HomeMy Public PortalAbout11173 O R D I N A N C E NO. 11173 AN ORDINANCE, authorizing the Executive Director and Secretary- Treasurer to lease certain real property of The Metropolitan St. Louis Sewer District, lying in south St. Louis County, Missouri, to Gateway Trailnet, Inc. of St. Louis County, Missouri, and to execute a Lease Agreement upon the conditions hereinafter set out. WHEREAS, The Metropolitan St. Louis Sewer District hereinafter called Lessor, has acquired certain real property in St. Louis County, Missouri, incident to its public functions and responsibilities, said property being for open space purposes, and WHEREAS, Gateway Trailnet, Inc. is desirous of leasing from Lessor said real property to be used as an extension to the Carondelet Greenway, and WHEREAS, the Board of Trustees has determined that it is in the public interest to lease said property to Gateway Trailnet, Inc. and the public interest will be best served by suspending the provisions of Resolution 1960, adopted December 12, 1990 in order to effect said lease, and WHEREAS, the execution of said lease will not interfere with the purpose for which said real property was acquired. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to Gateway Trailnet, Inc., upon the general terms and conditions hereinafter set forth, the following described real property; PARCEL 3 A parcel of ground being part of Lots 75 and 76 of Sigerson Nursery Tract in Block 6 of CARONDELET COMMONS, South of the River des Peres, together with the Southwestern 10 feet of Roosevelt Avenue, vacated by Order of the St. Louis County Court, recorded in Book 354, Page 155 of the St. Louis County Records, in Township 44 North, Range 6 East, St. Louis County, Missouri, said parcel being more particularly described as follows: Beginning at the point of intersection of the Southwest line of said Lot 75 and the Southeast line of the Missouri Pacific Railroad right-of-way, 100 feet wide; thence along the Southeast line of the Missouri Pacific Railroad right- of-way in a Northeastwardly direction 453.46 feet along a curve to the right, having a radius of 1,382.39 feet to a point of compound curve; thence continuing along said Southeast line in a Northeastwardly direction 463.31 feet along a curve to the right, having a radius of 1,336.19 feet to a point of tangency; thence continuing along said Southeast line North 76 degrees 23 minutes 08 seconds East 363.40 feet to the Southwest line of Roosevelt Avenue 50 feet wide; thence South 53 degrees 59 minutes 30 seconds East 324.32 feet along the Southwest line of Roosevelt Avenue, 50 feet wide, to the Northeast prolongation of the Southeast line of said Lot 76; thence South 36 degrees 00 minutes 30 seconds West 26.6 feet along said Northeast prolongation and along the Southeast line of Lot 76 to the North bank of Gravois Creek; thence North 81 degrees 01 minutes 45 seconds West 116.95 feet along said North bank to an angle point; thence South 53 degrees 53 minutes 35 seconds West 142.51 feet along the Northwest bank of Gravois Creek to the Northwest line of property described in deed to Santa Maria Country Club, recorded in Book 2925, Page 241 of the St. Louis County Records; thence in a Southwestwardly direction along the Northwest line of said Santa Maria Country Club property the following courses and distances: South 76 degrees 22 minutes 75 seconds West 168.88 feet, South 75 degrees 16 minutes 25 seconds West 172.11 feet, South 67 degrees 33 minutes 35 seconds West 246.26 feet, South 56 degrees 29 minutes 05 seconds West 231.88 feet, and South 44 degrees 04 minutes 35 seconds West 214.89 feet to the Northeast line of Mount Olive Road, 30 feet wide; thence North 54 degrees 01 minutes 00 seconds West 273.97 feet along the Northeast line of Mount Olive Road, 30 feet wide, to the point of beginning and containing 353,610 Square Feet or 8.118 Acres, more or less. PARCEL 4 A parcel of ground being part of Blocks 7 and 36 of CARONDELET COMMONS, South of the River des Peres, Township 44 North, Range 6 East, St. Louis County, Missouri, said parcel being more particularly described as follows: Beginning at the most Southern corner of said Block 7; thence North 54 degrees 07 minutes 00 seconds West 244.89 feet along the Southwest line of said Block 7 to the East line of the Missouri Pacific Railroad right-of-way, 100 feet wide; thence Northwardly along the East line of the Missouri Pacific Railroad right-of-way 1,429.89 feet along a curve to the right, having a radius of 1,382.39 feet to the Southwest line of Mount Olive Road, 30 feet wide; thence South 54 degrees 01 minutes 00 seconds West 769.36 feet along the Southwest line of Mount Olive Road, 30 feet wide, to the center line of Gravois Creek and the most Northern corner of property described in deed to the Santa Maria Country Club, recorded in Book 2927, Page 337 of the St. Louis County Records; thence South 35 degrees 53 minutes 00 seconds West 350.00 feet along the Northwest line of said Santa Maria Country Club property to its most Western corner; thence South 54 degrees 01 minutes 00 seconds East 214.00 feet along the Southwest line of said Santa Maria Country Club property to the Northwest line of Diebold Terrace, a subdivision recorded in Plat Book 99, Page 65 of the St. Louis County Records; thence South 35 degrees 53 minutes 00 seconds West 404.95 feet along the Northwest line of said Diebold Terrace to a point; thence North 54 degrees 01 minutes 00 seconds West 75.00 feet to the Southeast line of said Block 7; thence South 35 degrees 53 minutes 00 seconds West 438.66 feet along the Southeast line of Block 7 to the point of beginning and containing 837,219 Square Feet or 19.220 Acres, more or less. EXCEPTING THEREFROM, that area as shown hachured on Exhibit A as attached hereto and made a part hereof. Section Two. The lease term shall be for one (1) year at the rental of One Dollar ($1.00) per year with an option to renew this lease for an additional five (5) one-year terms upon the same terms and conditions. Section Three. The Executive Director and Secretary-Treasurer are hereby authorized to execute in behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other general terms and conditions as are approved by the General Counsel of the District. The Foregoing Ordinance was adopted February 20, 2002 by the following vote – Ayes- T.W. Purcell, M.G. Reichert, A.J. Soukenik, C.D. Seward, and J.W. Siscel. Nays – None. Secretary-Treasurer
