AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a
contract with the Northeast Public Sewer District whereby The Metropolitan St.
Louis Sewer District will treat sanitary sewage from real property within the
jurisdiction of the Northeast Public Sewer District where the topography has
rendered it impractical and economically infeasible for said real property to
connect to the sanitary sewage system of the Northeast Public Sewer District,
and the Northeast Public Sewer District will treat sanitary sewage from real
property within the jurisdiction of The Metropolitan St. Louis Sewer District
where the topography has rendered it impractical and economically infeasible
for said real property to connect to the sanitary sewage system of The
Metropolitan St. Louis Sewer District.
WHEREAS, Section 3.020(7) of the Charter of The Metropolitan St. Louis
Sewer District empowers the District to contract with municipalities, districts,
other public agencies, individuals, or private corporations, or any of them
whether within or without the District, for the construction, use, or
maintenance of common or joint sewers, drains, outlets, or disposal plants, or
for the performance of any service required by the District, and
WHEREAS, Section 3.020(8) of the Charter of The Metropolitan St. Louis
Sewer District empowers the District to contract with, and thereunder to
permit municipalities, districts, other public agencies, individuals, or private
corporations, or any of them whether within or without the District, to connect
with and use the facilities of the District. The rates for such service and
connections shall be such as may be agreed upon between the contracting
parties,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into
a contract with the Northeast Public Sewer District whereby The Metropolitan
St. Louis Sewer District will treat sanitary sewage from real property within the
jurisdiction of the Northeast Public Sewer District where the topography has
rendered it impractical and economically infeasible for said real property to
connect to the sanitary sewage system of the Northeast Public Sewer District
and the Northeast Public Sewer District will treat sanitary sewage from real
property with the jurisdiction of The Metropolitan St. Louis Sewer District
where the topography has rendered it impractical and economically infeasible
for said real property to connect to the sanitary sewage system of The
Metropolitan St. Louis Sewer District.
Section Two. The contract authorized in Section One of this ordinance
shall be comprised of such terms and conditions as are approved by the office
of the General Counsel of the District.
The foregoing Ordinance was adopted August 9, 2001 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, C.D. Seward, A.J. Soukenik, and M.C.
Williams.
Nays – None.
