Account# 3-01-20-165-25 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. That the proposal from CME Associates for Professional Land Surveying and Engineering Services with regard to Block 102, Lot 5.02, Southern Riverwalk Public Access Improvements at a total cost not to exceed .$30,000.00, billable in accordance with CME's existing contract with the Borough, is hereby approved. 2. That this action is approved as an award of a professional services contract pursuant to N.J.S.A. 40A:11-5(l)(a) in accordance with the Borough's Fair and Open Process'as authorized by law. 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department and CME Associates. HESS, PE, PP, CME Thank you for the opportunity to present our proposal for Professional Engineering services for the above -referenced project. Our office has previously prepared an outbound and topographic survey for the property that will be utilized in the following tasks. We understand that the Borough wishes to provide a new public access point to the recently completed Southern Riverwalk located within an easement on Lot 6.02, Block 102. This will include approximately ten (10) stalls within a paved parking area, concrete sidewalks, a timber access ramp and steps. The preliminary cost estimate for the work is approximately $226,000. It is anticipated that future improvements, including the FY22 NJDOT Transportation Alternatives Program (TAP) Rails to Trails Grant will connect this access point to Middlesex Avenue. With this being said, we anticipate the following scope of services: 1. Design Phase Services Under this task, CME will advance previously prepared surveying basemaps and concept plans for the proposed parking area and switchback to the southern terminus of the Riverwalk. It is anticipated that the extension of the boardwalk ramps will be completed with materials and finishes consistent with the existing improvements. The work in this phase will Involve the preparation of the necessary plans and bid documents for the permitting and public bid processes. Permitting Phase Services Work under this task will include the preparation of permit applications to outside agencies as required to implement the project. We anticipate the following approvals will be necessary for the project: a. Freehold Soil Conservation District Since the project will disturb more than 5,000 square feet of soil, a permit will be required from the Freehold Soil Conservation District (FSCD). b. New Jersey Department of Environmental Protection (NJDEP) Based on the location of the proposed parking area and ramp relative to the Arthur Kill and wetlands, it is anticipated that the following NJDEP Land Use regulations would be applicable to the improvements. Upland Waterfront Development Permit As the improvements will take place within 500 feet of the mean high water line, the work will require an Upland Waterfront Development Permit (WFD) and comply N.J.A.C. 7:7 Coastal Zone Management Rules. We proposed that the scope of work included in this application should include the installation of a pedestrian sidewalk along the southern side of the access road up to a point 500 feet from the MHW line to preclude future NJDEP permitting when the road accessing the site is improved. Reiman November 21, 2023 Southern Riverwalk Public Access Improvements Proposal No. 2023-214 Re: Proposal for Professional Land Surveying and Engineering Services Page 3 Wetlands Delineation Based on the New Jersey Department of Environmental Protection (NJDEP), GeoWeb online GIS resource, it appears that the proposed improvements will be located within freshwater wetlands and a wetland transition area. We will identify the disturbance area in the field and a portion of the wetlands, which will Include a delineation of the wetland/upland boundaries nearest to the improvements. The polygon will be established on the site, surrounding the proposed improvements and incorporating all areas of wetlands and wetlands transition areas that may be impacted by the project. CME will field delineate wetlands and/or State open waters, as appropriate, in the project area. All field work will be performed utilizing the methodologies outlined in the Federal Manual for Identifying and Delineating Jurisdictional Wetlands (1989), as required by the NJDEP under the Freshwater Wetlands Protection Act regulations. The wetland/upland boundaries will be determined based upon field examination of topography, hydrology, soils and vegetation characteristics at the site. All delineated wetlands will be.field surveyed for use in preparing a field survey of the regulated areas, Letter of Interpretation (LOI In order to verify if the location of the proposed improvements is within a wetland transition area, we will seek a line verification type of letter of interpretation (LOI). In order to keep the NJDEP application fees, survey work and environmental field work to a minimum, we are proposing the use of a partial LOI, as provided for within the Freshwater Wetlands Protection Act rules at NJAC 7:7A-4.5(b)2. This type of LOI allows the NJDEP to verify a wetland delineation for up to 10% of the total property area, which in this case is approximately 55 acres. The proposed location of the new parking area and boardwalk access appear to fit within an area that is significantly less than five (5) acres. Wetlands Special Activity Transition Area Waiver The disturbance required to develop the site will include clearing and grading within a 150-foot wide wetlands transition area. Based on historic aerials, this area appears to have been disturbed before 1989 and currently appears to be previously disturbed, minus some nuisance vegetation that has grown through gravel and debris. Based on this observation, we have confirmed with NJDEP personnel that this work would be classified as a redevelopment and would therefore qualify for a Special Activity Transition Area Waiver under N.J.A.C. 7:7A-8.3. During the permitting process, our office will confirm this with NJDEP Land Use officials and proceed accordingly. 3. Bid Phase Services This phase will include the following services to publicly bid the project in accordance with the Local Public Contracts Law: 1. Provide Bid Documents to Prospective Bidders. 2. Provide Addenda for Clarification of Project Specifications, as needed. 3. Attend Bid Opening. 4. Analyze Responsible Bids and Recommend Contract Award. 4. Construction Phase Services Generally, we prefer to quote services for construction phase services upon the completion of the Bid Phase as the ultimate cost for our services will depend upon a number of factors including the final design, the contractor to whom the contract is awarded and the desired level of construction observation required. Following project award, we would be pleased to submit our quote for these services upon your request. Meetings, with the exception of the meetings included above, will be invoiced on an hourly basis, in accordance with the enclosed rate schedule. The above fee estimates are based on information provided to us by the Borough.
