HomeMy Public PortalAbout10992 O R D I N A N C E NO. 10992 AN ORDINANCE, authorizing the Executive Director and Secretary- Treasurer to lease certain real property of The Metropolitan St. Louis Sewer District, lying in St. Louis County, Missouri, to Tiber Neighborhood-Community Association, Inc. of St. Louis County, Missouri, and to execute a Lease Agreement upon the conditions hereinafter set out. WHEREAS, The Metropolitan St. Louis Sewer District owns certain real property in St. Louis County, Missouri, incident to its public functions and responsibilities, said property being the abandoned Affton Treatment Plant Property, and WHEREAS, Tiber Neighborhood-Community Association, Inc. has leased from Lessor said real property to be used as a community playground, and WHEREAS, Tiber Neighborhood-Community Association, Inc. is desirous of executing a new lease in order to continue the operations on said real property, and NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to Tiber Neighborhood-Community Association, Inc., upon the general terms and conditions hereinafter set forth, the following described real property: Beginning at the intersection of the Southerly line of Section 14, Township 44 North, Range 6 East, with the Southerly prolongation of the Westerly line of Forman Place, a Subdivision of St. Louis County, Missouri; thence North 85 degrees 44 minutes West along the Southerly line of said Section 14 a distance of one hundred twenty-one and sixty-eight hundredths (121.68) feet; thence North 4 degrees 16 minutes East, a distance of thirty (30) feet; thence North 43 degrees 01 minutes West, a distance of two hundred nineteen (219) feet; thence North 8 degrees 21 minutes West, a distance of one hundred fifty-nine and eight-tenths (159.8) feet; thence North 63 degrees 18 minutes East, a distance of ninety- eight and forty-five hundredths (98.45) feet; thence North 83 degrees 10 minutes East, a distance of two hundred nine and four tenths (209.4) feet; thence South 0 degrees 24 minutes West, a distance of four hundred twenty-seven and fifteen hundredths (427.15) feet to the point of beginning except twenty-five (25) foot strips reserved for roadway purposes along the Easterly and Southerly sides of said tract, said strips beginning Northerly from and Westerly from the first and last calls respectively, above described; containing 1.8 acres more or less. Section Two. The lease term shall commence on July 1, 2001 and continue for five (5) years to June 30, 2006, at the rental of One Dollar ($1.00) per year with five (5) one-year options to renew this lease upon the same terms and conditions. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized to execute in behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the office of the General Counsel of the District. The foregoing Ordinance was adopted June 14, 2001 by the following vote – Ayes – T.W. Purcell, M.G. Reichert, M.C. Williams, A.J. Soukenik, J.W. Siscel, and C.D. Seward. Nays – None.
