O R D I N A N C E NO. 11206
AN ORDINANCE, declaring the necessity for the acquisition of
easements in certain real property within The Metropolitan St. Louis Sewer
District for the purpose of revisions and enlargement of the Riverwoods Pump
Station and construction of related appurtenances in the project known as
Riverwoods Pump Station P-738 (Infrastructure Repair #192) 97043 to serve the
needs of residents of the area, and authorizing the acquisition of said easements
by purchase or by the institution of condemnation proceedings.
WHEREAS, there exists within The Metropolitan St. Louis Sewer
District an area of the County of St. Louis within the Missouri River Watershed
wherein live and work numerous people; and
WHEREAS, sanitary and storm sewage gathered from such area will
have no adequate means of disposition, and will constitute a menace to public
health and welfare of the general public and the residents of The Metropolitan St.
Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis
Sewer District to protect the public health and welfare by construction,
reconstruction, maintenance or repair of the sanitary sewer lines and
appurtenances on, over and across said area in order to relieve and alleviate these
conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF

TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve
insanitary and dangerous conditions, it is necessary to appropriate and acquire by
the exercise of eminent domain or otherwise easements in real property for the
revision and enlargement of the Riverwoods Pump Station and construction of
related appurtenances in the project known as Riverwoods Pump Station P-738
(Infrastructure #192) 97043 hereinafter set forth, said easement being more
particularly described as follows:

A permanent sewer easement and a temporary constructions license across
part of Survey 141 of St. Ferdinand Common Fields, Township 47 North, Range
6 East in St. Louis County, Missouri, being more particularly described as
follows:
Permanent Sewer Easement
COMMENCING at a point in the East line of the tract of land conveyed to
Alexander and Adeline Aubuchon by Deed Book 2124, Page 138 of the St.
Louis County Records, said point being the northwest corner of a tract of land
conveyed to Alexander J. and Adeline E. Aubuchon by Deed Book 7865, Page
1925 of said St. Louis County Records; thence South 52 degrees 19 minutes 00
seconds East along the southwest line of said tract of land conveyed to
Alexander J. and Adeline E. Aubuchon by Deed Book 7865, Page 1925, a
distance of 17.63 feet to the POINT OF BEGINNING; thence continuing along
said southwest line South 52 degrees 19 minutes 00 seconds East, a distance
of 75.02 feet; thence South 36 degrees 24 minutes 28 seconds West, a distance
of 26.03 feet; thence North 53 degrees 35 minutes 57 seconds West, a distance
of 75.00 feet; thence North 36 degrees 24 minutes 54 seconds East, a distance
of 27.71 feet to the POINT OF BEGINNING.

Said easement containing 2,015 square feet or 0.05 acres, more or less.
Also a temporary construction license for use during the construction in the
above described permanent sewer easement, said temporary construction
license being more particularly described as follows:
Temporary Construction License
BEGINNING at a point in the East line of the tract of land conveyed to
Alexander and Adeline Aubuchon by Deed Book 2124, Page 138 of the St.
Louis County Records, said point being the northwest corner of a tract of land
conveyed to Alexander J. and Adeline E. Aubuchon by Deed Book 7865, Page
1925 of said St. Louis County Records; thence South 52 degrees 19 minutes 00
seconds East along the southwest line of said tract of land conveyed to
Alexander J. and Adeline E. Aubuchon by Deed Book 7865, Page 1925, a
distance of 17.63 feet; thence South 36 degrees 24 minutes 54 seconds West, a
distance of 27.71 feet; thence South 53 degrees 35 minutes 57 seconds East, a
distance of 75.00 feet; thence North 36 degrees 24 minutes 28 seconds East, a
distance of 26.03 feet to said southwest line; thence South 52 degrees 19
minutes 00 seconds East along said southwest line, a distance of 28.54 feet to
the northerly line of a 10' wide sewer easement as shown on Deed Book 7408,
Page 2274, thence along
said northerly line South 46 degrees 22 minutes 33 seconds West, a distance of
51.17 feet; thence North 53 degrees 35 minutes 57 seconds West, a distance of
104.16 feet; thence North 27 degrees 41 minutes 00 seconds East, a distance
of 53.73 feet to the POINT OF BEGINNING.
Said temporary construction license containing 3,815 square feet or 0.09 acres,
more or less.
The temporary construction license shall become null and void upon the
completion of this project.
Section Two. Counsel for The Metropolitan St. Louis Sewer District be
and is hereby authorized to enter into contracts to acquire by purchase if possible,
or to institute and prosecute an action in condemnation pursuant to the
provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of

the State of Missouri for the appropriation of private property rights as
hereinabove set out.
The Foregoing Ordinance was adopted April 11, 2002 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, A.J. Soukenik, C.D. Seward, and M.C.
Williams.
