HomeMy Public PortalAbout11079O R D I N A N C E NO. 11079 AN ORDINANCE, appropriating Thirty Million Five Hundred Thousand Dollars ($30,500,000.00) from the Sanitary Replacement Fund of the District to pay the settlement and related costs for the District’s 1992 User Rate Class Action litigation. WHEREAS, the Director of Finance has certified that there is an unencumbered balance in the above-named fund sufficient to pay the obligation authorized herein, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The sum of Thirty Million Five Hundred Thousand Dollars ($30,500,000.00) is hereby appropriated from the Sanitary Replacement Fund of the District to pay the settlement and related costs for the District’s 1992 User Rate Class Action litigation. Section Two. This ordinance, being an appropriation ordinance, shall take effect immediately contingent upon a favorable ruling by the United States Supreme Court in the aforesaid 1992 User Rate Class Action Litigation. The foregoing Ordinance was adopted September 25, 2001 by the following vote – Ayes – M.G. Reichert, C.D. Seward, A.J. Soukenik, and T.W. Purcell. Nays – None. Secretary-Treasurer
