A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO NEGOTIATE
AND EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE
CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD RELATIVE
TO ONSITE WASTEWATER TREATMENT SYSTEMS
WHEREAS, Section 13260 of the California Water Code (CWC) requires any
person discharging waste or proposing to discharge waste that could affect the quality of waters
of the State, except to a community sewer system, to file a report of waste discharge with the
California Regional Water Quality Control Board (the Board) and to receive waste discharge
requirements from this agency; and
WHEREAS, Sections 13290 and 13291 of the CWC require the Board to
establish statewide standards for the regulation of certain onsite wastewater treatment systems
(OTWSs) and authorize the Board to delegate implementation of these standards to a Qualified
Local Agency (QLA); and
WHEREAS, said requirement being exempted by the Board since 1952 are now
required unless the City is designated as a QLA; and
WHEREAS, certain properties in the City of Lynwood have been identified to be
affected by these requirements; and
WHEREAS, the Board requires the City to sign a Memorandum of
Understanding (MOU) in order to be designated as a QLA; and
QLA.
WHEREAS, the Lynwood City Council is desirous to have the City act as a
NOW, THEREFORE, the City Council of the City of Lynwood does hereby
find, proclaim, order and resolve as follows:
Section 1: That the City Manager or his designee is authorized to negotiate and
sign a MOU with the Board relative to OWTS.
Section 2: This resolution shall take effect immediately upon its adoption.
