AN ORDINANCE, vacating a portion of a ten foot (10’) wide
easement recorded in Deed Book 11523, Page 1395 of the St. Louis County
Records, and shown on the “Easement Plat-Brentwood Pointe,” as recorded in
Plat Book 349, Page 349 of the St. Louis County Records, said easement being
in Lot 1 of “Dierbergs-Brentwood Pointe” a subdivision according to the plat
thereof as recorded in Plat Book 349, Page 713 of the St. Louis County
Records, in the City of Brentwood, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested this
District to vacate the portion of subject easement, and this District has no
further use for said portion,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of the ten foot (10’) wide easement
recorded in Deed Book 11523, Page 1395 of the St. Louis County Records, as
shown hachured on the attached “Easement Vacation Plat”, and marked
Exhibit “A” and made a part hereof, is hereby vacated, EXCEPTING
THEREFROM the easements established by the “Easement Plat-Brentwood
Pointe” as recorded in Plat Book 349, Page 349 of the St. Louis County
Records, in the City of Brentwood, St. Louis County, Missouri.
The Foregoing Ordinance was adopted March 27, 2002 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, A.J. Soukenik, C.D. Seward, and J.W.
Siscel.
Nays – None.
