REJECTING BIDS AND AUTHORIZING A NEGOTIATED CONTRACT FOR
VENDING MACHINE CONCESSION SERVICES
WHEREAS, the Borough of Carteret has previously solicited and received bids for the
Vending Machine Concession Services pursuant to N.J.S.A.40A:11-4 of the Local Public
Contracts Law on two occasions; and
WHEREAS, no bid proposals were received on the first occasion; and
WHEREAS, the bid proposal received on the second occasion is hereby being rejected
upon the determination by the Borough Law Director that such bid is not in conformance
with the bid specifications; and
WHEREAS, the Borough Council has now on two occasions advertised and rejected all
bids received for the above referenced project upon a determination and recommendation
of the Borough Law Director that such bids are not reasonable as to price.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey as follows:
1. That the most current bid proposal received for the Vending Machine
Concession Services is hereby rejected and the appropriate Borough
Officials are authorized to take the necessary action to effectuate the same
including the return of any bid bonds that may be required.
2. That the Mayor and/or appropriate Borough Officials are hereby
authorized to negotiate a contract for the Vending Machine Concession
Services pursuant to N.J.S.A.40A:11-5(3) of the Local Public Contracts
Law.
