AN ORDINANCE, transferring the total balance in the University City
Sewer Improvement Fund to the Operation, Maintenance and Construction
Improvement Fund of the University City Branch of River des Peres in order to
close the University City Sewer Improvement Fund; transferring Three Hundred
Fifty Thousand Dollars ($350,000.00) from the Sanitary Replacement Fund to the
Operation, Maintenance and Construction Improvement Fund of the University
City Branch of River des Peres, and appropriating Two Million Eight Hundred Fifty
Thousand Dollars ($2,850,000.00) from the Operation, Maintenance and
Construction Improvement Fund of the University City Branch of River des Peres
to be used for project costs for the construction of a storm channel and sanitary
sewers in Archer-Braddock-Coolidge-Grant Storm Channel Phase III and UR-06
Phase I (91000C), in the City of University City, Missouri; and authorizing the
Executive Director and Secretary-Treasurer on behalf of The Metropolitan St.
Louis Sewer District to enter into a contract with Fred M. Luth & Sons, Inc. for the
construction of the aforesaid storm channel and sanitary sewers.
WHEREAS, the bid for the construction of said storm channel and
sanitary sewers is Two Million Four Hundred Fifteen Thousand Five Hundred
Seventy-nine and 75/100 Dollars ($2,415,579.75), and the allowance for
construction change orders is Four Hundred Thirty-four Thousand Four Hundred
Twenty and 25/100 Dollars ($434,420.25), and
WHEREAS, the State of Missouri has agreed to contribute One
Hundred Thousand Dollars ($100,000.00) toward the total costs of said project;
upon the receipt of such funds from said source, said money will be returned to
the Operation, Maintenance and Construction Improvement Fund of the
University City Branch of River des Peres.
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The total balance in the University City Sewer
Improvement Fund is hereby transferred to the Operation, Maintenance and
Construction Improvement Fund of the University City Branch of River des Peres
in order to close the University City Sewer Improvement Fund.
Section Two. The sum of Three Hundred Fifty Thousand Dollars
($350,000.00) is hereby transferred from the Sanitary Replacement Fund to the
Operation, Maintenance and Construction Improvement Fund of the University
City Branch of River des Peres.
Section Three. The sum of Two Million Eight Hundred Fifty
Thousand Dollars ($2,850,000.00) is hereby appropriated from the Operation,
Maintenance and Construction Improvement Fund of the University City Branch
of River des Peres to be used for project costs for the construction of a storm
channel and sanitary sewers in Archer-Braddock-Coolidge-Grant Storm Channel
Phase III and UR-06 Phase I (91000C), in the City of University City, Missouri.
Section Four. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter
into a contract with Fred M. Luth & Sons, Inc. as the lowest responsible bidder for
the construction of a storm channel and sanitary sewers in Archer-Braddock-
Coolidge-Grant Storm Channel Phase III and UR-06 Phase I (91000C), in the City
of University City, Missouri, pursuant to bids received and opened on the 30th day
of April, 2002.
Section Five. This ordinance, being an appropriation ordinance, shall
take effect immediately upon its enactment.
The Foregoing Ordinance was adopted June 26, 2002 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, A.J. Soukenik, C.D. Seward, J.W. Siscel, and
M.C. Williams.
Nays – None.
Secretary-Treasurer
