APPROVING PROGRESS PAYMENT ESTIMATE
NO. 2 & CHANGE ORDER #1
WHITTIER STREET AREA IMPROVEMENTS
WHEREAS, the Governing Body of the Borough of Careref has previously awarded a contract to S.
Brothers, Inc., in the amount of $774,582.06 for the Whittier Street Area improvements; and
WHEREAS, the Borough's Consulting Engineer for the project, CME Associates, has advised the
Governing Body that a modification of the contract is reasonable and necessary and has recommended that
the aforesaid contract be modified in accordance with Progress Payment Estimate 92 & Change Order #1
(see attached); and
WHEREAS, Progress Payment Estimate No. 2 & Change Order #I include a change in the description of
work and/or to decrease quantities to reflect as -built conditions, and to provide for certain supplementary
items; and
WHEREAS, Change Order #1 provides for a net increase in lire contract price in the amount of
$151,083.79, resulting in a revised contract price of $925,665.79 including all previously approved change
orders; and
WHEREAS, the Borough's Consulting Engineer, CME Associates has advised that the above described
changes and/or modifications to the project were unforeseen at the time of the award of the original
contract. Acct. # C-04-23-103-201
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as
follows:
1. That Progress Payment Estimate No. 2 & Change Order 41 attached hereto and
made a part hereof, resulting in a net increase of $151,083.79 and resulting in a
revised contract price of $925,665.79 is hereby approved.
2. That the appropriate Borough Officials are hereby authorized to execute
Progress Payment Estimate No. 2 & Change Order #1 and issue payment
thereon, based upon the recommendation of the Borough Engineer and subject
to adomeys review of the maintenance bond.
3. A copy of this resolution and a fully executed copy of Progress Payment
Estimate No. 2 & Change Order #1 be forwarded to the Borough's Purchasing
Department and CME Associates for distribution to S. Brothers, Inc.

Dear Ms. Pogorzelski:
Enclosed for your review and further handling, please find Progress Payment Estimate No. 2 and Change
Order No. 1 for the above -referenced project, as approved by this office. This estimate is in the amount
of $166,041.36 for work completed through November 7, 2023 by the Contractor, S. Brothers, Inc. Work
includes concrete curb, concrete sidewalk, hot mix asphalt surface course and associated work.
The change order reflects increases and decreases in original contract quantities required to complete
the project. The increases in quantities could not, in our opinion, have reasonably been effectuated by a
separately bid contract without unduly disrupting work and imposing adverse consequences on the
Borough and will provide an improved level of service to residents.
The Change Order results in an increase in the project cost from the original contract amount of
$774,582.00 to an adjusted total of $925,665.79 for an increase of $151,083.79. Certified Payroll Records
and Manning Reports are submitted by the contractor under separate cover.
