AN ORDINANCE, authorizing the Executive Director and
Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into a Settlement Agreement with the Missouri
Department of Natural Resources, the Missouri Clean Water
Commission, and the Missouri Attorney General to ensure that the
District will take certain measure to achieve temporary compliance with
the Baumgartner Lagoon permit effluent limits until such time as the
Baumgartner Lagoon is taken off line.
WHEREAS, in the litigation entitled State of Missouri ex rel.
William L. Webster, et al v. The Metropolitan St. Louis Sewer District,
the District entered into an Amended Consent Judgment which, in part,
provided that the District would achieve and continue to achieve
compliance with the Missouri State Operating Permit effluent limitations
at the Baumgartner Lagoon, and
WHEREAS, the District has been unable to consistently meet
said permit effluent limitations at the Baumgartner Lagoon, and
WHEREAS, the Settlement Agreement as hereinafter
authorized will the District to take certain measures to achieve
temporary compliance with the Baumgartner Lagoon permit effluent
limits until such time as the Baumgartner Lagoon is taken off line,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-
Treasurer are hereby authorized on behalf of The Metropolitan St. Louis
Sewer District to enter into a Settlement Agreement with the Missouri
Department of Natural Resources, the Missouri Clean Water
Commission, and the Missouri Attorney General to ensure that the
District will take certain measures to achieve temporary compliance with
the Baumgartner Lagoon permit effluent limits until such time as the
Baumgartner Lagoon is taken off line.
Section Two. The Settlement Agreement as authorized in
Section One of this ordinance shall be comprised of such terms and
conditions as are approved by the Office of the General Counsel of the
District.
The Foregoing Ordinance was adopted June 26, 2002 by the following
vote-
Ayes – T.W. Purcell, M.G. Reichert, A.J. Soukenik, C.D. Seward, J.W.
Siscel, and M.C. Williams.
Nays – None.
