S. Brothers, Inc. $594,141.88 2. Black Rock Enterprises, LLC $668,137.68 3. Seacoast Construction, Inc., $678,556.00 4. AA Berms, LLC $713,936.00 5. Berto Construction, Inc. $1,012,374.00 WHEREAS, Brothers, Inc., of South River, NJ has submitted the lowest bid for said contract as evidenced by the response on file with the Borough's Purchasing Department and with the Borough Engineer; and WHEREAS, the Borough Engineer has reviewed the above bid proposals and has recommended the award of a contract to S. Brothers, Inc., in a total amount not to exceed $594,141.88, per attached award letter; and WHEREAS, the Chief Financial Officer has certified that fimds are or will be avai able for said purpose. Brothers, Inc., of South River, NJ for the Project for the sum of $594,141.88 in accordance in all respects with the request for proposals and bid on same. 2. That a copy of this Resolution shall be forwarded to the Borough's Purchasing Department, the Borough's Consulting Engineers CME Associates and the Borough's Director of Engineering. 3. That the aforementioned award of bid is contingent upon formal approval from the New Jersey Department of Labor, Division of Wage and Hour Compliance. 4. That the aforementioned award of bid is subject to review and approval by the NJDOT Local Aid, District III Office and the Borough Attorney. A total of five (5) bids were submitted, ranging from an apparent low bid of $594,141.88 by S. Brothers, Inc. to a high base bid of $1,012,374.00 by Berto Construction, Inc. Brothers, Inc. is the lowest responsible bidder. While there were irregularities present in other bids submitted, we found that they were minor in nature and the outcome of the bid was not affected. As a matter of procedure, our office has contacted S. Brothers, Inc. to discuss their bid. The representatives we spoke to indicated they are comfortable with the bid as submitted and there is no objection to completing the project based on the bid prices submitted and the contract time. Based on this information, we recommend the following actions: 1. Award of the contract to the low bidder, S. Brothers, Inc., P.O. Box 317, South River, NJ 08882 within 60 calendar days, on a unit price basis in the total amount of $594,141.88 for Bid Items 1 through 18, as available funding permits.
