AN ORDINANCE, vacating any rights, title, or interest of the
District in a ten foot (10’) wide easement granted to Millstone Construction,
Inc. as recorded in Deed Book 5377, Page 155 of the St. Louis County Records,
and in the mutual easements granted in the Reciprocal Easement Agreement
as recorded in Deed Book 7271, pages 502 thru 508 of the St. Louis County
Records, all as shown on the “Easement Plat-Brentwood Pointe”, as recorded in
Plat Book 349, Page 349 of the St. Louis County Records, said easements being
in Lot 1 of “Dierbergs - Brentwood Pointe” a subdivision according to the plat
thereof as recorded in Plat Book 349, Page 713 of the St. Louis County
Records, in the City of Brentwood, St. Louis County, Missouri.
WHEREAS, the owner of this land has requested that this District
vacate any rights, title, or interest that the District may have in the subject
easements, and this District has no further use for said easements,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District hereby
vacates any rights, title, or interest of the District in a ten foot (10’) wide
easement granted to Millstone Construction, Inc. as recorded in Deed Book
5377, Page 155 of the St. Louis County Records, and in the mutual easements
granted in the Reciprocal Easement Agreement as recorded in Deed Book 7271,
Pages 502 thru 508 of the St. Louis County Records, all as shown hachured on
the Vacation Plat marked Exhibit “A” as attached hereto and made a part
hereof, EXCEPTING THEREFROM the easements established by the “Easement
Plat – Brentwood Pointe”, as recorded in Plat Book 349, Page 349 of the St.
Louis County Records, in the City of Brentwood, St. Louis County, Missouri.
The Foregoing Ordinance was adopted March 27, 2002 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, A.J. Soukenik, C.D. Seward, and J.W.
Siscel.
Nays – None.
