AUTHORIZING A PROFESSIONAL SERVICES CONTRACT WITH
FRIZELL GOLDMAN & SAMUELS / GARBAGE TRANSFER STATION
WHEREAS, the Mayor and Council, by Resolution No. 01-46, adopted on
February 1, 2001, did authorize the law firm of Frizell Goldman & Samuels to
represent the Borough of Carteret, in participation with other local municipalities,
in the matter of the Borough of Metuchen v. Union County Board of Chosen
Freeholders / Transfer Station; and
WHEREAS, the Borough has received a request from Frizell Goldman &
Samuels for additional funding over and above the funds previously authorized by
the resolution of the Mayor and Council, said additional funding to include
Carteret's one-third share of the required expert and consultant fees; and
WHEREAS, the Borough Attorney has reviewed this request and has
recommended that the additional funds be allocated to the firn~ of Frizell
Goldman & Samuels for legal services and expert and consultant fees; and
WHEREAS, the Municipal Finance Officer has certified that funds are or will be
available for said purposes.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret, County of Middlesex, State of New Jersey, as follows:
1. The laxv firm of Frizell Goldman & Samuels is hereby
authorized an additional sum for legal fees and expert and
consultant costs in the garbage transfer litigation and opposition in
the sum of $9,000.00. This initial amount is authorized in
accordance with the terms and conditions of Resolution No. 01-46,
authorized by the Mayor and Council on February 1,2001.
2. A copy of this resolution be for~varded to the Borough Finance
Department, Frizell Goldman & Samuels and the Borough
Attorney.
Adopted this 18th day of April, 2002
and certified as a true copy of the
original on April 19, 2002.
