AN ORDINANCE, vacating an easement for sewer purposes
recorded in Deed Book 2187, Pages 186-187 of the St. Louis County
Records, said easement being in part of vacated Burns Road in Sections
5 and 6, Township 45 North, Range 6 East; in part of Lot 13 of Tower
Hill, a subdivision according to the plat thereof as recorded in Plat Book
3, Page 107 of the City of St. Louis Records; and in part of Lot 10 of the
Subdivision of George W. Beirnes Estate, according to the plat thereof as
recorded in Plat Book 8, Page 151 of the City of St. Louis Records, in the
City of Olivette, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested
this District to vacate the subject easement, and this District has no
further use for said easement,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The easement for sewer purposes as recorded
in Deed Book 2187, Pages 186-187 of the St. Louis County Records, as
shown hachured on the attached “Sewer Easement Vacation Plat” and
marked Exhibit “A”, and made a part hereof, is hereby vacated
EXCEPTING THEREFROM any portion of the easements recorded in
Deed Book 12872, Pages 22-24 and Deed Book 4575, Page 482 of the St.
Louis County Records, in the City of Olivette, St. Louis County, Missouri.
Recorded in Deed Book 13081, Pages 2546-2549.
The foregoing Ordinance was adopted May 10, 2001 by the following vote
Ayes – T.W. Purcell, M.G. Reichert, M.C. Williams, A.J. Soukenik, J.W.
Siscel, and C.D. Seward.
Nays – None.
