AN ORDINANCE, authorizing the Executive Director and
Secretary-Treasurer to subordinate certain rights along the length of an
easement owned by The Metropolitan St. Louis Sewer District, and
recorded in Deed Book 7009, pages 1165 and 1166 of the St. Louis
County Records, to St. Louis County, Missouri for the purpose of
operating and maintaining a public roadway fifty feet (50’) wide known as
Birchmont Place Drive and a variable width roadway known as
Baumgartner Road in a subdivision known as Birchmont in St. Louis
County, Missouri, as recorded in Plat Book 348, page 508 of the St.
Louis County Records.
WHEREAS, the subordination of said rights in said easement
will not interfere with the sewer services provided therein,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District does
hereby subordinate certain rights along the length of an easement owned
by the District, and recorded in Deed Book 7009, pages 1165 and 1166
of the St. Louis County Records, to St. Louis County, Missouri for the
purpose of operating and maintaining a public roadway fifty feet (50’)
wide known as Birchmont Place Drive and a variable width roadway
known as Baumgartner Road in a subdivision known as Birchmont in St.
Louis County, Missouri, as recorded in Plat Book 348, Page 508 of the
St. Louis County Records.
Section Two. The Executive Director and Secretary-
Treasurer are hereby authorized to execute on behalf of the District an
instrument giving effect of Section One hereof, said instrument to be
comprised of such terms and conditions as are approved by the Office of
the General Counsel of the District.
The Foregoing Ordinance was adopted May 13, 2002 by the following
vote –
Ayes – T.W. Purcell, M.G. Reichert, A.J. Soukenik, C.D. Seward, J.W.
Siscel, and M.C. Williams.
Nays – None.
