A RESOLUTION OF THE CITY COUNCIL FO THE CITY OF LYNWOOD TO
EXEMPT THE FOLLOWING CLASSIFICATIONS: ASSISTANT CITY
MANAGER/FINANCE, DIRECTOR OF HUMAN RESOURCES, DIRECTOR OF
ENVIRONMENTAL SERVICES/CITY ENGINEER, DIRECTOR OF
REDEVELOPMENT AND MARKETING AND GRANTS MANAGER FROM THE
PERSONNEL SYSTEM
WHEREAS, The City of Lynwood is authorized by Government Code
section 45001 to adopt an ordinance establishing a personnel system for the
selection, employment, classification, advancement, suspension, discharge, and
retirement of appointive officers and employees; and
WHEREAS, The City of Lynwood established a personnel system by
passing Ordinance No. 671 and No. 728; and
WHEREAS, The City of Lynwood passed Ordinance No. 1178 relating to
exemptions from the personnel system on September 7, 1982; and
WHEREAS, Ordinance No. 1178 provides that other offices; positions,
and employment in the service of the City as may from time to time be specified
by resolution of the City Council to be exempt from the coverage of classified
service; and
WHEREAS, Section 18-3.2 of the Lynwood Municipal Code provides for
the City Manager and City Council to set a position and compensation plan; and
WHEREAS, Section 18~9 of the Lynwood Municipal Code provides for the
City Manager and City Council to set a position and compensation plan; and
WHEREAS, the positions of Assistant City Manager/Finance, Director of
Human Resources, Director of Environmental Services/City Engineer, Director of
Redevelopment and Marketing and grants Manager are highly specialized
positions requiring greater experience and technical knowledge; and
WHEREAS, the City Council of the City of Lynwood has determined that
to successfully recruit qualified candidates it is necessary that the positions of
Assistant City Manager/Finance, Director of Human Resources, Director of
Environmental Services/City Engineer, Director of Redevelopment and Marketing
and Grants Manager be executive positions not subject to the personnel rules;
and
WHEREAS, removing the positions of Assistant City Manager/Finance,
Director of Human Resources, Director of Environmental Services/City Engineer,
Director of Redevelopment and Marketing and Grants Manager from the
personnel system will enable the City of Lynwood to recruit qualified individuals;
and
WHEREAS, the positions of Assistant City Manager/Finance, Director of
Human Resources, Director of Environmental Services/City Engineer, Director of
Redevelopment and Marketing and Grants Manager work closely with the City
Council and City Manager of the City of Lynwood; and
WHEREAS, it is necessary that the City Manager, City Council have
authority to ensure that the positions of Assistant City Manager/Finance, Director
of Human Resources, Director of Environmental Services/City Engineer, Director
of Redevelopment and Marketing and Grants Manager carry out its directions
appropriately; and
WHEREAS, the positions of Assistant City Manager/Finance, Director of
Human Resources, Director of Environmental Services/City Engineer, Director of
Redevelopment and Marketing and Grants require a working relationship
different than that other line staff positions and as such should be exempt from
the personnel system; and
WHEREAS, by making the positions of Assistant City Manager/Finance,
Director of Human Resources, Director of Environmental Services/City Engineer,
Director of Redevelopment and Marketing and Grants Manager exempt from the
personnel system, the City Council of the City of Lynwood will be able to recruit
and hire individuals as the needs change of both the City of Lynwood as well as
of the City Council.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF LYNWOOD, STATE OF CALIFORNIA, DOES HEREBY RESOLVE,
DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. The personnel system shall not apply to the positions of
Assistant City Manager/Finance, Director of Human Resources, Director of
Environmental Services/City Engineer, Director of Redevelopment and Marketing
and Grants Manager, as they are exempt.
Section 2. Appointments to the above positions will be made by the
Appointing Authority as defined in Section 18-9 of the Lynwood Municipal Code
with the compensation level to be set by the City Manager through an
employment contract.
Section 3. The above amendment shall be effective after adoption of
this RESOLUTION.
Section 4. The above amendment shall not be effective as to the
incumbents in said positions of the adoption date of this RESOLUTION.

the City Council of the City of Lynwood at a regular meeting held in the City Hall
of said City of the Z0th day of September ,2005, and passed by
the following vote:
