A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
CERTIFYING THE MITIGATED NEGATIVE DECLARATION, APPROVING THE
MITIGATION MONITORING AND REPORTING PROGRAM, AND APPROVING
GENERAL PLAN AMENDMENT NO. 2018-01, CHANGING THE LAND USE
DESIGNATION FROM SENIOR CITIZEN HOUSING DEVELOPMENT TO
RESIDENTIAL-HIGH DENSITY AND GENERAL PLAN MAP ON ASSESSOR
PARCEL NUMBERS 6186-001-900, 6186-001-901, 6186-001-902, 6186-001-903,
6186-001-904, 6186-001-905, 6186-001-906, 6186-001-907, 6186-001-908, AND
6186-001-909 IN THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE
OF CALIFORNIA
WHEREAS, the City of Lynwood filed Application General Plan Amendment
2018-01 and Zoning Code Amendment 2018-01, which shall not be approved unless
the Final Mitigated Negative Declaration is certified and approved; and
WHEREAS, the applications for General Plan Amendment 2018-01 and Zoning
Code Amendment 2018-01 have been evaluated in accordance with established City of
Lynwood procedures, and with consideration of the General Plan and Municipal Code;
and
WHEREAS, an Initial Study, supporting technical studies, and Mitigated Negative
Declaration have been prepared for General Plan Amendment 2018-01 and Zoning
Code Amendment 2018-01 consistent with the California Environmental Quality Act and
based on a thorough analysis of potential environmental impacts. The Mitigated
Negative Declaration represents the City of Lynwood's independent judgment and
analysis; and
WHEREAS, the Mitigated Negative Declaration has been considered by the City
Council and there is no evidence that the proposed General Plan Amendment or Zoning
Code Amendment will have a significant impact on public health or be materially
injurious to surrounding properties of the environment as a whole; and
WHEREAS, a 30-day public review period of the Initial Study and Mitigated
Negative Declaration commenced on July 26, 2018 and concluded on August 26, 2018.
The public Notice of Intent to adopt the Mitigated Negative Declaration was mailed to
interested parties, public agencies as well as published in the Long Beach Press
Telegram on July 26, 2018 and filed with the Los Angeles County Clerk; and
WHEREAS, the City of Lynwood, in conducting its own independent analysis of
the Final Mitigated Negative Declaration, determined that a Mitigated Negative
Declaration is an appropriate environmental determination for General Plan Amendment
2018-01 and Zoning Code Amendment 2018-01 as there is substantial evidence that
demonstrates the Project with mitigation would not result in any significant
environmental impacts; and
WHEREAS, a Mitigation Monitoring and Reporting Program has been prepared
in accordance with California Environmental Quality Act Guidelines, and is designed to
ensure compliance with the identified mitigation measures outlined in the Final Mitigated
Negative Declaration through project implementation; and
WHEREAS, the City of Lynwood, Planning Division, located at 11330 Bullis
Road, Lynwood, California is the custodian of documents and other materials that
constitute the record of proceedings upon which the decision to adopt the Mitigated
Negative Declaration is based; and
WHEREAS, the City of Lynwood Planning Commission reviewed all
environmental documentation for General Plan Amendment 2018-01 and Zoning Code
Amendment 2018-01 and recommended that the City of Lynwood City Council adopt a
Mitigated Negative Declaration and approve the Mitigation Monitoring and Reporting
Program for General Plan Amendment 2018-01 and Zoning Code Amendment 2018-01;
and
WHEREAS, the City of Lynwood City Council considered the Initial Study
prepared for General Plan Amendment 2018-01 and Zoning Code Amendment 2018-01
for the purpose of compliance with the California Environmental Quality Act, and based
on the Initial Study including all supporting technical evidence, it was determined that
General Plan Amendment 2018-01 and Zoning Code Amendment 2018-01 impacts are
expected to be less than significant with mitigation, and approval of a Mitigated
Negative Declaration is an appropriate environmental determination for General Plan
Amendment 2018-01 and Zoning Code Amendment 2018-01; and
WHEREAS, the City Council of the City of Lynwood held a public hearing on
September 4, 2018 to consider General Plan Amendment 2018-01, Zoning Code
Amendment 2018-01, and all environmental documentation prepared for The project;
and
WHEREAS, the public hearing notice for this project was published in the local
newspaper on August 23, 2018. Public notice was sent to all property owners of record
within 300 feet of the project site on August 23, 2018; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred; and
NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY RESOLVE AND DETERMINE AS FOLLOWS:
Section 1. The City Council hereby specifically finds that all of the facts set for
above in this Resolution are true and correct.
Section 2. Independent Judgment and Analysis —City of Lynwood staff
coordinated preparation of the Initial Study/Mitigated Negative Declaration and related
technical studies for General Plan Amendment 2018-01 and Zoning Code Amendment
2018-01. The documents were properly circulated for public review in accordance with
the California Environmental Quality Act Guidelines. The Mitigated Negative
Declaration/Initial Study has been completed along with the Mitigation Monitoring and
Reporting Program to ensure compliance with all mitigation through future project
implementation. All environmental documents that comprise the Mitigated Negative
Declaration, including all technical studies, were independently reviewed by the City of
Lynwood. On the basis of the whole record, there is no substantial evidence that
General Plan Amendment 2018-01 and Zoning Code Amendment 2018-01, conditioned
and mitigated, will have a significant effect on the environment. The Mitigated Negative
Declaration prepared and completed, in accordance with California Environmental
Quality Act Guidelines, reflects the independent judgment and analysis of the City of
Lynwood.
Section 3. Based upon substantial evidence presented to this City Council
during the above referenced meeting on September 4, 2018, including written and oral
staff reports, public testimony and the record from the public hearing, this City Council
hereby specifically finds as follows:
A. The proposed General Plan Amendment and Zoning Code Amendment are in
the public interest, and that there will be a community benefit resulting from
the amendment.
FACT:Approval of the proposed General Plan Amendment and Zoning Code
Amendment will enable establishment of a beneficial community use on what is
now, and has been for some time, a vacant and unused property. The General
Plan Amendment and Zoning Code Amendment will enable a future application
for an affordable housing project that will help to satisfy a portion of the assigned
RHNA allocation for the City. Provision of housing affordable to low- and
moderate-income households will provide new residential opportunities for
families in need of such housing.
B. The proposed General Plan Amendment and Zoning Code Amendment are
consistent with the goals, policies, and objectives of the general plan
FACT: The proposed General Plan Amendment and Zoning Code Amendment
will facilitate future provision of housing opportunities for low- and moderate-
income households. In addition, the proposed General Plan Amendment
complies with General Plan Land Use Element and Housing Element goals and
. policies that pertain to the following: further enabling the City to plan for a
diversity of residential opportunities that will help to fit current and future housing
needs of potential Lynwood residents (Land Use Element Goal LU-1); allowing
development of apartments within the Residential High Density land use category
(Land Use Element Policy LU-1-5); encouraging a variety of housing types to
meet needs of City residents (Housing Element Goal 2); identification of suitable
sites to accommodate the City's 2014-2021 Regional Housing Needs
(Assessment) Allocation (Housing Element Policy 2.1); supporting innovative
public, private and non-profit partnership efforts for development of affordable
housing (Housing Policy 2.4); continuing to provide appropriate land use
designations and maintain an inventory of suitable sites for residential
development (Housing Element Objective 2.1); encouraging private development
of moderate and lower-income housing units (Housing Element Objective 2.2);
encouraging private development of housing units with three or more units that
can accommodate large households (Housing Element Objective 2.3); and,
promoting Fair Housing opportunities for all persons regardless of race, religion,
sex, marital status, ancestry, national origin or color (Housing Element Goal 5).
Goal 2 of the City's Housing Element states the City shall "assist in the
development of adequate housing to meet the needs of low-and moderate-
income households".
Goal 3 of the City's Housing Element states the City shall "identify adequate
housing sites which will be made available through appropriate zoning and
development standards and with public services and facilities needed to facilitate
and encourage the development of a variety of types of housing for all income
groups".
Establishment of an affordable housing use achieves the General Plan Goal of
providing a balanced and functional mix of land uses, which takes advantage of
the unique position of Lynwood in relation to the region. In addition, the
proposed affordable housing use would fulfill the City's goal of planning for new
patterns of land uses that complement the overall character of existing uses, and
which offer opportunities for compatible development of vacant and underutilized
parcels. As stated previously, the proposed project site is vacant. Also, future
establishment of an affordable multi-family residential development on the
property would ensure that future residents of the Project site would enjoy direct
access to commercial retail establishments, the Yvonne Burke Ham Park, the
Metro Route 120 that proceeds along Atlantic Avenue, and the Lynwood Route B
trolley (that proceeds along Atlantic Avenue and through the eastern part of
Lynwood).
C. The proposed General Plan Amendment will not conflict with provisions of the
zoning code, subdivision regulations, or any applicable specific plan.
FACT: The proposed General Plan Amendment will facilitate future
development of multi-family housing for low- and moderate-income
households. The current zoning for the Project site provides for multi-family
(Residential High Density) residential use. The General Plan Amendment will
indicate that affordable housing will be a specifically allowed use in the
Residential High Density land use category. Any future discretionary
application for affordable multi-family development on the Project site will be
subject to Site Plan Review, which will address all Project design features.
The Project sitels not located within a specific plan area.
D. The amendment will not adversely affect surrounding properties
The proposed General Plan Amendment will not adversely affect surrounding
properties. The existing General Plan Land Use designation for the Project
site is Senior Citizen Housing Development. The General Plan Amendment
will reclassify the designation to Multi-Family Housing, which will maintain an
allowance for senior affordable housing but also include non-senior affordable
housing as an allowed land use for the Project site. Surrounding commercial,
recreational and residential properties will not experience any substantial
adverse impact as a result of maintaining the site as designated for affordable
multi-family housing.
Section 4. The City Council hereby CERTIFIES the Mitigated Negative
Declaration and APPROVES the mitigation monitoring and Reporting Program.
Section 5. The City Council hereby APPROVES General Plan Amendment
2018-01 and, based on the findings contained in this Resolution, the General Plan Map
attached hereto as Exhibit A.
Section 6. This resolution shall be effective immediately upon its adoption.
Section 7. The City Clerk shall certify to the adoption of this resolution and
hereafter the same shall be in full force and effect.
