ORDINANCE NO. 11018 AN ORDINANCE, appropriating Three Million Six Hundred Ninety-four
Thousand Dollars ($3,694,000.00) from the Operation, Maintenance and Construction
Improvement Fund of Black Creek for the purchase and demolition of certain real
property in the City of Maplewood, Missouri known in Hanley Industrial Court and
West Point Drive Phase I (DCBC-150) 98053, and authorizing the Executive Director
and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to
purchase and demolish said real property for flood mitigation purposes.
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Million Six Hundred Ninety-four
Thousand Dollars ($3,694,000.00) is hereby appropriated from the Operation
Maintenance and Construction Improvement Fund of Black Creek for the purchase and
demolition of certain real property in the City of Maplewood, Missouri in Hanley
Industrial Court and West Point Drive Phase I (DCBC – 150) 98053.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to purchase and
demolish certain real property in the City of Maplewood, Missouri for flood mitigation
purposes, for a total purchase price not to exceed Three Million Six Hundred Ninety-

four Dollars ($3,694,000.00), and real property being more particularly described as
follows:
The north 40 feet of Lot 22 in Block 1 of “West Point Subdivision” as recorded in Plat Book 20 Page 21 of the St. Louis County Records – Lot 31 in Block 1 and Lots 43, 34, 35, 36, 37, 22, 23, 24, 25, and 26 in Block 2 and Lots 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, and 20 in Block 3 of “West Point Subdivision No. 2” as recorded in Plat Book 21 Page 45 of the St. Louis County Records – Lots A, B, C, 31, 31, and 33 of “Resubdivision of Lots 27, 28, 29, 30, 31, 32, and 33, Block 2, West Point Subdivision No, 2” as recorded in Plat Book 98 Page 82 of the St. Louis County Records – Lots 20 and 21 in Block 2 of “A Resubdivision of a part of West Point Subdivision No. 2” as recorded in Plat Book 22 Page 46 of the St. Louis County Records.
Section Three. Upon the execution and delivery to the District of a
General Warranty Deeds in proper form conveying title to the above-described real
property to The Metropolitan St. Louis Sewer District, the Executive Director and
Secretary-Treasurer are hereby authorized to pay to the grantors a total sum not to
exceed Three Million Six Hundred Nine-four Thousand Dollars ($3,694,000.00) for said
real property.
Section Four. This ordinance, being an appropriation ordinance, shall
take effect immediately upon its enactment.
The foregoing Ordinance was adopted July 12, 2001 by the following vote
Ayes – T.W. Purcell, M.G. Reichert, C.D. Seward, A.J. Soukenik, J.W. Siscel, and
M.C. Williams.
Nays – None.
