen reserve the right to re-
fuse to-issue to any one any licenses for any purpose for reasons
sufficient by them.
SECTION 6. Any person procuring a license on or after Novem-
ber 1, 1949, shall pay one-half the fee therefor set forth in this
Ordinance.
SECTION 7. Any person, firm or corporation violating any of
the provisions of Section 1 of this Ordinance shall, upon conviction
before the Mayor's Court of said Town, be subject to be fined in the
sum of not more than One Hundred Dollars (4100.00) or be imprisoned
not more than thirty days, either or both or any portion of either or
both in the discretion of the Court.
SECTION 8. All Ordinances or parts of Ordinances conflicting
with the provisions of this Ordinance are hereby repealed.
Councilman peters moved that the following Resolution be
adopted, Councilman Lovell seconded and the motion passed.
A RESOLUTION
WHEREAS, the Town of Savannah Beach, Tybee Island, Georgia,
at a meeting held June 17, 1948, adopted a resolution to sell to
Mr. John C. Wylly the property known as public Alley No. 1 in the
Town of Savannah Beach lying between Chatham Avenue and the Inlet,

at and for the consideration of Two Thousand Five Hundred Dollars
($2,500.00), and,
WHEREAS, said property, which consisted of a part of the
public domain of the Town of Savannah Beach, was conveyed to the
said John C. Wylly by deed dated July 15, 1948, filed for record
on July 17, 1948, and recorded in the Clerk's Office of the Super-
ior Court of Chatham County, Georgia, in Record Book 47 D, Folio 461,
and,
WHEREAS, the Town of Savannah Beach, Tybee Island, Georgia,
in a special meeting held August , 1949, adopted a Resolution
that said sale was made to John C. Wylly through misapprehension
and constitutes both mistake of law and fact and should be rescinded
and the property reconveyed to the municipality and the purchase
price refunded to the purchaser.
WHEREAS, John C. Wylly was tendered the amount of the purchase
price and requested to execute a deed conveying the property to the
municipality but he refused. Since this time, litigation in the Super-
ior Court of Chatham County, Georgia, resulted in a temporary injunc-
tion being granted which nullified said conveyance. This decision was
affirmed by the Supreme Court of Georgia.
NOW, THEREFORE, BE IT RESOLVED, THAT the Attorney for the
Town of Savannah Beach be and he is hereby authorized to return
the sum of $2500.00to John C. Wylly and secure a conveyance of the
property to the municipality end take such other steps as he may
deem proper and necessary to affect the purpose of this said Reso-
lution.
Councilman Young moved that the following Ordinance be adopt-
ed, Councilman Peters seconded and the motion passed.
AN ORDINANCE
AMENDING AN ORDINANCE ENTITLED "TO PROVIDE FOR THE
APPOINT}ENT OF A BUILDING INSPECTOR FOR SAVANNAH BEACH,
TYBEE ISLAND, GEORGIA; TO DEFINE HIS DUTIES; TO PROVIDE
FOR THE ISSUANCE OF BUILDING PERMITS; TO PROVIDE RULES
AND REGULATIONS FOR THE ERECTION, ALTERATION AND REPAIR
OF ALL BUILDINGS IN SAID TOWN; TO PRESCRIBE PENALTIES
FOR THE VIOLATION THEREOF; AND FOR OTHER PURPOSES.
SECTION 1. Be it ordained by the Mayor and Councilmen by the
Town of Savannah Beach, Tybee Island, Georgia, in Council assembled
and it is hereby ordained by the authority of the same that an Or-
dinance adopted by the said Meyor and Councilmen intitled "To pro-
vide for the appointment of a building inspector for Savannah Beach,
Tybee Island; to define his duties; to provide for the issuance of
building permits; to provide rules and regulations for the erection
alteration and repair of ell buildings in said town; to prescribe
penalties for the violation thereof; and for other purposes ;, be
and the same is hereby amended by striking therefrom the last para-
graph of Section 6 of said Ordinance, "Footings for continous wails
of concrete, concrete block, tile, brick or stone shall be twenty
(20) inches below natural grade, twenty -four (24) inches wide and

twelve (12) inches thick for supporting walls not over ten (10) feet
in height. Walls over ten (10) feet in height to have footings thir-
ty (30) inches wide and fourteen (14) inches thick. All footings shall
be of concrete as specified in preceding paragraph for pier footings,
and inserting in lieu thereof the following paragraph, "Footings for
continous walls of concrete, concrete block, tile, brick or stone
shall be at least twenty (20) inches below grade and to project at
least four (4) inches on each side of wall and to be at least eight
(8) inches thick for walls not over ten (10) feet in height. Walls
over ten (10) feet, footing to be at least twelve (12) inches thick.
However, footings for walls over ten (10) -feet in height may be of
the same thickness as for less than ten (10) feet providing they are
re- inforced with at least 2 5/8 re- inforcing irons spaced on 8 inch
centers ", so that said paragraph of Section 6 of said Ordinance
shall read as follows:
"Footings for continous walls of concrete, concrete block,

grade and to project at least four (4) inches on each side of wall
and to be at least eight (8) inches thick for walls not over ten
(10) feet in height. Walls over ten (10) feet, footing to project
at least six (6) inches on each side of wall and to be at least 12
inches thick. However, footings for walls over ten feet in height
may be of the same thickness as for less than ten feet providing
they ar re- inforced with at least 2 5/8 re- inforcing irons spaced
on 8 inch centers,"
SECTION 2. Be it, further, ordained by the Mayor and Council-
men of the Town of Savannah Beach, Tybee Island in Council assembled
and it is hereby ordained by the authority of the same that the Or-
dinance referred to in Section 1 of this said Ordinance, be and the
same is hereby, further, amemded by striking therefrom the paragraph
in Section 8 relating to ceiling joists, to -wit, "Ceiling joists
shall be not less than two by six (2x6) inches where span does not
exceed twelve (12) feet, over this span shall be not less than two
by eight (2x8) inches", and inserting in lieu thereof the following
paragraph, "Ceiling joists shall be not less than two by six (2x6)
inches where span does not exceed fourteen (14) feet, over this span
shall be not less than two by eight (2x8) inches ", and by amending
the paragraph in Section 8, to -wit, "Rafters on garages or small .
outbuildings where the span does not exceed eight (8) feet may be
of two by four (2x4) omches when approved by the Building Inspector"
by adding thereto the following sentence, "Framing on garages and
small outbuildings may be laid on twenty -four (24) inch centers ",
so that those portions of said Section S of said Ordinance will read
as follows:
"Ceiling joists shall be not less than two by six (2x6)
inches where span does not exceed fourteen (14) feet, over this
span shall be not less than two by eight (2x8) inches".
"Rafters on garages or saall outbuildings where the span
does not exceed eight (8) feet may be of two by four (2x4) inches
when approved by the Building Inspector ".
HFraming on garages and small outbuildings may be. laid on
twenty-four (24) inch centers“.
Councilman Young moved that the following Resolution be
adopted, Councilman peters seconded and the motion passed.
A RESOLUTION
WHMREA5, in order to pay the expenses of the Mayor and Coun-
cilmerv:of the Town of Savannah Beach for the calendar year, 1949, it
is necessary to make a temporary loan of 120,000.00; and.
WHEREAS, the total gross income of the Mayor and Councilmen
of the Town of Savannah Bench for the year 1948 collected amounted
to $83,947.00; and
WHEREAS, there is no lean to said Mayor and Councilmen now
unpaid which was made under the provisions of Paragraph 1V, Section
Vil, Article Vil, of the Constitution of the State of Georgia; and
WHEREAS, the total anticipated revenue of the Mayor and
Councilmen of the Town of Savannah Beach for the calendar year 1949
is $93,500.00 and the aggregate of this proposed temporary loan, and
other contracts or obligations for current expenses, is not in excess
of such total anticipated revenue for the calendar year 1949; and
WHEREAS, The Savannah Rank & Trust Company has agreed to
make a temporary loan to the said Mayor end Councilmen of $20,000.00
peylble en the 31st day of December, 1949, with interest thereon at
the rate of 4% per annum; it being a condition of said loan by said
bank that the proceeds of said loan shall be used only to erect a
bulkhead and groin between 1st Street and Tilton Street at Savannah
Beach, Georgia.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Coungilmen
of the Town of Savannah Beach in Council assembled that the Mayor
and. Councilmen of the Town of Savannah Beach procure from SaVannah
Bank & Trust Company a temporary loan in the amount of 120,000.00
payeble on the 31st day of December, 1949, and bearing interest at
the rate of 4% per annum. Said loan shall also be payable, at the
option of said Mayor and Councilmen, in whole or in part at any
time between the effecting of said loan and the 3lat day of December,
1949, with full abatement of interest on the part of principal so
paid.
BE IT FURTHER RESOLVED that the proceeds of said loan shall
be used only to erect a bulkhead and groin between 1st Street and
Tilton Streets.
BE IT, FURTHER, RESOLVED that the Honorable Edward. A. Dutton,
Mayor, of the Mayor and Councilmen of the Town of Savannah Beabh,
Tybee Island, Georgie, or the then acting Mayor, is hereby author-
ized and directed to execute the necessary promissory agreement or

or agreements with said bank and the Clerk of Council is hereby
authorized and directed to attest the signature of the mayor , or
Acting Mayor, and affix to said instruments the official seal of
the Town of Savannah Beach, Tybee Island, Georgia.
