HomeMy Public PortalAbout11005ORDINANCE NO. 11005 AN ORDINANCE, appropriating Thirty Million Five Hundred Thousand Dollars ($30,500,000.00) from the Sanitary Replacement Fund of the District to pay the settlement and related costs for the District’s 1992 User Rate Class Action litigation. WHEREAS, the Director of Finance has certified that there is an unencumbered balance in the above-named fund sufficient to pay the obligation authorized herein, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The sum of Thirty Million Five Hundred Thousand Dollars ($30,500,000.00) is hereby appropriated from the Sanitary Replacement Fund of the District to pay the settlement and related costs for the District’s 1992 User Rate Class Action litigation. Section Two. This ordinance, being an appropriation ordinance, shall take effect on July 25, 2001 contingent upon an appeal of the subject litigation not being filed in the United States Supreme Court on or before July 24, 2001. The foregoing Ordinance was adopted July 9, 2001 by the following vote Ayes – T.W. Purcell, M.G. Reichert, M.C. Williams, A.J. Soukenik, J.W. Siscel, and C.D. Seward. Nays – None. Secretary-Treasurer
