AN ORDINANCE, appropriating Seventy-five Thousand Dollars
($75,000.00) from the Operation, Maintenance and Construction Improvement
Fund of Maline Creek for the purchase and demolition of certain real property in
the City of Ferguson, Missouri known in and numbered as 610 Cunniff Place for
flood mitigation purposes in Cunniff Place Channel Improvement (99108), and
authorizing the Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District to purchase and demolish said real property.
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Seventy-five Thousand Dollars ($75,000.00)
is hereby appropriated from the Operation Maintenance and Construction
Improvement Fund of Maline Creek for the purchase and demolition of certain real
property in the City of Ferguson, Missouri in known and numbered as 610 Cunniff
Place for flood mitigation purposes in Cunniff Place Channel Improvement
(99108).
Section Two. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to
purchase and demolish certain real property in the City of Ferguson, Missouri
known and numbered as 610 Cunniff Place for flood mitigation purposes.

Section Three. Upon the execution and delivery to the District of a
General Warranty Deed in proper form conveying title to the above-described real
property to The Metropolitan St. Louis Sewer District, the Executive Director and
Secretary-Treasurer are hereby authorized to pay to the grantors for said real
property.
Section Four. This ordinance, being an appropriation ordinance, shall
take effect immediately upon its enactment.
The Foregoing Ordinance was adopted June 26, 2002 by the following vote –
Ayes – T.W. Purcell, M.G. Reichert, A.J. Soukenik, C.D. Seward, J.W. Siscel, and
M.C. Williams.
Nays – None.
