AUTHORIZING A PROFESSIONAL ENGINEERING SERVICES CONTRACT
WITH CME ASSOCIATES, FEE ESTIMATE FOR
CARTE RE, AVENUE EXTENSION LITIGATION SERVICES
WHEREAS, the Borough of Carteret is in need of specialized engineering services in
connection with Carteret Avenue Extension Litigation Services; and _
WHEREAS, CME Associates, 1460'. Route 9 South, Howell, New Jersey 07731,
possesses the requisite experience and expertise to provide said services; and
WHEREAS, CME Associates has submitted a proposal to provide said services at a total
cost not to exceed $25,000.00; and
WHEREAS, the Mayor and the Council have reviewed said proposal; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be available
for said purpose. Aect. 4
NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the
Borough of Carteret, County of Middlesex, State of New Jersey, as follows:
The proposal from CME Associates for engineering services related to
Carteret Avenue Extension Litigation Services at a cost not to exceed
$25,000.00 is hereby approved.
2. .This action is approved as an award of a professional services contract
pursuant to N.J.S.A 40A:11-5(1)(a) in accordance with the Borough's Fair
and Open Process as authorized by law.
3. A copy of this Resolution be forwarded to the Borough's Purchasing
Department, the Borough Director of Engineering and CME Associates.

Dear Mayor:
We are pleased to have the opportunity to present our fee estimate to support the Borough's
continued development of the Carteret Avenue Extension. This fee estimate outlines the scope
and costs of services necessary for CME Associates to provide consulting and engineering
services to support ongoing litigation between the Borough and involved property owners.
CME Associates has provided ongoing coordination services alongside the Borough's
redevelopment attorney, McManimon, Scotland & Baumann throughout the property acquisition
process. This has included meetings the Defendant's counsel and professionals, responding to
motions filed by the Defendant's attorney, and providing depositions and professional testimony.
Following the Middlesex County Court's ruling in favor of the Borough to proceed with the
condemnation, we understand the Defendant has since filed an appeal on the decision.
Our office is currently in receipt of the most recent filing from the defendant dated November 14,
2023 which includes a substantial listing of access and facilities relocations, and security concerns
which we are currently reviewing. With this being said, we propose the following scope of services
to support the continuing litigation:
Litigation Services:
1. Review and develop responses to engineering concerns raised by the Defendant in
coordination with the Borough's counsel;
2. Prepare relocation plan addressing existing site infrastructure identified by the property owner
and Borough for discussion and proceedings with the Defendant;
3. Develop construction sequencing plans and a project schedule in coordination with the
Borough and Contractor to accommodate resident access, emergency access, and facility
relocations, and,
4. Prepare a 24"x36" street level perspective color rendering of the improvements.
